    The next item that we have on the regular agenda, we're gonna jump a little bit to item AP13. You'll be sitting as the local planning agency for this item. And it has a companion MPUD, which is P10, DRB Little and Ross M PUD. Item AP13 is PDE 260173, a comprehensive plan amendment in the name of CPAS 2511, DRB, Little Road and Loth Ross Lane, excuse me, providing for a small-scale comprehensive plan amendment to the future land use maps 2 15 and Sheet 10,

    changing from COM Commercial and Res 9, residential 9 dwelling units per gross acre, to res 6, residential 6 dwelling units per gross acre on approximately Approximately 26.2 acres of real property, located approximately 600 feet east of the intersection of Little Road and Ross Lane. And this is coming with the recommendation that the local planning agency find the proposed amendment consistent with the comprehensive plan presented by staff.

    All right, good afternoon. Amy Toll, Planning Development and Economic Growth. Before you is PDE 26-0173. It's a proposed comprehensive plan amendment in the name of CPAS twenty-one eleven, DRB, Little and Ross.

    The proposal is a small-scale comprehensive plan amendment to change the future land use from COM and Res 6, or I'm sorry, COM and RES 9 to Res 6. The proposal is to allow for a maximum of 74 single-family dwelling units located approximately 0.18 miles east of the intersection of Little Road and Ross Lane. There is a companion MPUD to follow this presentation. Properties located in the West Market area and urban service area.

    Here's a visual of the context map. There's an existing residential development to the east. Subject site is currently vacant. There's a commercial located along the corridor of Little Road up to Ridge Road. Commercial to the north as well.

    Here's an aerial view of the proposed site.

    The existing feature land use is currently Res9 and Calm. As you can see, there's Res9 to the east, commercial to the north and west, ROR and Res9 to the south.

    Proposed development is or the proposed language change is to res six.

    Existing zoning district is currently C apportion C two and A C with C two along the corridor.

    Uh following policies are consistent with the comprehensive plan or the following amendment is consistent with comprehensive plan policies. I always say that backwards, I'm sorry.

    And the following uh policies are not consistent with the proposed area.

    And with that, we recommend the local planning agency find the proposed amendment consistent with the comprehensive plan, and I'd be happy to answer any questions you might have, unless you would like to see the PowerPoint for the MPUD also.

    Uh the Companion Zoning Amendment to the Comprehensive Plan Amendment, the DRB Little and Ross MPD, PDE 267893. Here is the current location within the western uh market area. This is a rezoning request from agricultural AC to MPD master plan unit development to allow for the maximum development of 74 single-family detached units and associated infrastructure on approximately 26.2 acres. This is northeast of Little Road

    and the Ross Lane intersection.

    Here is the location map. The MPD outlined in red to the south being Ross Lane, commercial out parcels as you move west towards Little Road, and to the south is the VA.

    Here's the existing zoning map. the existing future land use map showing that a portion of the site is commercial and a portion of this site is currently Res9.

    Yeah. Yeah. Uh that about point five miles to the north is the Little Road and Ridge Road intersection and the Veterans Affairs, of course, to the to the south. This is the MPUD master plan. which illustrates some pedestrian infrastructure both internal and external to the development. I'm gonna skip forward slightly to the binding concept plan, which illustrates this a little bit more clearly,

    but notably here we can see that these are a minimum 60-foot lots for the single family detached.

    Here is the binding concept plan oriented on the PowerPoint. I know it looks a little weird, but that's to keep the north arrow. uh pointing north, you can see the access off of Ross Lane and the sidewalk that will be built along the frontage uh on the north side of Ross Lane, as well as the seventeen feet of additional dedication for Ross Lane. There in yellow, as you move west towards the Little Road intersection, you can see the off-site segment of sidewalk. That

    this project is constructing that is mobility fee credible since it is an offsite improvement. As we move further north, highlighted in red is the eight-foot pathway being built on site to the south of the stormwater facilities and then along the access road of the adjoining commercial properties. And then finally, in orange is the six foot path internal that navigates from the cross access on the east north

    around the stormwater facilities and to the eight foot path in red.

    Here is a drone connectivity exhibit that the applicant was kind enough to provide, which shows the current subject site. And uh the same applicable coloring of the m different multi-use segments that I just mentioned on the connectivity plan. the orange segment, the red segment. and the off site yellow segment in conjunction with the onsite green segment along Ross Lane.

    There's one variation request.

    Yeah. Uh proposal here from 901611, street design and dedication requirements to not provide an interconnect to the north or directly to the west. To the north.

