16mRon OakleyChairUh P sixty two.
Kathryn StarkeyVice ChairApproved for publication temp May Times June 26, 2024.
DeniseItem P sixty two is PG twenty four seven eight zero eight. It's a zoning amendment under the name of Dave Mitchell's Holding Company, Mitchell Clinton rezoning for a change in zoning from R1MH, Single Family Mobile Home District, and C2 General Commercial District to a C2 General Commercial District with a voluntarily agreed upon deed restriction related to the Live Local Act. Comes to you with a recommendation of approval from the Planning Development and Economic Growth Department and the Planning Commissioner.
Ron OakleyChairOkay. Is anyone here to speak against this item?
Kathryn StarkeyVice ChairUm I
Ron OakleyChairsee another one.
Kathryn StarkeyVice ChairI have a question and I
Ron OakleyChairon P sixty two?
Kathryn StarkeyVice ChairYeah, and and it would be the same to the one before. Um because this is the area where and I asked this in my meetings with staff. This is the area where the DOT in the county that we did not put in the multi-use.
Have we determined which side of the road that's going to go on at this area? Is it going to be on the north or the south side when we go to connect this to 301? Because on this is on the north side, P61 is on the south side. It's got to go on one of those two sides. So I just want to make sure we're reserving the land that we need for that multi-use pack.
Liam DevineLiam Divine, Planning and Economic Growth Department. So there is currently so going back to P sixty one, um, you're saying that's on the south side. There's currently a twelve foot wide multi-use um path already in existence that was just put there and that's on the north side. However, it stops at Curly Road and it does not continue on. So after Curly Road going east, um which is where P sixty two is on the north side. Um there's just two five foot sidewalks on both sides. Um I don't know if it's
been planned for, I can tell you it's not currently in the CIP plan.
Kathryn StarkeyVice ChairWell that's a problem because we've already met with DOT and we know that they have the right of way And we're going to talk about it at the MPO meeting to put it back in from Curley to Prospect on the north side. We don't know. I think it's coming across the street from Prospect On, but someone needs to make a decision here. And for you to not even know, I mean Oh, I'm so frustrated that that we're so
piecemeal that we're we're trying to preserve this land.
Unidentified speakerVoice ACommissioner Oak if I might, Clark, Tommy, Hobby and Hobby PA have been sworn. This is not that section of fifty two at all. This is on the west side of Maratha. This is not near Curley. This is about two miles away from the section you're talking about.
Kathryn StarkeyVice ChairThis okay, so this one wait, which one
Unidentified speakerVoice Athis is west of Murata. Just west of Marata where the old broken down uh I think it was like some kind of warehousing thing was there, but there's a multi use path in the area on the north and then there are the paths required by Connected City that are that's what the the conditions and the deed restriction are about are building the path connections that are required by Connected City.
Kathryn StarkeyVice ChairOkay, so there's al already one on the north side.
Liam DevineI I think we're confusing two of the items, which is P sixty one and sixty two. Right. So I think we're on P sixty two. Okay.
Okay. Well I asked a question on both, so it's not near that fair. Alright, so P s p P so sixty one is okay.
62 is what we're currently looking at in the area. Right.
Kathryn StarkeyVice ChairSo I'm I'm asking staff, I'm asking my planners, I'm asking somebody. When we fix the mistake of when we stopped the multi-use path at Curly. From prospect East, which side of that road is it gonna be on?
Jack MarianoMr. Chairman M you wanna just pull this on consent and then we'll talk about it because then we pull it give them a chance
Kathryn StarkeyVice Chairto pull up a bigger map. All right, then they can figure out who's gonna act who's gonna Tell us what the plan
Ron OakleyChairagain you asked staff for those answers before this meeting.
Kathryn StarkeyVice ChairUh I did not have a meeting on sixty two. I had a meeting on No, I don't have a meeting.
Ron OakleyChairI mean, you've gone over these items but you said you asked staff and you didn't get an answer. So I have a problem if
Kathryn StarkeyVice Chairstaff didn't give you an answer. I thought I asked I asked had a meeting on this Mitchell one and I asked that. Is that just Mitchell? Yeah, Mitchell.
But they d but I didn't have an answer.
Ron OakleyChairI just said it had it
Kathryn StarkeyVice Chairit has to be addressed.
DeniseBut no one's addressed okay. I I think we have a few people in in the audience that can assist with that in in um including but not limited to our county engineer. Um so is this being it's are we pulling that from consent, item P sixty two? Yeah, why don't we do that? And I believe the applicant is um is on on WebEx on that one. That's uh Barbara Will Hayden.
So that that is the end of your consent agenda? Um
Ron OakleyChairP because P sixty three has been pulled. It's being
Denisepulled, yes. And there's someone signed up to speak on that one as well.
