The Real Property team has received a petition to vacate a portion of a platted ingress-egress easement, a utility easement, and the rear lot lines of lots 41 and 42 of Shooting Star Court by Sunfield Homes and Orsi Development. The purpose of the vacation is to enable the petitioners to create buildable lots for future residential construction. There were no objections to this petition and the team recommends approval.

Joanne RivitaUm it's my understanding is that it is just currently vacant land that they were going to develop. But they realized that they could not develop it, so they wanted to remove the ingress egress easement so that they could develop the two residential lots in the front.
StarkeyChairWell um I'm just wondering is that is that land can you pull up the map? Yes. Is that is there any up is there any value to keep access to that land? Could it become a park or s anything like that?

I have um a bigger drawing if that helps any. Um so we still own that parcel and we also own parcels or a lot. Uh forty-one and forty-two. Originally we tried to do some development plans and they were opposed not only by the HOA but also by the
county. So at this point,

And what we've done is we've basically split it in half and attached it to lot 41 and lot 42. So Our goal is to sell those two platted lots, but right now the easement between the lots, instead of having a s a seven and a half foot side yard setback, you have a 17 and a half. So with a pie
lot you've got almost no building pad. Yeah. So because we can't use the back, all we're trying to do is make the units that are there more buildable. Oh that's a good thing. anymore.

And the reason why I showed you the green area, um, because as you can see, each of those green tracks are HOA tracks, and the green going between the lots is the access to the green tracks as platted. So this particular easement doesn't have anything to do with the HOA. It was something that we were required to do. During Plat in order to have access, ingress, egress, and utilities for the future development, which
as I said is no longer happening.
StarkeyChairThere was a time when um I know when this used to be our property. Yes. There there was a hope that somewhere this would connect back to Starkey Boulevard instead of everyone going up, you You know, there's only one one exit. Although I I do hope to connect Amazon and Anaconda. David Engel, that's the piece I was showing you right there? There's a little spite strip there from uh left over that now I think we might own it now and we can do that connection. Um So
I you know there's no useful land behind there and no reason to not approve this. I would ex entertain a motionless question? Yeah.
OakleyYeah, just a question. Um so the area that's marked pink on I guess those are lots. You're not going to build on those two lots?

Unidentified speakerVoice AAnd the pink tract is now basically divided in half. Half of it goes with 41 and half of it goes with 42. You you can't see that on there. But you can see that right where the easement is, if you continue to draw the line straight where it hits the top of the page, that's pretty much where it's at.

OakleyOkay. I thought you said something about electric and Sewer and all hookup, is that a hookup? Can that be done with that project for this property here?
Unidentified speakerVoice AUm the water and sewer were built with the original project. They're at the front lot line in the utility easement for forty one and forty two. There's two stub outs, one for each lot.
OakleyYeah. So you'll connect those for these lots behind?
Unidentified speakerVoice AWell there is no lot in behind. It's just the land behind will go with the lot in the front.