    Um If we move back towards the aerial, that is uh the current Lowe's uh there that's uh on the south side of Ridge Road. That southern portion of the Lowe's is the loading dock and side access for the trucks. And to the west you can see the commercial outpartial division that's already begun through commercial subdivision. um within the overall polygon of the com flu. in lieu of a complete

    vehicular connect directly to the West, the applicant is providing pedestrian connections to the West in in the form of that eight use path.

    as well as uh the fact that the the main western connection is gonna be on Ross Lane, which is approximately nine hundred feet south of where that western connection would be. It's a very short distance away and serves as the most meaningful vehicular connection. I will point out that the signalization of Ross Lane and Little Road is currently at 30% design with the county as it's on the CIP. with construction anticipated

    fiscal year twenty seven. those signalization improvements. do include an additional right turn lane being built on R on Ross Lane westbound on to Little Road as well as intersection improvements to Little Road. uh for both uh the northbound and southbound left turn lanes from Little Road.

    Pursuant to the conditions of approval the applicant's gonna be paying a proportional share for these improvements as a as a part of this development at $128,000.

    And with with that being said, uh PDE is amenable to the variation request for for those following reasons and come to you with a recommendation of approval with the rezoning request uh with conditions to the Board of County Commissioners. I'm here for any questions.

    So the Interconnect to the East, what is that going to?

    That that is a a stub out in case there's uh future development. Right now there's a a single family home that's there that actually gets their access from the neighborhood. Um as you move a little bit further east on Ross Lane. if I had a a larger aerial their access is actually off of one of those internal streets. It's along Dirt driveway where they have an easement.

    Good afternoon again. Barbara Wilhite, [address removed]. I bring my laptop because I can't see up there.

    I know. If staff can bring up my PowerPoint.

    I'll start with saying um I'm happy to be here. I have represented this property in its prior life with an another potential developer who was gonna develop uh multifamily. Rental. So I've met these neighbors. We've come along a journey together to get to this place where we're gonna do 70 DRB, my client's gonna do 74 single-family homes. 6,000 square foot lots, 60 60 foot wide, very compatible with Crescent Forest, which is a very nice neighborhood to our east. So I think we've come up

    with something. We had a neighborhood neighbor meeting the other night, well received, and uh and my clients working with Crescent Forest. They have a very nice entry wall. ornamental wall and my client's gonna do something very similar so that our neighbor neighbor d community community will have some continuity of quality Um when even not only with the home sites being the larger homes, but also along our frontage. So they are well underway to working together as as n as

    new neighbors.

    So I probably should do this properly.

    Staff has done a good job showing you the context obviously where we're at and we all know it's just north of here. Um This is the shows you where this little bit of commercial is. It's really remnant commercial in my view. What happens is when somebody cites commercial, sometimes they don't get the boundary right and this is that scenario. The commercial has is located itself along Little Road. It's called Little Road Landings Commercial, and it's already platted and it has the depth

    needed for commercial. So to me it's just a mapping. This is a mapping issue of remnant commercial, in my opinion. And this is the calm.

    Interesting, under the current land use which is res9 and com, there could be 421 dwelling units. We are proposing 74, which is an eighty-two percent reduction. We could have said let's take this land use to res nine, because it already is res9 and com, but we actually down it to res six.

    We used to be able to

    I have ruined all of that. I am going on vacation on Saturday for a week and I'm excited about it. Um So, as we were saying, even though the I think it's remnant commercials just 'cause sometimes you don't get the lines It does produce the ability to have some some pretty intense um numbers when it comes to square footage. Um this would take that to zero. So the residents would know they would have residential next to them and no more commercial. Height is interesting, this is in the urban service area, so currently

    the property has no height limit. Our height limit in our conditions um leaves us l is only two stories. As you've heard, we're proposing the 60 74 single-family homes, 60-foot lots. We did a binding concept plan. We're exceeding PM26. When you do 60-foot lots, you don't have to do the monotony control architectural features per the wording of PM26, but we have incorporated that into our conditions: 23-foot driveways, minimum trees per lot. HOA management of our on-street parking, all things

    that have been important to the board and for other communities. You've already seen William did a great job going through our binding um concept plan.

