    Excellent. Okay, so agenda item PC3 is going to be PD 21-7522 in the name of Amber Thomas. It's a special exception request for a home-based male artist in an R3 residential district, medium density. It's located on the north side of Carr Drive, approximately 280 feet east of Farms Drive, Zether Hudson.

    The subject site contains a single family dwelling and a shed on approximately 0.22 acres. On December 16, 2020, the property owner received an ordinance violation notice for a permitted use violation. The applicant is requesting a special exception to allow the home-based male artist in an R3 medium-density residence in the state. Microfilm occupations are permitted successory uses in R3 districts, and the trip generation associated with this occupation requires special section approval.

    And so here's just a look at this throughout the zoning. It's R3 to the north, south, east, and west. And the future land use of the site is Red 6. And then just one last slide showing the aerial and the access on car drive. And um So the approval, a recommendation of approval with conditions, and then I have some of the conditions listed on the next slide. So the special exception

    approval would be limited to just this site, 0.22 acres as submitted for the application. All business arranged visits would be by appointment only and would be limited to one customer at any given time. And exterior signs that would be visible from the street or neighboring dwellings that would be associated with this home occupation would be prohibited.

    The approval of the special section would not run the land and would not be transferred to another owner or lese of the property. And the applicant would be required to maintain all required county and state health permits, licenses, and certifications. And then the last condition we have is just the standard one where they were in any way violating any of the conditions of this approval that it could be revoked.

    I I do actually, uh Mr. Chairman. Couple of questions. Um Christina, what what's the anticipated ship dr trip generation or you know it appears the business was in operation before this? I mean, what was the nature of the trip generation to the business? Number one. Number two, is there hours of operation that would be um considered as part of this too?

    Um, we could add as a condition, hours of operation, if that would be better, and uh we could talk to the applicant about how many people she could see in a day. I know that in previous conversations with her, she said that the kind of nail work that she does takes between two and three hours per person, so she can't really handle the kind of volume the You know, we're creating a lot of third generation. She's thinking between three and four cars a day maximum. And um

    and you know, it's really just something that she's doing in her free time. So I know she's uh she's on the line and she has a little presentation that she wants to give to you to kind of explain what it is that she's doing and um what you could expect if this were approved.

    I have a couple of questions. Yeah, go ahead, Pete. They pertain to traffic. Is this a street that you can park on?

    So it is my understanding that they are not permitted to park on the street at all in this neighborhood.

    My question then leads to the question what If there's a backup, in other words client A is there and still there, would client B arrives, or will client B park her or his car?

    Okay, so the the way we have it written up, she would not be permitted to have someone in reading. She's only to have one client at a time. I think sometimes when we approve these special exceptions, we allow one customer to be in waiting, but because there was some opposition in the neighborhood, I should prefer and make sure that would be okay, that it would just be one person at a time with no one in reading. And so she understands that she would have to stagger her appointments. Just in case one of them ran over, that she wouldn't have someone waiting in the wings. Because I know the traffic lift was

    an issue. Because this was a code violation, we had an officer from our code enforcement department. He's been out there numerous times, and he said that even when he observed the use violation, there were never more than two hours to the crack.

    I think that you And I I just want to say that I'm I'm semi-retired and I'm just doing this as a hobby. And the code enforcement officer said I I have to make this a business since I can't do it as a hobby. You guys don't recognize hobby because of the trip generation. So I I think I don't want to cause my neighbors any distress. I don't want to. Is anybody I only I only wanna do a minimum amount of people to

    keep my skills up. I have other irons in the fire. Um I'm I'm not a commercial nail salon. I have a nail desk in my dining room. Um I have off street parking. Um, you know, I I don't generate nearly the traffic my neighbors do and the Christmas light show does and the Halloween light show does. Um I'm a specialist nail artist. I I don't do pedicures. I don't. do

    any beauty treatments. I design on nails with gems and shellac and drawing and art. Um and I I

    I I'm so um uh conscious of not wanting to disturb my neighbors that I'm happy to go along with whatever it takes during this COVID period. to get me through until I decide what I'm actually going to do. Oh my I prefer to keep it a hobby, but If it's gonna be a business then

    Welcome. Just so you'll know, what we try to do is to not cover the same ground too many times. So if you're and I'm bringing up a t particular topic and Speak to it thoroughly. the next person we'd like to cover something else. So um Go ahead and start.

