    Liam Devine planning developing. Happy New Year's. Um this is item P12. Before I begin, I do want to note that there was an update to attachment nine. That was for the affidavit. It was not notarized. A notarized copy has been sent to the clerk's office.

    Um item P D D 24-7758 in the name of Carlton E. and Elise Ellison. It is the Euclidean zoning amendment from AR Agricultural Residential District. To C2 General Commercial District with a future land use classification of COM Commercial under the comprehensive plan. There was a Comp Plan amendment back in August, August 8th of 2023, of that change from REST 6 to COM Commercial. The proposal is to develop the property

    with a maximum of 110,000 square feet self-storage facility in conformance with the C2 General Commercial District standards. And the subject site is located on the south side of Curley Road, approximately 850 feet northeast of the intersection of Curley Road and State Road 54.

    The subject site is located in the South Market area and is located in the urban service area and is outside of the rural areas.

    The surrounding future land use to the northeast and south is all Res 6. To the west is Com Commercial and Res 6. The surrounding zoning to the north is AR and MPUD. It's of the Pine Ridge M Pud. To the east is AC, to the south is AR, and to the west is AR. The subject site consists of a single family dwelling in approximately 4.423 acres. On October 17, 2023, the applicant held a neighborhood meeting, and this is coming with a voluntary agreed-upon deed restriction as

    provided in your agenda packet. And this is coming with a recommendation of approval from P D D staff. Do you have any questions?

    Uh and uh for the record Kevin Ray Alley 401 East Jackson Street in Tampa and to the Chairman's question, um we we have a presentation prepared and we asked for some more time. Um uh but in the absence of opposition here if there's no one online, uh we're really just there to answer questions. Um the history here as to why there were questions is if you all remember um the future land use application change for this property included property to the west and there were subsequent um uh app not

    applications but uh submissions to staff for pre-apps and things to develop that with a more intense use. Uh we had our neighborhood meeting we explained that this is this is not what that is. This is just a portion of that future land use map change. So with the pleasure of the commission we have a presentation but um otherwise if if there are no questions we'll we'll just um stand by.

    Ooh, I don't have the letter in front of me, um, so I don't want to misquote it. Um but if you give me a second I can pull it up and we can refresh my memory and I could write that.

    Writing to you as a concerned resident, I live in the Pine Ridge community. It's increased traffic on Curly Road. The traffic uses Curly Road is predominantly residential. This property is directly behind my home. It's going to impact my property value. There's going to be noise behind my house. The area still consist of trees and nature. Nobody wants a view from their home of a storage building. There's already a storage facility across the street on 54.

    I'm concerned about the impact on my privacy. as a result of people exiting the site and we they don't see how there's a viable need for another storage unit.

    Uh just a comment because this recently happened in my neighborhood with a climate controlled self storage.

    Please don't cut off a neighborhood's access to provide a a directionalized access into a climate controlled storage. That's what happened to my neighborhood. And unfortunately that's a decision of the Florida D. O. T. and the F and F D. O. T. isn't for Florida at this time, but Um, we really didn't appreciate that. We can't make a left turn out of our neighborhood so that a climate control can have its own channelized

    access, left turn in for all of the the whole purpose of these things and then of this is that you know, it's gonna generate less than fifty peak hour driveway trip, so I'm not understanding why a climate controlled storage would need its own access at the expense of a neighborhood's access. But I hope that doesn't happen here. Just to comment. I'm not opposed to this project.

    Anything else? What kind of um uh is there any um plans for buffering or any kind of um uh site uh sight line abatement or what's what's the you know what w do you have a kind of c concept plan for So um

    we we do have a concept plan. I don't know if we have a printed

    though, Cynthia. Do you have a printout? So the the code already requires a pretty significant setback and the FAR is relatively low at point six, so it's only gonna be uh a two-story facility. And so the combination of the setback and the the limited height uh we think is a is uh a significant buffer and there's gonna be a buffer requirement in the code uh along curly road. Uh additionally the the opposition letter we checked the dates on that and that was the same date of our of our neighborhood meeting and given that the that um that uh person isn't here

    today when we talked through all of these things a lot of the conversation at that meeting had to do with um like I said the the use uh that was uh in for a pre app to the to the West Um and then the other questions were you know will it be Windows. The club requires windows but the the facility will likely have um uh like a glossing on the windows because that's more for for architectural look than it is for function. Um another concern was hours. This is not gonna be a 247 facility.

    It will close in the night. Um so it's low traffic generating, low noise, uh low impact to that respect. And there were questions about drainage, but the the topography of the site is such that it actually flows away from the neighborhood. So the site will have a swift microfire Of course, but additionally it would flow uh away from the neighborhood anyway, uh even without that type of improvement. So those are the things that we addressed at the meeting and I I'm I'm taking from uh that person not being here today that the meeting satisfied their questions. I can't speak for them, but that's you know that's for the Commissioner decide. Okay. All

    Okay. P forty-nine was advertised in the Tampa Bay Times December 20th, 2023, and by affidavit of certified mailings and site postings.

    Good afternoon, Commissioner Starkey Hernandez Planning and Development. Item P49 is PDD 247758, which is a zoning amendment in the name of Carlton E. and Elise V. Ellison Trust. It's for a change in zoning from an AR agricultural residential district to a C2 General Commercial District with a voluntarily agreed upon deed restriction, which uh there are some corrections that have been made to the record. Those have already been provided to the clerk. Office. That includes striking the following in finding a fact number one, the

    phrase maximum of 110,000 square feet or square foot. Also striking in the voluntarily agreed upon deed restriction, the term which would include but not be limited to 110,000 square feet of self-storage. Those corrections have been made on both the agenda memo, the resolution, and the deed restriction. The voluntarily agreed upon deed restriction is to basically limit the uses to those C2 uses.

    That generate less than 50 peak hour trips, AM or PM, whichever is higher, and also to provide the live local deed restriction, which is reserving those uses for specifically for C2 uses, comes to you with a recommendation of approval from the Planning and Development Department and from the Planning Commission who heard the item on January 4th, 2024.