    Proud to bring the DRB homes which have the three some of them will have three car garages. I know the house I raised my kids in in Trinity had a three-car garage, so nice to see some of that coming back. This is our connectivity exhibit. What we wanted to do here is just show our how we fit into the existing because we clearly this is an infill piece. We have commercial we have development all the way around us. Um You heard about the the um path, sidewalk, eight foot sidewalk that we're gonna be putting where the red

    is along the roadway. Um driveway that goes to Wendy's to the commercial project. The commercial project left a couple gaps. One being this gap here. So although they have a sidewalk all the way along their back Reverse frontage road, it stops. And so we're gonna pick up and then we're gonna go. We're gonna pick up a side sidewalk and put a sidewalk on our property. It's not the perfect way to do this. Because

    their sidewalk is on their property and our sidewalk's on our property. But because it was missed or something happened. And the commercial project didn't put in when they put in the driveway through the Wendy's property, they didn't put in a sidewalk. We're trying to do our best to to prov to fill in that gap. There's also a gap on Ross Lane, um, where their stormwater pond is that that was missed somehow, I guess. And so that's a gap that we're gonna fill in. So we're trying to fill in the gaps and to have a nice pedestrian movement. as

    William uh explained, that you can't really see behind this commercial property, there is a reverse frontage road all the way down to Ross. And so it's not in yet, but I understand the plans for the commercial out parcel that's next to Ross are in, and so that connection will be made. So the residents, and they were kind of happy to hear this, they won't have to go on the little road. our our neighbors over here, um, to my right, won't have to go on Little Road to get to all the commercial. Our residents won't have to

    go to on Little Road to get to all the commercial. So they'll be able to drive down that reverse frontage road or walk or bike with the pedestrian connectivity that we're filling in.

    As you heard a about the traffic signal. You heard about that and then you can't do that. I wanted to just kind of show you this. Um We plan on having our project permits and and first model in and Q three, Q four, twenty twenty seven. The county's timing for the signal is twenty twenty seven, so those will coincide nicely. The signal be in by the time we start having residents moving in. I do get asked um a bit about, you know, the connectivity to the West. Um And

    Why we don't have vehicular connectivity. There is an ECR and I I represented the commercial project to the West as well as this property now twice. Um and there is an easement covenant and restrictions. Over Lowe's. KFC, Wendy's, Dunkin' Donuts. And now the commercial property. to the West They all were part of an ECR many years ago. And uh that's w the how that project to the West was

    able to get that connectivity through Wendy's, although that took him two years. to to get that connectivity that was contemplated in the E C R for Wendy for them to get the connectivity for that commercial project, that reverse frontage road that goes all the way it will go all the way from King Healy. Let me start from the south. It'll go from Ross to King Healy, and then we all know if we've been to Lowe's, you can get through Lowe's and up to Ridge Road. So finally achieving some nice vehicular connectivity. We do not have a connectivity to our west. One,

    we're not part of that ECR, so we we can't access their roads with our vehicles. And two, we want to have Our community really doesn't want to have um s sitting in your backyard looking at a connection to Wendy's. So we're for for both reasons we don't have the ability to do it, nor would the community really want that we don't think that would be good for the community, um an asset for the community. So I wanted to explain that. 'Cause I get questions about that,

    about how this ECR works and what's going on out there. If when you look at King Healy as a as you leave Wendy's and you go to the light, King Healy Boulevard is actually that p portion's actually on Kentucky Fried Chickens property. So it's kind of interesting. It's kind of an old school ECR and the way it's set up. So You'd have to to change at E C R you'd have to approach Twelve different corporations. And uh It's a just a the commercial property to the west had to approach just Wendy's 'cause they were part of the ECR and it took 'em

    years. So In any event, um I hope you receive this as well as as uh I think it's received. I know we had a wonderful neighborhood meeting and we'll continue to meet and work with our neighbors any way we can. We are improving the drainage situation just in because we know it's got some engineers here. Their their pond does get full. Um right now with the drainage that comes to it, but as a result of this project we are going to take Drainage that's now coming their way from the commercial, legally coming their way. And

    we're gonna take it and pipe it to our pond and then we're gonna go north. So they will see a reduction in um water coming to their pond in a storm event. So I think that'll be helpful to them. Thank you.

    Good afternoon. I think I know some of you up there. Um my name is Karsus Kestaykis. I'm the um I live at uh Crescent Forest, [address removed]. Um I'm the president of the association. I'm a retired engineer and executive. So I have met with uh DBR and we have gone over with a developer, we have gone over some uh issues that I had and I'm very satisfied for the first time in twenty eight years of somebody you know coming in. as

    a neighbor of ours. Um however there's still a little bit of issues as um Uh the VA apparently has decided to use Ross Lane as their main entrance and exit when they were supposed to use it only on time of an emergency. That's gonna uh bring an issue with all the construction equipment going in in and out. Um I will propose the expedition of the uh the changing of Ross Lane and the turning lane

    and everything else in order to reduce all those issues for the developer and also. for the for the residents of of our community Uh it would have been nice to have another entrance for the equipment, but I do understand as an engineer some of the you know previous uh mistakes of the past in uh regards to uh rezoning and the um in and outs of the communities. But if we can expedite

    some of the work that needs to be done on Ross Lane, I think it's gonna be a perfect uh the you know the position of everybody, you know, uh coming in and out or to or developing that uh community. Thank you.

