It's a zoning amendment requesting a change from AC Agricultural District to an AR agricultural residential district. As previously stated, this is a Euclidean rezoning. The purpose of the presentation was we did have some. Letters of opposition on this, so we'll go through a brief presentation. So they are requesting a change to AR.
The future land use is res three residential three dwelling units per gross acre. They are proposing to rezone to allow for a split of the subject site to two and a half acre lots. It is located on the south side of Kitten Trail, approximately one mile east of the intersection of Kitten Trail and Hickory. Road. This is the county location map. It is in the North Market area. Here's the aerial view of the subject site. It is approximately fourteen acres.

Future land use is residential three dwelling units per gross acre. the existing zoning district of A C Agricultural District,
And some of the findings of fact. So the subject site is currently vacant. It used to operate as a blueberry farm on 14.57 acres. Access to the property is from Kitten Trail, which is a county-maintained collector roadway with approximately 50 feet of right-of-way. There is a capital improvement project on that trail to construct a five-foot sidewalk that's currently past the design phase and working. Through the construction phase. The five-foot sidewalk is going to be from Gideup Lane to
Hicks Road. And the applicant has volunteered to record a deed restriction. So we are we worked with the applicant and the district commissioner on this item. There is a voluntary deed restriction to address the Live Local since this is going to an agricultural zoning district and then also limit the size of the lots to two and a half acres. And with that we recommend approval of the proposed rezoning and we can answer any questions you might might have.

Amy HeilerRight. So um I did ask that inquire with the applicant. She can come up and confirm if need be, but right now they are unaware of doing either or. Um they just want to be able to split the property. So that's gonna be handled by whoever ends up obtaining the property.

Amy HeilerYes. Well, let me just say they did not want to restrict ADUs. So there is an opportunity for ADUs to occur in this plat in this scenario, yes.

But as we did discuss, there are ER zoning districts about three thousand 3,000 feet away. So if the board or commission is amenable to something like that, we could take a look.

This is one section of AC that's still sitting there. As of right now, only one house can go on the entire property. There is no way to I mean, right across the the road, I have four driveways to four different two and a half acre lots. So I'm just trying
to basically maximize the potential for the property so that we can, you know, create some estate size lots, which is why I called it kitten trails, you know, farms, because farms are, you know, they're not small, you know, to have some substantial land so that people could have, you know, two, three, four acres and whatnot. They had proposed two and a half acres, totally fine with that. I'm not trying to go in there and do anything, you know, on a grand scale. Just wanted to create some estate-sized lots as far
as whether it be single family or a manufactured home. I'm taking this one step at a time. So my first goal was to split it once because based on my meeting, you know, you're allowed to go. Ahead and do that once and then speak with the county about some potential ideas to come back and split it again. So maybe split three or four acres over here on the far side, leave the rest of the majority of the property, which then has the ability to be split, you know, two or three more times
for some other estate-sized lots. So that's kind of where I'm starting with this. If I mean if somebody came along and they wanted to buy the whole thing, then it's a moot point. But I'm trying to just kind of, you know, I buy and sell land as a living. I've been in real estate twenty years. So I'm just trying to maximize the potential for the property, but keep it in line with everything that's around it, the rural character that's in the area. You know, not come in and do something that's out of character for what is next door and what's All

Unidentified speakerVoice BI don't wanna confine it and restrict it that much. I I don't I don't know if Pasco County um has restrictions on the age of the home. I know other counties they have a a a year per se, you know, a mobile homes have to be at least five years, you know, newer. Um, if there's something like that I could be amenable to. I I don't wanna restrict it altogether. Just because affordable housing is such an issue right now. I I I don't have a plan to go in there and put
a bunch of mobile homes, but I don't wanna restrict the potential If I sell it and somebody wants to build a mobile home, but they can't because that's now they have to build a site-built home and it's double.

Janelle CondogadoOkay. Well is there anything that we can say to get the county commissioner to bet better reflect the um interest of their commission c constituents?
Unidentified speakerVoice AWell Although I haven't heard the rest of the testimony in this case, I'll give you an idea where I'm preliminarily thinking. And that is that there's another case not too far from this one. substantially larger piece of property. that's asking for eight hundred houses. I think in fact it's right across the street.
Um these people are willing to deep restrict this to two and a half acre lots and I appreciate the applicant's willingness to preserve the rural character of the kitten trail area.
Janelle CondogadoOkay. Do we do we understand the environmental impact of developing Fourteen acres of land.
Unidentified speakerVoice AWhen an applicant submits an application for a subdivision in this county. The first thing that one of the first things they have to do is submit a listed species survey to determine if there are any listed or protected wildlife species on the property. And if there are, they're required to get all of the required the permits necessary under Florida law and US law. to either preserve andor relocate
those animals. There is extensive stormwater drainage studies required. They'll have to do an analysis on their utility demand. As I pointed out, this is in the RES III future land use category and they'll be required to connect to the public utility system at their own expense. We have a tree ordinance that this board recommended passing a few months ago. that now makes the penalty for cutting down a pa a tree larger than ten
inches in diameter in Pasco County $75 an inch. That's up from $50 an inch. That's a 50% more cost of mitigation. Also in a residential development like this, that ordinance that we recommended approval for unanimously will require that they preserve at least 20% of all of the trees greater than 10 inches in diameter, which is a substantial improvement from the ordinance we had in place before that didn't require the preservation
of any trees.
Janelle CondogadoUm are you aware that most animals don't survive relocation, particularly gopher tortoises?