Kathryn StarkeyVice ChairAnd I I did want to make a comment on the road The road on the first one. On P six P sixty? P sixty. Okay. Just when when I look at that, I know it's too late. I I've talked to Mike Galvin about this and others. This road section.
It is a hundred and forty two feet. That is s that is such a lot that is a lot of land. And And I and and hey, I'm all for you know I want the multi-use trail on one side and the sidewalk on one. And but to have from the edge of the road Um all the way over 29 feet. Uh you're you're gonna have to be running to co cross these streets. And here we're trying to build walkable communities
and I believe these road sections are crazy expensive and I think we've made a mistake in these um to to look if you look on the right hand side or the left hand side. It's twenty nine feet from the edge to the sidewalk.
Unidentified speakerVoice BOh.
Kathryn StarkeyVice ChairI why why did we do that?
Clark, you do you Yeah, I believe
Deniseall these road sections were based on the villages of Pasadena Hills planned. So that's already approved within that village.
Kathryn StarkeyVice ChairThat target left the horse or barn or whatever they say. Um I just think we were way way out of line to be asking these guys to build roads like this. We would have been a lot better with more roads and smaller roads and a grid than having these gigantic expressways. Okay.
David EngelDavid Engel, Planning Development, Economic Growth. The road cross sections are part of the VOPH plan. We've retained Bill Oliver to do a new study for VOPH to ascertain if we could reduce these roadways. And uh I can't I can't speak to this because it's already a given, but in the future and next year we'll have new new recognition. Mm-hmm.
Kathryn StarkeyVice ChairYeah, I think um I think we need to do that.
David EngelAnd I guess P sixty two is a bolt because there's just wanna let you know there's sidewalks on both sides of uh
Kathryn StarkeyVice ChairSide Yeah, it's supposed to have the most used trail on one of those sides, so I I wanna pull that for discussion. So so you've got sixty and sixty one I think for approval.
Ron OakleyChairSo you're pulling sixty two now?
Kathryn StarkeyVice ChairI'm sorry. Which is the I'm confused.
Ron OakleyChairShe
Kathryn StarkeyVice Chairshe
Ron OakleyChairwanted sixty two fold.
Kathryn StarkeyVice ChairFold, yeah. So I'm I moved to approve sixteen sixty one.
Ron OakleyChairI got a motion. Second. And a second. All those in favor say aye. Aye. Motion passed five zero on P sixty one, P P sixty, P sixty one. Now P sixty two, what is the question?
Kathryn StarkeyVice ChairOkay.
Liam DevineSo presentation for P62 Liam Devine, Planning and Economic Growth Department.
P sixty two. PowerPoint?
Kathryn StarkeyVice ChairOh you won't I just add the
Liam Devinemap. Unless we don't want a presentation.
Kathryn StarkeyVice ChairNo, I just all I'm asking is
Liam DevineSo we've had
Kathryn StarkeyVice Chairwe uh you know
Liam DevineSo I the I think the the question might be better suited to your transportation engineering department. Right. Um because that would be with the CIP and extending that. I can just tell you where the current trail stops at Curly Road, it's on the north side.
Unidentified speakerVoice CYeah, so I'm going to go to the right-of-way.
Liam DevineSo so I don't know if they would continue it on the north side, but I don't think there's any plan to but that question would be for your y for Ted.
Kathryn StarkeyVice ChairOkay. This is why we need that trail person higher at D S A
Sun CoastT.
Liam DevineWelcome Nick.
Sun CoastHi, I'm Ted.
Uh good afternoon. Uh Nick Uren, County Engineer. The question is are we going to build a a wider sidewalk on the north or the south side?
Kathryn StarkeyVice ChairSo you're aware, I think, um the multi-use path, which was supposed to be all along the north side of fifty two, connecting to the three oh one trail.
Unidentified speakerVoice DWas narrowed.
Kathryn StarkeyVice ChairWas stopped. at Curloo by some someone's decision, not ours. We had no knowledge that someone decided to stop that. So we met with DOT, we've talked a couple times with them, that we wanted to continue. And they have said they have the right of way to continue it on the north side from Curley to Prospect. But from Prospect
on To
Ron OakleyChair301.
Kathryn StarkeyVice ChairThere's there's more challenges and it was thought that it needed to go, my understanding, my recollection, was that it probably needs to go on the north side of Prospect. So we've been reserving that every time a project comes through, we've been preserving.
Ron OakleyChairNorth Side of
Kathryn StarkeyVice ChairI'm sorry, south side of Prospect.
Ron OakleyChairSouth
Kathryn StarkeyVice ChairI mean fifty two. Clinton Bakay, whatever you call it. From Prospect East.
Ron OakleyChairClinton Avenue.
Kathryn StarkeyVice ChairYeah.