    James Vogel, [address removed]. Uh we've lived in Crescent Forest right behind this community for thirty something years now. We're the second home in the community. Um My brother and sister in law live on Ross Lane. My sister-in-law's been there her whole life. The area's changed quite a bit through time. Um Our drainage in our neighborhood is horrible. Our our lakes are overflowing and right now where they're building looking to build these homes is a orange grove sandfield. So the drainage

    is pretty decent in that field and it absorbs more than it pushes back to us. A lot of it's coming from the lows, not from where they're building this home. The drainage I feel isn't gonna do anything that they're installing. The Traffic on Little Roads since they changed the traffic pattern on Little and Ross Lane. getting in and out of that community is very difficult. and the builder said that they were paying for a light to put in there. And that's all great, but add another hundred and forty cars a day to that intersection's gonna be difficult.

    On the back east end of the property, they have that stub out that you had brought up and saw. That goes to a property right behind my mother's house and behind eight other homes. that o has three homes on it, not one single resident. And it has a black top driveway, not a dirt driveway, going to it. And that is part of our actual community. They pay the fees, they're part of our community. My fear is that the builder is looking to purchase that property and eventually put more in there. He the builder at the meeting on Tuesday tried to tell me, no,

    the county made us put that stub out there. It's part of the county that did that. That's incorrect. The county doesn't tell you you have to stub out to another potential property.

    the I'm really concerned that their plan is to eventually add into that property behind us, which is part of our community and they pay fees in our community. That's just my biggest concerns. This was an issue last time she tried to get something through. She doesn't include anybody on the street. This is important to me because my house is actually facing what you plan to build. It's also facing where you plan to put, I guess,

    their street to enter and exit. Why I'm not included, my family's not included, not really sure. Another point I wanted to bring up is it sounds like they're trying to use the end of Ross Lane as an easement to get out of that person sells. That's tanglewood. That is another home, an individual's home. So again, I don't see where they're planning this other exit. We are a dead end street. Ross Lane is a dead end.

Um Is there a way, I don't know, we can make these homes not be the cookie cutters that we're seeing everywhere else?

    Um so we're looking for something different. 72 homes is a lot of homes. The last time they tried to put the multi-unit homes over there. Their drainage was into someone's yard. That is what they were planning. Um and the owner of the property actually spoke up at a community meeting to tell them that. I don't know where their drainage system is, what their plan is. Um If they need to have a retention pond, our request would be to put that retention

    pond in front of the house our house. on Ross Lane because we really don't wanna have everybody so close. And the county will not issue them a permit until they provide the county with copies of the approvals from the FFWCC. For all the permits to capture and relocate those tortoises from the property to a gopher tortoise reserve. So no, they

    just can't come in and mow over the gopher tortoises. And that's they're not treated any differently than any other applicant. That's that's a requirement of our local code and state law.

    Good afternoon, Commissioner. Jeremy Couch, [address removed]. And I am an engineer specializing in drainage. So we started to look at this property. The first thing we do with all projects is we think about are there issues in the area, what is the cause of the issue, and what can we do to help? So right now if you see Crescent Forest and then after this area, I'll ask staff to put up the binding concept plan.

    Historically, what's happened is Little Road Little Road is considerably higher than Crescent Forest. And if you can see kind of where the yellow dot is in the middle of Crescent Forest, that's their community retention pond. This was built a long time ago before the stringent rules that developments are required to have today. And so what has historically happened? Is where the commercial site is and where our site, the planted pines are, has historically always run off. down to

    the pond in the middle of their community and that pond doesn't have a great outlet. So they have Yeah. The first benefit um to them for their drainage issue is that when the commercial developed you can see that the commercial parcel has two large dry ponds. These are perk ponds intended to Eliminate um Um uh match volume. So generally

    what we see with these type of ponds is large dry ponds. Um do have discharges in the extreme events, but the gully washers that people are seeing where all of a sudden on a random um September the pond is overflowed. That goes away. If you could move to our binding concept plane. So our site. Drains. directly into their property. Um a small portion of our site drains to the north. I