    My name is Joe Handley. I live at [address removed], which is directly across the street from Ms. Thomas's house. It may not be this way in the future, but in the past we have seen cars parked in the street. In fact almost backed in one backing out of my driveway one day was parked in the street. I have seen as many as three and five cars at a time over there. That is the best of my knowledge, memory. It may have been four or five. It might have been three or five. Um, it's gonna affect our property values. My wife and

    I bought our home a little over four years ago. It's going to be our retirement home. We plan on dying in that house. And this by two realtors we've talked to will affect our values and our property. And one of the other big concerns is the traffic issue in the neighborhood. Any bail business such as Ms. Thomas is in, which again we don't want to cause distress to our neighbors and I anguished over whether he'd even be in on this today, but I feel we have a responsibility. Nail salons in my understanding are just like haircuts

    and any other beauty parlor. Their busiest days are usually Friday, Saturday, and Sunday. This is also the days our children are out of school. This is the days that the families who do work are home trying to enjoy the sanctity of their home. This is going to be the heaviest traffic days. We don't want that. It's just we put submitted a petition, which I think Christina has, that there's roughly 90 homes in our face, one, two, and three. Of the 90 homes, I believe that there's 65 signatures in that 90

    homes opposing. Uh when we took the petitions around We eliminated there's four rental houses I'm positive they were eliminated. One house is on lockdown from COVID. Obviously I didn't get their signature. The rest of the people who were not home. But of the ones that we found and got to, I think there's around 60, 65 signatures out of 90 residences. That's a pretty good percentage of don't want this. Um Really that's about all I got to say. I

    don't again don't want to cause grief to my neighbor. But this has been going on for eight months and it has not been pleasant when it was illegal, much like what it'll be in the future. So that's really all I have to say.

    Good afternoon, Commissioners. My name is Christine Smith. I live across the street from Amber Thomas. I'm at [address removed]. My concern with this is the parking. I'm not sure if you can see, but I have actually a photo of Amber the front of her house. There's really not much parking for her clients and we all know it's salons. They run behind. They just do. You get talking, you add extra stuff to nails. Um clients can even run late, pushes her whole day behind.

    Um also on her Facebook, she has sixteen thousand followers. So I mean she does have a lot of clientele. Um She in her home, I don't know if you can see these photos, she has rooms set up, couches, she has um table, chairs.

    I am sorry. Oh for overflow. Okay, these this is a section for overflow to sit. Um here is another one she's got her I I guess where she does nails and then across we have a table with two chairs and it is for overflow. We all know that it's gonna happen. Commissioner, you guys won't be there all the time. Um you know, if this happens. Also I wanted to show you um It is it's a residential area and I have photos of our roads.

    They're not made for commercial. They're they're broken already as it is. We have potholes and there's only one way to get in and out of our neighborhood. And if you can see these photos that I've provided, um, they have the counties coming in and fixing them, you know, as much as they can. So we don't have You know, our roads aren't designed for this. And with sixteen thousand, you know, followers She should have a commercial location. Um Honestly,

    this is where our kids play. They they ride their bikes on the sidewalks. They do go in the roads as well. a car backing up, you know, extra we don't need any extra in our neighborhood. And that's really odd. When she was parked in the road, when I was backing up I almost hit a car as well. So this is where where I stand. Thank you.

    Good afternoon. My name is Russ Smith. I also live across the street at 38922 Carr. Um, my concern is that this variance would fundamentally change the dynamics of our neighborhood. Uh we would have extra traffic. We would have extra parking. There was that one time um I counted when her ha her ha her home was completely full in front of our house and there was two cars in the street. Um There were several cars and and they were in the way. One as my son was backing

    out and on his on his way to his part time job honked to him because he was getting close to the car that was parking in the road. So

    Um One of my other fears is that a a variance of this sort would open up the door to other variance. You know, perhaps a automobile shop. Hell child care.

    Those are my my concerns without being redundant on On the other two that have been here, those are my my concerns.