I talked to several of the residents surrounding it, so I got some information from them, what goes on around there, what the property is. The previous owner, Scott, I believe his name was. He um had goats on the property all the time. He uh wanted to build on that property at one time his parents did,
but the property would not perk for septic. So at least the question to me what are they gonna do about septic? And as far as the water goes, it could only be a well because we do not have uh county water or sewer on Kitten Trail. We uh it also has approximately three-quarters of an acre of a sinkhole that's open to the aquifer. I know it's open to the aquifer 'cause it's full of water all the time. We've had alligators come up out of
that hole and actually walk across the street into my property. The uh There's no way they could get there other than through the aquifer system. This property I with the sign on the front because they said they're gonna resell as advertising for a potential uh res three, which is as you know, one house per acre. Buildable acre. That will give them the potential for 40 plus houses in the
back in the future. This is something we can't sustain on Kitten Trail anymore. We've been through this with the Denton Avenue project. Kitten Trail is busier than what it needs to be now. I uh don't think this should be allowed unless we have absolute restrictions to. A two and a half acre tract. five acre tracts for whatever we could get. to uh keep the minimal of the uh Building down to a A reasonable

The applicant said when they she first came up that um they they're restricting anything there to at least two and a half acres. It has to be a two and a half acre track. They can't they can't cut it up into forty lots 'cause only fourteen acres.

Makes the developer First, investigate the underground conditions and determine whether or not there's potential for sinkholes. We also have a A stormwater ordinance that prohibits the discharge
of stormwater into sinkholes with a direct connection into the Florida and aquifer. And if there is a direct connection from that um sinkhole into a Florida and aquifer, that will also make it our highest categoriz category of wetlands and will achieve the highest protection that our county requires if that's there.

Unidentified speakerVoice AThat's what our county, that's what Patrick's department over here does, the Planning, Development, and Econom Economic Growth Department. The applicant will be required to submit an application, a preliminary development plan application for a subdivision. They'll be required to present a geotechnical report and analysis to determine whether or not there's the potential for sinkholes, as I explained earlier. You'll also have to do a listed species survey to determine if there's the president presence
of gopher tortoises or the Florida alligator. And then whether or not those species need to be relocated or can remain on the property. Or if there'll be areas where they can't build because of the presence of that species. They'll also have to get permits from the Southwest Florida Water Management District, which their rules just changed on December 28th of last year, which now requires water quality treatment on the order of four times more than what we've been doing for the last three
decades. So they've got I'll just say that before they develop that property they've got a tough road to hoe. They're gonna have to pay a lot of engineers and scientists, and they're gonna develop a lot of plans, and then those are gonna be highly scrutinized by Mr. Dutter's department over here before they're gonna be authorized to remove a single tree or a single blade of grass from that property.

Alrighty, and uh so I have some concerns. as uh all these roads to there are two lane roads. Okay, we already are acquiring six hundred homes at Houston, what we called Houston, right there at the end of Hicks and Denton. So they've cleared that from the Hudson Road all the way across to Houston. Okay, I know what used to be in there. Used to be woods. Used to go out there, know
all about it. The water that that used to reserve for our aquafires, believe it or not, there was many ponds out there that fed back to the aquafir. So now we've got city water going to all these houses, county water, wherever it is. The rest of us are on wells. So the roadways are overpacked already. Denton Road is so dangerous that I have watched I've lived there nine years now in the area. And I have watched people die in the middle of the night. A friend of mine got hit in the middle of the night out there by a driver
who thought he hit a deer and then hit her again. What are we gonna do to provide the infrastructure built up? You guys are building, building, selling off. The whole county is I get development, I get there has to be growth. I get it. However, we are still the little last rule area of that part of Pasco County. They are not supporting the railways. Shady Hills got all the Del Webb added in. Those roads are not, I don't care what Dell Webb did with their sidewalks up to the schools. We have no support for the rest of those schools through that area.
We have two lane roads down Denton and Peace. Now you're getting ready to develop Kitten Trail at the corner of Kitten and. and Den Road, where they're starting to do the road work to add the curve in to east road there. What are we doing about the roadways? I uh I actually came for that piece a lot on Denton Road. I guess I missed it. I have a concern about that being rezoned from agricultural. But any of it, when we start rezoning them from agricultural down, It allows for the laws to change, the water to change. Most of us live on wells out there. Okay.
When I moved in I thought it was agricultural. Come to find out I'm on an AR one. Okay, AR1 is your first step. As soon as you rezone it past that, then you guys can do and the county and anybody can do anything he wants. Then we start getting city water. We're forced off it. We have no water left. Our wells start getting issues. There's been a lot of people. Luckily, I'm a newer well than a lot of people have been out there for a long time, longer than me. That their wells are older than mine. So between the roadways and our wells and the infrastructure,
I'd like to know what what's gonna support that. I actually am not