    talked with my client and even though the Florida law allows us to drain our retention pond back into their site, is that really what's best for their community? Absolutely not. What we're going to do is capture the water that comes into us from the commercial and comes into us from our site and our roads. We're going to drain our roads to the street, and we are going to the north. And although in this graphic that is a blue-colored retention

    pond, it's a big dry perk pond. And it's not desirable to be dry, but that's what is best for the drainage situation in the area, a big dry perk pond. So the 30 acres that used to dump directly into their pond is now being taken around their property through a series of dry ponds and will considerably alleviate the situations that they've had. Our project will be required to get a permit from the state through the Southwest Florida Water Management

    District and also through Hillsbury or Pasco County whose engineers will review it. Um last thing is like Barbara said. We would be more than happy to eliminate that stub road to the east. We have no desire to connect to the eastern parcel. It's a cost we don't want to incur. It doesn't look great. But we are meeting the code.

    Jeremy, why while you're up there, buffering at Tim Ms. Vogel's question, um, what's the buffer on the the South Side gonna be?

    On the south side, we have a D buffer. I believe with this right-of-way width, it's 10 foot. Um in addition to the east, the code doesn't require um buffering for like-kind districts, so single family on single-family. We have self-imposed a 10-foot type A buffer between us and Crescent Forest to Um soften The two projects.

    Good afternoon. Hiya Mazilli, Planning Development and Economic Growth, and I will be presenting item P38. Uh we'll start with the project's overview. Thank you, Gina. So the applicant is proposing a comprehensive plan, small-scale comprehensive plan amendment to change the future land use designation from Res 9, residential 9 dwelling unit per gross acre, and Calm commercial to Res 6, residential 6 dwelling unit per gross acre. And the intent of this proposal is to

    create a unified residential future land use designation. To allow for the development of 74 single-family detach units on approximately 26.2 acres site. This site is located on Ross Lane, approximately 600 feet east of Little Road. As Amy mentioned, there is a campaign rezoning petition to MPUD in the name of DRB, Little and Ross MPUD.

    This map shows the general location of the subject site, which is located in the West Market area and within the urban service area. This is a zoomed-in aerial of the location of the subject site. As you can see, the site is just north of our government building. It is situated south of Ridge Road, east of Little Road, and just north of Ross Lane.

    And this map provides the existing context surrounding the subject site, which is currently undeveloped. The surrounding area includes a mixture of uses with commercial development to the north along Ridge Road and to the west along Little Road. And we have the Crescent Residential Community located to the east of the subject site. Although not shown on this map, the VA Hospital is located to the south of the subject site.

    Next, we have this slide that illustrates the existing transportation network. There is an existing sidewalk located along the east side of Little Road. There are no sidewalks along Ross Lane. However, the applicant is proposing to construct a sidewalk on the north side of Ross Lane, and specific details of this sidewalk will be addressed during the MPUD presentation.

    This is a map showing the existing future land use. As you can see a portion of the site is Calm Commercial and the rest is Res9. Com is also to the north and the west of the subject site.

    So after review and analysis, the Planning Development Economic Growth Department found the proposed amendment to be consistent with the following comprehensive plan policies. Rest six, policy flu 1.4.3, policy flu 1.8.7, policy flu 1.8.10 and policy flu 8.1.1.

    So based on the comprehensive plan consistency analysis, staff recommend the board to um access public comment and adopt the proposed comprehensive plan amendment and ordinance by call by roll call vote.     Good afternoon, William for Million Planning Development, Economic Growth. This is the companion MPD rezoning to the previously mentioned CPA, PDE twenty six seventy-eight ninety-three.

    The location map. This is a rezoning request of the right-of-way. From A C agricultural. T and C two general commercial to MPD Master Development District to allow for the maximum development. Of seventy four single family Detached homes and associated infrastructure on approximately twenty six point two acres. Uh th those single family detached homes are a minimum of sixty feet in width. This is located in the Western Market area, budding the northeast corner of Little

    Road and Ross Lane Intersection. Here's the location map. You can see out towards Little Road, some of that commercial property has already been commercially subdivided. And then as you move uh further west onto Ross Lane, or further east onto Ross Lane, you find the subject site highlighted in red. It is the site of an old uh tree farm. The current zoning map. And the current future land use map reflecting the Res9 and commercial flues

    on the subject site.

    Here is the contextual map to the north to orient the commission exists the hardware store with the commercial subdivision happening as you move further west along Little Road and then on the southern portion south of Ross Lane exists the uh the Veterans Affair building.

