    Denise

Mr. Chairman Denise Hernandez Planning and Development here again. So um if we can if if it's okay with you if we can move on to item P six.

    Charles GreyChair

    Yes, let's do that.

    Denise

Item P six says PD twenty one seven five five two. It's a zoning amendment, SR forty LLC, Riverside Village Unit 5. For a change in zoning from an R2 low density residential district to an MF1 medium density residential district for a total of 55 townhomes with deed restriction. Um this particular item after the uh the agenda was published, the applicant requested a continuance in writing to the October 28th, 2021 Planning Commission meeting at 1.30 p.m. in Newport Ritchie.

I know that there may be some folks here who may want to speak to the item, but I just wanted to um read that into record that there is a request for continuance on that item to October twenty eighth, twenty twenty one Planning Commission meeting at one thirty in Newport Ritchie.

    Jaimie GirardiVice Chair

Okay. So Mr. Chair, to be clear, they do have the right to speak today, um, but if they do, they will not be able to speak again when the item is continued to the new date. So I just wanted to alert.

They can speak today if they want to, but that would be your three minutes. When this comes back.

    Charles GreyChair

Okay, so is that clear to everyone or do you need further explanation? Is there anybody that would like to speak?

No, I'm sorry, that dis that does you know you'd be disqualified then.

    Jaimie GirardiVice Chair

    He's joking.

    Charles GreyChair

I'm just kidding. Of course you can. Come on up. Yeah.

    Marcus Coe

    Um

    Charles GreyChair

    lighten things up a

    Marcus Coe

little bit. I went to golf high school, so you can't go that far. So did I. So did I. I went there too.

Um my question on that is If they bring up new evidence, so what we've came to prepared to speak on today's behalf, a lot of us took off work again to be here. whatever new evidence that he produces, because he didn't show up, he asked for the continuance. us as individuals who have to take off work to show up here to try to get across our uh points. If he brings up something new, how are we still not allowed to speak? Because he's not improving uh he's not producing any information different from

last time that he was supposed to. He's asked for the continuation so he can provide that.

    Jaimie GirardiVice Chair

Yeah you could choose to speak at the next meeting when you have that new information. You don't have to speak today. You can wait till

    Marcus Coe

    we're

going to be able to do that.

Right. But my question is I have information that I wanted to bring up today. Now he's gonna produce new information. When he produces that new information, it should allow me, as long as I'm not repr repeating what I said.

    Jaimie GirardiVice Chair

There's nothing saying you have to speak today. You're

    Marcus Coe

choosing to speak today. Right. But it and it was Pop. We gotta when did we get notice that it was a continuance?

    Jaimie GirardiVice Chair

I realize that it was after the agenda was was posted, which is why you technically have the right to speak today. But

    Marcus Coe

Right, but then I don't have the chance to speak next time if I can get off work. So once again, we're holding a meeting. I brought this up last time. We're holding a meeting in the middle of the day where some people aren't afforded and you brought up the Web WebEx, you can't necessarily tell your boss, hey, I've got to sit here and watch this WebEx until I have my possible turn turn to talk. I don't know when that's gonna be.

    Jaimie GirardiVice Chair

Yeah. I get that you should have had more notice from the applicant to the continuance and you should direct those comments to the applicant, not the other.

I mean you could object to the continuance And ask that it be heard today. And then But uh it it's up to the Planning Commission to decide whether they want to continue it or not.

    Marcus Coe

But uh am I wrong in such a

    Jaimie GirardiVice Chair

are you objecting to the continuance?

    Marcus Coe

    Well I'm asking a question.

    Jaimie GirardiVice Chair

Okay. If you want to speak to why the item should not be continued, that's fine and you can get speak again at the next meeting. But if you're speaking to the substance of the item, you get one shot at that.

    Marcus Coe

Even if he provides new information from

    Jaimie GirardiVice Chair

Yes because you could wait to the next meeting when he's got new and waiting.