But my concern is mostly the roads and the waterway. And that piece that I guess I minced whatever
at Denton and Kitten. It's so close to me. I travel through there every day. going back and forth to work. I lost my three minutes. But either way, I'd like to know what you guys are planning on there, okay? Between that little and I guess I again I came strictly for the corner of kitten and Denton there where they're rezoning and doing the east upgrade 'cause they've got that lot there that they're trying to rezone from agricultural now too. But every time you guys rezone it down, then the rest of us are being jeopardized. W our roadways are not supporting
it. We see no infrastructure being added in. To support the roadways. How many more people have to die there? You put they put a lay a light at County Line and Waterline. Now we got County Road adding all them homes on County Line at uh via Alexand that doesn't have the support for the roadways either. They added a light there. Do you know? Okay, well all the lights.

The problem is is those roads are paid for by impact fee and taxpayer money ultimately. And when there's no development, none of that taxpayer money is coming in. You can't build a road for something that may or may not happen in the future. So it always has to occur after the fact. Once a development happens, then the tax revenue is there, then we can start building some. of that infrastructure. Now we try to plan the best we can and that's what comprehensive
plan are for and we look at um water capacity, you know, uh sewer capacity, things like that before uh uh development's uh approved. But ultimately the things that improve that infrastructure is driven by the tax revenue from the developments that occur.
Sarah GonzalezWell I understand that, but again in the little area out there, as we start selling off all the property and adding in these six hundred home tracks, four hundred home tracks, five hundred home tracks at the end of Shady Hills soon to be behind Circle K and the advanced auto parts or whatever's there, that little thread of land is gonna be a hundred homes soon. But they look at that they look at that. There are traffic studies and you know it it's yes, it's more strained than what it was before before that, but it's still th they they look at that capacity before those projects are approved and then when improvements need to be made and the tax revenue is there to do it, they can do it. You know, if we if we develop Expanded roads and developed infrastructure for things that were permitted or things that were approved, and then the market shifts and the developer says, you know what, I'm not gonna build this development
anymore or the money doesn't make sense and now we've spent money to build a road to nowhere because now this development doesn't get built. That's a problem for the taxpayers too.
Sarah GonzalezOkay, and one last thing 'cause I do know over my time. Um There's there's people that work. I had to take off at home to you know, work to make it to this. I have a question. How can us in Pasco County, 'cause Pinellas County did it. They were able to arrange their meetings to be in the evening so those at work that can't afford to take off of their jobs could attend some of these meetings. Is how do we How do we make the steps in Pasco County to get these meetings adjusted so that we can have them in the evenings? You know, Penellas has done that,
accommodated their their residents to meet in the evenings at say five five thirty evening so that people like us, the regular citizens, blue-collar workers, can actually make it to these meetings to have our word heard, hear what's going on, be able to try to understand what you guys are doing, what the development's doing. You know, I mean it none of us get the chance to do that.

Well, I've been a practicing engineer for more than thirty years. And I've had to go to zoning hearings where Counties or municipalities held their meetings after 5 o'clock. I've also had zoning hearings happen at 1 o'clock in the morning. But people say they can't take off of work. Well, I would like to know how you're going to get to work the next day when your zoning hearing starts at
one in the morning and goes until three o'clock in the morning because that's happened to me before. And the other thing I'd like to point out about having meetings after 5 o'clock is there's two sides to that coin. One, you could have that meeting at 1 o'clock in the morning. The other is that everybody that sits here With the exception of the school board representative and I don't mean to pick on him because he knows I love him.
We all run businesses. We're all unpaid volunteers here. And I come down here twice a month. Okay, two meetings every month. My time. I'm not paid for my time. I have to read in fact at the last Planning Commission agenda. The agenda package that I was delivered on the Friday evening before the Thursday meeting was 1,399 pages long that I needed to read and I need to
do this twice a month and come down here. That's time away from my business that I'm not getting paid for, that my business is not making money. Okay? I It's important enough to me as a community member to come down here and volunteer my time twice a month. There's not something that happens in your neighborhood every day. That isn't important enough for you for one one rezoning hearing that happens once a year or
two a year to come down here and manage to take 30 minutes off of work to come down here and talk.

what is she asking for? She's asking to change the zoning from agricultural commercial to agricultural residential. Right now she has an approximately fourteen acre lot. Okay. And an agricultural residential you're allowed to build one house per ten acres.

she's requested would allow, and I would make the point that right now the future land use designation is Res III. She could have come in and asked for a more intensive zoning district than AR but she's chosen to request AR, which is a minimum of one acre lots, and she's volunteering to make them a minimum of two and a half acre lots, which is far better than the application we heard in here a couple of months ago. that's not too far away on the other side of the street.

Um just you know a nice estate size lot. I'm not trying to go in there as a a large uh builder, production builder and put in, you know, one home per you know half acre or whatever. That's not the goal here.