    Here is the MPUD master plan which roughly highlights the internal street uh network here as well as some of the pedestrian improvements, but it's further illustrated here on the binding concept plan showing those uh 60-foot minimum single-family detached lots as well as the the sidewalk along Ross Lane, both along the entirety of the project's frontage as well as that yellow piece as you move towards the commercial subdivision. The applicant is building off-site sidewalk to fill

    the gap there with the commercial piece for mobility fee credits. The on-site portion, of course, not mobility fee creditable. The red portion Uh that you can see up to the north is an eight foot uh eight foot walking path, a nature trail, that will provide further pedestrian connection to the commercial subdivision that's already occurred alongside Little Road. and then to the north of that pond. In orange we can see the internal six foot trail that's proposed along the north side

    of that pond that comes down uh through that uh what could have been a lot green space as you connect onto one of those internal roads.

    This is a connectivity exhibit provided by the applicant with drone shots that overlays those those same color coordination to the eight foot, six foot, and five foot of the uh the pedestrian facilities that we're talking about being constructed with this project. as it pertains to the site aerially You can see they're highlighted in orange, in red, and then in green and yellow along the project frontage.

    There is one LDC variation with this product, project from nine oh one six D eleven street design and dedication requirements. The applicant requests to not provide a vehicular interconnection to the north or to the west.

So to the north of that is the uh if I could go back to the aerial here. That's actually it would spit the uh the residents out right into the the loading zone of the uh of the lows. They use that side access and if if we could zoom in or go to mapper. it'd be helpful. But you can see that that's actually their their loading area. It's pretty narrow and uh it's gonna be Uh

    a bunch of semi trucks and larger box trucks delivering goods there. You can you can see there on the right there with that delivery bay where they stack all their old pallets. So that was one of the reasons staff didn't feel like a connection was feasible to the north. And that's to the north. Okay. So let's talk to the west,

    that's my biggest issue is the west.

So to have all that commercial right there to take these people out on Ross Lane. When I don't need to. To not put them in there. I don't know why you guys would allow them to go against our code and look for a variation with that. I would have made them put that in there. And I think this

    board, Commissioner Starkey we talk all the time about how we try to interconnect.

    could be accessed by pedestrians to the commercial outparcels. If one needed to go to Lowe's, you'd simply get on Ross Lane at where in the CIP we are signalizing that intersection. and then go straight north to Lowe's without having to get onto Little Road.

Which has got another neighborhood behind it, got a VA All seventy four lots going through to go take out go out here on Little Road, take a right turn, take a right turn back in, then when they're gonna return, they're gonna go back on Little Road, take a left turn, and a left left turn in again, as opposed to driving internally going right to Lowe's. You think that's a better way to go?

It's the connectivity which we talk about all the time, neighborhoods to neighborhoods, I'm talking about A residential neighborhood connected.

    Well w with with this proposal with the organic internal frontage that's happening in this scenario you wouldn't have to go back out on Little Road, whether you're going to or from Lowe's. How are you gonna get there?

    Yep, just take a ride out onto Ross. Uh it's about five hundred feet right onto the internal frontage road, and then you you go north without getting on Little Road. The the street pattern is as organically formed through commercial subdivision of that piece that's grayed out there.

    gonna be out there? Sure. So there is uh thirty percent signal plans that are done for the signalization of uh of that intersection and it has it's on the CIP in fiscal year twenty-seven to be complete. As well as those uh the the aforementioned uh pedestrian improvements that are occurring along Ross Lade, uh the VA built their portion to the south to their access point. as well as a a portion of this, um, I guess some some textbook cleanup had to happen. The Ross Lane wasn't actually on the county maintenance

    schedule. And I I know that within a within a month or two the resolution's gonna be brought forward to bring this county road back onto the to the county maintenance schedule.

    Yeah. At the intersection on the lanes going out. Is there two lanes or one lane at the intersection?

    Sure. As a part of that that design they are um contemplating additional lanes uh to help capacity there. So for for right turn movement, left turn movement and a through.

    Right. I'm gonna have seventy-four cars plus the neighborhood, plus the VA. And to Reduce the stacking. I would think that we w would automatically put in that we would have a right turn lane and a left turn lane to be able

    This is just an overall context slide. I think staff has already shown you a similar slide. This one's just backed out a little bit more where you can see the VA to the south, the commercial development to the west, the newer commercial development to the west, and then the more legacy development more towards the north.