And so we've been reserving that every time a project comes through here. Um I just wanted to be sure if you guys have had further discussions that that is where where it's gonna go. I'm gonna ask that on every piece that comes up on Clinton. 'Cause I don't wanna have a project go and then we then we have to stop. Then then it goes from a multi-use path to a sidewalk. Sure. Multi use path. So
Sun CoastMr Chair, I I guess the the best response I can give you at this point in time, we don't have a design for the pathway east of Prospect, putting it on the north or the south side, but there is a condition of approval on this rezoning that requires them to convey right-of-way from the center line of the road, consistent with our comprehensive plan width, which would give us the option to put a pathway on the north side should this rezoning be approved and this and this petition conveys the land needed. It keeps our doors open. Yeah.
Kathryn StarkeyVice ChairKeep the door open. That's all I'm asking. That's perfect.
Jack MarianoHold on,
Kathryn StarkeyVice ChairMs. Chair Mr. Chairman?
Jack MarianoYeah. But who's going to pay for the sidewalk? Shouldn't we have them paying for it?
Kathryn StarkeyVice ChairI I don't think that's you know I don't know if that's what determined yet, but at least we've got to make sure we have the land to do it.
Jack MarianoI agree with that, but then there's we're making all the other developments put the trail in or put the sidewalk in.
It should be something in front. And that should be done at the time of construction, not after the fact. So if we think we won eight or twelve And we have the rights to ask for it, then let's let's ask for it now.
Kathryn StarkeyVice ChairYou know, we don't have that one person in charge of all of this. That's
Jack Marianotrue.
Kathryn StarkeyVice ChairThat's right, but right now I do believe they they've interviewed someone and they're about to hire someone. So it's not me.
Unidentified speakerVoice BMr. Chairman, you've got I don't know that you've taken public comment on this, but you've also got an applicant online that probably wants to address this. Um
Ron OakleyChairthe same one?
Unidentified speakerVoice BSixty two.
Kathryn StarkeyVice ChairCan you volume? Can you hear me? Yes. Can you hear me?
Ron OakleyChairYes.
Unidentified speakerVoice EHi, Mr. Chairman Commissioner Oak Barbara Will Hyde. So this property is already zone C2 along Clinton Avenue, and there's already a site plan approved along Clinton Avenue that set up the requirements for development along Clinton Avenue. What we're doing here is a cleanup because we have a parcel under single ownership that has split zoning. We have commercial land use on the entire parcel, and we have split commercial and residential. So this app Is to rezone the residential
portion, which is to the back of the parcel. So this we really don't have the ability to effectuate any other what Mr. What your county engineer said, which is already in the staff area. We don't have the ability to effectuate this. We already have the project already has approved site plan. It's got a requirement for conveyance and rightway, and ultimately all we're doing is cleaning up a split zoning situation on this property.
Unidentified speakerVoice AOkay.
Kathryn StarkeyVice Chairwhen we look at the maps that are in our um Uh in the application On on one map it goes all the way to the edge of Clinton, but on another map there is a gap. um between the parcel and Clinton. It
It's a little.
Unidentified speakerVoice Ego over this with staff and have a little better answer and presentation to you if that's
Kathryn StarkeyVice Chairacceptable we'll continue. Well if that if that comments if that comment that the county engineer said is in there that if we do if it if it is coming on that side then there's land for it. That's all that we need. I don't need any
Ron OakleyChairmentioned a minute ago.
Mr. Chairman
Unidentified speakerVoice BMariano
restriction in your package.
And just scrolling down. Just add it up.
Jack MarianoHey Mr. Chairman Mariano? Yes. Uh Barbara?
Kathryn StarkeyVice ChairYeah.
Jack MarianoCongratulations, but this is nowhere to spend a honeymoon.
Kathryn StarkeyVice ChairI didn't show you a picture. I did show a picture. Oh I'm
Unidentified speakerVoice Ereally
Kathryn StarkeyVice Chairhappy
Unidentified speakerVoice Eto continue this. I I'm not gonna continue if there's there's no urgency on changing this up. I'm happy so we can come back.
Everything I ask you to do is something that you're comfortable doing. So I'm fine continuing to the next meeting in Dade City and we'll we'll bring it back and give a look at that and make sure we can answer your questions.
Jack MarianoMove to continue so she can get back to Ronnie Move.
So let's
Ron OakleyChairstill public hearing.
Does anyone want to speak to this item today?
Or when it comes back Nate City at time circle. Cool.
Unidentified speakerVoice BYes So if there's no one there the motion would be to continue to September third at one thirty or soon thereafter in date. So move
Ron OakleyChairsecond Got a motion of second. All those in favor say aye. Aye. It's continued.
Kathryn StarkeyVice ChairSeven o'clock. We'll have dinner.
Ron OakleyChairAll right.