And I'm worried about all the chemicals that this lady uses. Where's she dumping them all? You know, are they going into the toilet? Is she exposed to them? You know, like regular commercial businesses do. You know, that's uh that's a big environmental impact that could happen on our water supply. And

    all of a sudden also that um there's needles showing up. You know, down in that area. You know, what's going on with all that? Is she using needles to do fine tuning on You know with their nail stuff? We don't know. But there's there's a lot of problems going on down there and we don't want this in the neighborhood.     Everyone keeps calling it a salon. It's not a commercial salon. I'm sitting at one desk doing nails by myself. Uh The overflow seating that they showed you pictures of is a love seat that is in my kitchen. And the table next to my desk is actually my dining room table. So I'm I'm not sure. where they think that's overflow. Uh I have Um nearly fifteen thousand followers on

    Facebook and a thousand on um

    other social media outlets. But they're from all over the world. They aren't local. Um, I would say less than five percent of my followers are local. I'm big into nail art. I'm a master nail art. I Just have a a a following uh because I do tutorials, I do things online. It's not my actual clients. I actually let my clients go when I let my salon go back in August. Um The way Uh first of all, we

    have city water in this neighborhood. I didn't know anybody wasn't on city water. Um

    Um How nail techs dispose of chemicals that we use. The only chemical I actually use, I use is um alcohol and acetone, what you would find in a normal house to remove nail polish. And how that's disposed of is by It evaporates really quickly and what even is on the paper towel that I dispose of evaporates before it even hits the trash can. But if there was a spillage or an overage, We dump it into a container

    with paper towels and we let that evaporate before it goes in the trash. I've never had to do it as of yet. I definitely do not have any needles of any sort. It's not part of the nail industry. Um

    I don't think, it doesn't sound like my neighbors know that this area is already zoned for both small and large home occupations. Um, I I don't feel like I'm bringing anything commercial into the area. Um And I the one instance they're talking about where he saw so many people parking. Um, I've done pampered chef, I've hosted pampered chef parties for friends. I do barbecues, I have Christmas parties. Um, I

    had people over for my son just got married. Um, I feel like whenever there is anybody at my home, they're taking it as customers. Like I don't have a right to have anybody at my house, period. Um and as for parking on a street, well It's done all over the neighborhood with multiple cars. But my people, I Make sure my driveway is free. They they don't even have to park on the road. It is a non-issue as far as I'm concerned. And I'm

    really sorry there's so many of my neighbors. I wish they would have come talk to me. I I I this probably could have been handled differently. That's all I have to say.

    We we don't have any approved special exceptions in that neighborhood, no. There may be people operating a business or operating a a business. Great trips. I believe one of the examples I was given was that someone was making cabinets in their in their garage, but not bringing people to the house for purchasing. So because it doesn't generate a trip, they're not required to have a special exception.

    can have my uh average customer day, whatever you guys deem it, because I didn't bring my customers with me from the salon. I'm starting all over. I was doing this as a hobby. until the code enforcement officer came. So I didn't bring my clients with me. Um, so this is starting all over again, but I don't Want A full busy day. I I'm happy to agree to the three people. I mean, it's gonna take me time to build

    clientele again.

    And Ms. Thomas, when when do you typically see your your clients? Is there specific days? Is it weekend based like like the uh the the folks who provide a comment set or is is it spread out through the week or when does that typically happen?

    Uh Well, when I had the salon, it was 7 a.m. to four PM.

    Sure, sure. But w what do you anticipate in your your home occupation?

    I guess I haven't given it much thought. I mean

    I don't have anybody on the books or and making appointments at the moment. Um Most of the people who are around me. um are at work early. So I'm happy to do it early and ha be over by the time they get home from work.

    Just just to be clear, the existing conditions do not have a cap on the number of Clients. Do not have powers of operation. So if those are factors that are important to the Planning Commission, you would need to add those as conditions.