    As staff showed you, that is the um the zoning map. You can see the little bit of commercial. I would call that remnant commercial. What happens is when the county sets zoning district lines and comp plan lines, it doesn't necessarily match the depth of the commercial. This depth has been defined as the commercial that exists to our west. And so that's why you see that overlap. Yeah. And there is the comm overlap.

    Under the current future land use, the property could have four hundred and twenty-one dwelling units. We're proposing seventy-four. An eighty-two percent uh less in drawing units. I can tell you we had a voluntary neighborhood meeting. and given what other people have proposed on this property. A lot of our neighbors are very happy that we're doing 60-foot single family homes to their beautiful homes to our east, single family detached to single family detached, and that we've got such a low density compared to what could be here. The

    f the future land use provides for a very large, on a calculation standpoint, a very large amount of square feet. The current height, there's no ma there's no maximum height, because this is in the urban service area. We're proposing two stories.

    Single f as I mentioned, 74 single family homes, 60-foot lots on square 6,000 square foot, 60-foot lots on 6,000 square foot lots. We have produced a binding concept plan. We're exceeding policy member PM26. To answer Commissioner Starkey, she had me look at street trees. PM 26 actually is not required for 60 foot lots, but we are complying with it. But your PM twenty-six requires two trees per lot. Um one can be in the front. Two can be in

    the front. One can be in the front, one can be in the side or the rear, but there is no requirement for a street tree. You can use your front tree in the street if you'd like or on the front of your lot. At the request of the Commissioner, we anticipate this is going to be a very nice subdivision. We will add a street tree. Thank you. We need to work out that language with staff. Yes, it's an addition. So you've two l the cur current conditions say There's two trees required. We'll add a third tree and require that that one be a street tree.

    I want to make sure it's not a crate myrtle. Or an understop tree. It's a shade tree.

    We yes, that's fine. We do need to work on the specifics of that language. Hopefully if you approve this today, we can we can work that out in the final details. But we the client is happy to do that. So we're exceeding exceeding PM26. It doesn't apply with that. We have the monotony control, the architectural features, the HOA manage of our on-street parking, all the things that you put into PM26. These are example elevations of our 60-foot product. You can see we're bringing back the three-car

    garages, which I used to have a home uh but before I bought my home in Golf Harbor's it had a three car garage, uh a very nice product. This is the binding concept plan that you've looked at. I think staff has gone over the connectivity, um pedestrian connectivity. There were gaps in the pedestrian connectivity. that we have filled in. I think there's a better way to show it, which is the drone aerial shots that um Tampa Civil did.

    So this is the built environment. Mm. When you look at this is looking to the east and we've got Little Road going north-south, Ross Lane is to to our right. And the commercial development, when you heard staff talking about this organic reverse frontage road, it is an actual requirement. What's interesting is the commercial project to our west and all of the commercial development to the north are

    part of a declaration. This property is not, even though it has com on it, is not part of that declaration. I am under oath. So, what I'm telling you is factual. I have a legal opinion. We didn't just say this. The county attorney's office made us prove it. We proved and to their satisfaction that this Property is not part of that declaration and does not have legal access to their private and they're not roads, they're driveways, they're private driveways.

    restriction, basically. It's a it's a recorded document that has conditions for that specific development, much like you're used to seeing as an M Pud condition, except it only applies to the property that it attaches to and is recorded um in advance of sale of lots.

    And so when the commercial development came forward, because I represent the commercial development, the county made sure that this reverse frontage road was put in. There was a gap. that they didn't own. on Wendy's property, because they were all subject to the same declaration This property does not have the benefit of the subject property that we're rezoning. Mm. Wendy's had to accommodate that leg of the driveway that goes up to King Healy, the light at King Healy. So very purposefully the

    County said Mr. Kate. Hassan Gail who's here said there will be a reverse frontage road going from Ross, so anybody on Ross Lane doesn't have to get out, including this project, does not have to get out on Little Road and can go up and through here. So the vehicular connectivity running have the its own frontage road is going in. And we'll be there. There was gaps in the pedestrian network. And why is it? So

    Why was there gaps? So there's two gaps. One is on Ross Lane.