    Marcus Coe

That I wanted to talk to the validity of. Now he's gonna produce new information because what I wanna talk to is the validity of what he said. So that's him producing information after I got to speak. Then he's gonna produce new information again. On the next one. So that shouldn't change.

    Jaimie GirardiVice Chair

I understand that, but you can speak at the next meeting with whatever new information they provide. And my advice to you would be to wait because One of the th items that the Planning Commission asked for was a concept plan for this property. I don't think one's been delivered yet or shown. And so That would be new information that you may want to wait to see before you make your comments.

    Marcus Coe

That's one of the things I wanna talk about. But I had to take off way work again to come to do this and

    Charles GreyChair

Well let me just say that A lot of us are up here. We we took off work to be here too. And we do it e two times every month. So I appreciate what you're saying. Mm-hmm. But that's just the way it works. So we gotta have rules and regulations, we gotta follow 'em. It can't be chaos, it can't be Today it's this way and tomorrow it's a different way. So it was never but it was never posted. So on that day off.

    Chris Williams

    Okay.

    Charles GreyChair

And we we uh we required it to be in writing and we c required it to be, you know, in advance and it was, so we have to you know have to accept the request. We don't have to approve it. But it's been accustomed to approve that we have to do it. That's the P five,

    Marcus Coe

correct? Yes. The request for the R.

    Jaimie GirardiVice Chair

The remedy would be if you're upset with the continuance. Okay. Planning Commission doesn't have to approve the continuance and they can demand that the item be heard today.

    Charles GreyChair

    Okay.

    Jaimie GirardiVice Chair

    That's your remedy.

    Charles GreyChair

But you're not gonna get all the information. Because he doesn't have the concept plan. Okay, thank you.

    Marcus Coe

    Sorry, Marcus Co., [address removed].

    Golf High Grads.

    Charles GreyChair

    Cowbox.

    Jaimie GirardiVice Chair

I want to ask if anybody else wants to speak.

    Charles GreyChair

Anybody else? Does anybody else want to speak?

I see no one. Okay. So the um the uh motion I'm looking for is to continue continue this um His application until October twenty eighth, twenty nineteen uh twenty twenty one. In New Port Richey.

    Unidentified speakerVoice A

I'll make a motion to continue P five to ten twenty-eight. P six. Excuse me. P six. Sorry. Gotta go.

    Jaimie GirardiVice Chair

Before we hear the motion, can we just confirm the applicant doesn't want to say anything?

    Charles GreyChair

All right. Mr. Applicant, are you uh prepared to say anything? Or Mrs. Applicant.

    Barbara Wilhite

Barbara Will Hight, [address removed], New Portie, Florida.

Wouldn't that be nice? Um We are in a we request the continuance. We are working on the items that uh you requested further information on, and we look forward to being back here in the end of October. Thank you. Thank you.

    Charles GreyChair

Okay. I think we've cleared that now. So we have a motion.

    Unidentified speakerVoice B

There's I think there's already a motion on the floor, right?

    Charles GreyChair

    No, there is a I

    Unidentified speakerVoice B

I don't mind second it but I I do understand and I am Somewhat sympathetic to people that have to take off work, so If anything can be done to try to make sure that all the questions are answered and everything's ready for this item to be heard next time, I think that would be greatly appreciated by all.

    Jaimie GirardiVice Chair

Okay, so let me add, or if it can't, make sure it's noticed as a continuum. on the agenda. So I mean Tell us about the continuance well before so we can put it on the agenda as a continuance.

    Charles GreyChair

Okay, I think that was Barbara's fault.

    Chris Williams

I just want to go to Gold High School. No, it's this true. I just want a clarification on the date of October twenty eighth. Twenty eighth of October. Okay. Go things.

    Charles GreyChair

All right, so I think we have a motion or second to have we do. Any further discussion?

    Unidentified speakerVoice A

    Second.

    Charles GreyChair

Any further discussion? All in favor? Signify by saying aye. Aye. Aye. Opposed? Like signed? All right. Motion carries.

    Michael Dadey

    Okay.