    Yeah, I mean the the difficulty with this, uh honestly and I I think it was alluded to both by the applicant and Some of the people that spoke against it, I mean it's Obviously residential neighborhood, I'm stating things that are obvious, but residential neighborhood, but it look at look at just the pictures that are online. People park on the street, not just at this lady's house. This condition of approval does restrict one customer at a time. Um, so the parking will be in the driveway. Um I mean, people have parties, people

    have people over, so I mean the time there are times when you do exceed what you can fit just in your driveway. And I I mean I tend to agree with the applicant that she sometimes is targeted as having customers there when in fact they're not customers at all. Um, I mean we we've limited to to one customer at a time. I mean, personally I'm fine with this as long as I mean if we want to limit it to certain number of customers or certain business hours, but I I personally don't see where this creates the problem that's being indicated by the people that are uh

    here to speak against it.

    Mm-hmm. Well for I you know, I think that you know, I think the applicant said that she was doing it as a hobby, not as a moneymaker. That was her original intent. So uh you know I think it would be appropriate in that case then. She's only doing this because the county is insisting that she complies and that's that's appropriate. So um, you know, I think it's also

    then appropriate to put limitations on her hours and also on the number of people that she can service. That's my feeling. Probably certainly no more than three in any any one day. And if it takes uh two hours to do a to do one client, you know, that's a that's a six hour day and that's a Pretty strong hobby if you have three people. So I would say two to three people. What?

    Keep her skills intact. until she can build up her Practice again and move to our Appropriate. Retail area.

    I I I guess in regards to the hours of operation, I mean Ms. Thomas, what what are fair hours of operation? I mean, if it's limited to I mean, is it eight to six business? Is it a evening business?

    I definitely didn't want to make it evening because that's when my uh neighborhood is most active. Um, you know, people are out walking, they're uh outside talking, visiting, um, and they have a lot of cars themselves at that time. So I I was think definitely thinking early morning into the afternoon before people got home.

    That's fine. I jes, fine. Um, the only the only problem I would have is I'm being made to be a business, so I I've got to have a certain amount of customers to now make the business expenses. that if I get limited to my days.

    People try to come to me on their days off and they all vary. So some days I do nobody. Some weeks I do nobody. It's it's not. the way it's being pictured. I need some flexibility about the days that I can be open. The hour's fine. That you know, uh uh uh people can come during eight to five on days off. But limiting the actual days a week. Um that I would struggle with that. I don't know if I can say

    it or not, but I would struggle with that.

    Well, for for me, I think it's not necessarily the days that aren't need to be limited. It's it's I'm going right back to what you said initially, is you you were doing it as a as a hobby. Now now you're talking about covering your expenses. So uh what you know, which is it? Is it a business or is it your hobby that you're trying to get approved? Um

    I wanted I was told I couldn't have a hobby, that it had to be a business. So I have been putting steps forward. Two. make that happen. They told me I had to get a business uh tax receipt. You know, I'm uh I'm told that I have to make it a business, so that's what I've started doing.

    Well it depends on your own person's point of view. Obviously your neighbor.

    You know, I I think You know, I'm more sympathetic to you being able to pursue your hobby and keep your skills than I am to you opening a traditional business in your neighborhood. So, you know, I wouldn't be opposed to that. But I I'm not opposed to trying to accommodate your hobby. So that's that's

    No, I can't. It was doing it as a hobby. Went through the IRS. The only thing I could charge is for my materials.

    They used to, not since I had this proposal where I came over and said I couldn't have the hobby.

    Well yeah, the way I look at it is if you have a guy next to you that's building go uh golf carts and he's selling them. And bring the people in to look at 'em. you might not appreciate that, even if that's ev even if he considers that his hobby. So All I'm saying is that, you know, I I don't wanna stop you from doing your hobby, but I I think it's obvious that your neighbors feel it's an imposition on them for you to be operating a full fledged business there.

    And I think you're Splitting hairs when you're saying the county's forcing you to do a business. I don't think they are.

    This is Jamie Girardi. I'll make a motion for approval with um some amendments to the conditions. Um Recommended condition of approval number two says all business related visits shall be by appointment only and shall be limited to one customer at a given time. I think we need to add language in there that restricts um or prohibits on street parking. and limits the customers to no more than three customers per day.

    And I think we also need to add a condition that restricts the hours to eight AM to five PM seven days a week.