    Because your current your exist your prior code, I don't know if they f I think they fixed it when they just redid your code dealing with p pedestrian facilities. But when a project comes in For development. there is a requirement that they put sidewalk in. So when the I don't remember what the corner is, if it's Chipotle or or what uh what the user was at that corner of Little and Ross, but they're in for review, that one they had to do a sidewalk. but behind them was a pond, And so they didn't trigger

    the sidewalk. We have to say that so and but I you know, so I but I think they've been on this you know, this has happened a bit ago w under the old code. So we we came in and we'll say, Look at the right-of-way. We don't want our folks walking in the dirt. You know, they're gonna we're gonna put a sidewalk in, then they'll be we'll put the extension of the sidewalk off site. So that is provided for. When you look at the frontage road. road the frontage road has pedestrian facilities into it.

    The frontage road has a pedestrian facility into it, up to the point where they put the driveway in on Wendy's property. No pedestrian facility. So they get another gap. So You know, we don't just kind of put this thing these things to you. We actually look at them and try to make sure things make sense and that we do what we need to do. So here where the red is, that's a gap. So When folks would if we didn't fix that, folks would come down and walk along the new frontage road and then walk in the dirt.

    or on the road to get to Lowe's. So we're fixing that with this project. That'll be an eight foot path, red is eight foot path. We're bringing an eight foot path out of our project and then putting the new eight foot path so there'll be pedestrian facility all along that reverse frontage road, love reverse frontage road. And that's what we are doing as part of our project. So I hope that answers the questions. I would just say the other thing about the interesting about that declaration is It's not a association, it's an ownership,

    and there's six to at least six to eight property owners, national property owners. Um When the commercial folks came in they worked with just Wendy's because they were already benefiting from that declaration. But it took them, I don't know, a year, yeah, two years to to get the approval from Wendy's to put in the road that was contemplated by the declaration. So kind of crazy that's right. So those so those all those property owners and and when you look at King Healy as the as you come up to the light between Wendy's and KFC That

    pr road, that property where the road is, is owned by Kentucky Fried Chicken. So It's not just like so simple to say You should, it makes sense to, we can't.

This I've been representing this property before it was single family homes when it was multifamily rentals. For the sake of the property owners

    around. It's and I think hopefully the county, everybody's very happy with this client um in the single family detached homes but so but I they hired real estate counsel and a a fine law firm to review the issue and issue a legal opinion.

And I know we keep talking about them going to the lows, but the reality is hopefully they're gonna go to those restaurants and help keep those restaurants afloat. They got away without a little bit. What, the sidewalk goes to the pond and then just dumps you in the dirt? That's

    And uh they did a nice job. Something brought forward. is the connection to Rocky Sync. Rocky Sink already backs up and flows reverse because of all the development that's been in this area. I've been down there personally and watched it. I've sent you pictures of Rocky Sink flowing backwards. So with that happening, you're gonna flood out Cranes Roost, Bass Lake, and Golden Acres. Thank you very much. That's the important part of this because it's not being addressed.

    A lot of people are not addressing the riparian flow of our waterways. And you're gonna see more and more flooding. I already have seen enough flooding at Golden Acres. It can all be fixed. But it's not being addressed. you know, uh Rocky Sink can have an alternative outflow, but it doesn't right now because it hasn't been addressed. the tangle would spill way spillway. You have a two foot difference in water flow from the top to the bottom, even with the gates open. Shouldn't be, because there's so many blockages in the Tanglewood spillway. This development

    will put pressure on our side of the road because that's where we have a natural spillway out to Rocky Sink. then also to our east, Like developing tanglewood, we'll see the water sub s the riparian flow being pressured to them, and since the tanglewood spillway is non-functional. Tanglewood will flood out. That's my point. And I gave you a presentation. This presentation will apply to others throughout the throughout the county. I've I've been out to Dade City. I've witnessed the same similar activities happen in Dade

    City. And quite often, you know, you have all of the uh beautiful Drainage ditches and whatnot designed. They're designed to contain the pollution in accordance with DEP regulations. There is no nothing out there that I have found yet. That's addressing the riparian flows and the additional flow that we're going to be encountering, especially in my neighborhood. Thank you.

    As I recall, part part of Magnolia Valley was going to be able to actually build it, the way we're gonna build it actually w we'd be able to hold water coming from the east or the west. So that could actually take some water from this area here. Um I c I can say, Alan, if you if you watch the apartments on uh Ridge Road up there that were being built in the Tanglewood entryway. I did have there was one area there was like a a wetland that was kinda low. Uh I did have it checked out thoroughly. David Allen did a great job with his team. And there wasn't a connection to Rock Sank. It was just a s just a low

    area where the water drained too.

    That connects to the Tangowood spillway, not the Rocky Sink.

    Well and I I but I will address I will address I brought you up the this the Tangowood spillway. We will take a look at that. But that's that one area I had some calls on it that I did look at.
