you. So the proposal on this one is going to be to amend the future land use that's going to be Map 2-15 sheet 23. It is currently has a future land use for major attractors and is being proposed to move to Res 3 to accommodate a stormwater pond. This is east of Gall Boulevard and north of the County Line Road. So directly it will be adjacent to Derelane Road. The proposed comprehensive plan amendment is for approximately 5.05
acres, and there is no rezoning action proposed at this time.
Um during the comprehensive plan consistency review, then we have reviewed it against policy flu 8.1.4, and we have determined it is consistent with the east market area.
The next. So this is going to be the location map of it. Um directly above, then that is all going to be major attractors. And below it is res three. Um so for If you want to go to the next slide, I'll probably show this a little better. Um currently this property it does jet out um into the res three portion as AT. So we don't feel that it has significant impact on to the actual overall major tractors future land
use.
And we do recommend the LKA to find this amendment consistent with the comprehensive plan and approve the Board of County Commissioners. Um are there any additional questions for this?

I would like to know how they're gonna handle the traffic. That where this is is an absolute dead end dirt road that I've lived on since eighty eight, The county does not maintain it. There is no way to get to that place. that they're talking about building Um mo I've I've seen prints on it. and there's no way they can get traffic in and out of there. I want to know what they're going to do about. the uh wastewater.
'Cause the drainage is awful. and it they're gonna flood everybody just like that one on Rooks, old Rooks Dairy is gonna do. And the traffic. How they gonna get water to it? And what are they gonna do with the wastewater?

Uh yes, I believe I did. Um Let me begin by saying that The Project itself. or the the piece of property Wait. project is affiliate w which is affiliated with a project which is actually going to be built out onto Gaul Boulevard or US 301. Um that particular piece of property is going to be used for stormwater pond.

So I guess Diane can you clarify how the What will be the vehicular access to that area?

So it's going to come in through the parcels that are Uh to the to the west of the subject property. The subject property itself is only going to be used for stormwater.
So will th will there be any access to Deer Lane?

So you're not building anything on that property, you're just it's a stormwater retention.

Mr. Chairman Mariano. Yeah. It may help to clarify the location of the overall development which is in the Res III future land use. Um I can point it out using the pointer and maybe Diane can Confirmed for us.

This this is would would be the area where the residential development would be. And then we're going to be able to do This site in red is the detention pond or one of the ponds at least.
So Terry, is this an MPUD that Still going to come to the Planning Commission on a future date?

I I would confirm that with uh Diane. Diane, would you know are you preparing an M P U D for this project?
No, uh that is um a Euclidean zoning. The zoning is done on it, and uh currently there are I believe totally very consistent. Hands of order.

So is it coming in as one site plan approval the parcel to the west and this parcel is like all coming in under a single site plan.
Yes, they are.
So I think staff through the site plan approval process can ensure that The access to this parcel is only through Gall Boulevard. Even though it's not coming through as an M P D. they still can require it to be a unified site plan that has only one access to go bullet. So uh with that stipulation. Yeah, it's not really a condition. You can't condition a plan amendment, but I'm just saying the staff has the power to make sure that happens through the site plan review process. Okay. And they also
can address drainage and flooding through the site plan or review process as well. Okay.
Okay. Uh was there anybody else that had any questions about this application?

Well, mm all I can say is there is no drainage there. When we have w if they dig a retention pond there or a lake or whatever they want to dr dig there, There's no place for the excess water to go. It backs up there, there's a ditch. that comes through there. that I've got on the print in my Case right there now. It comes from nineteen forty one. And that water comes from across
the street and down there and it runs toward Crystal Springs to the to the river. When a heavy rain it floods everybody. If they do that, and they plan to put their stormwater there The water does not go through gumbo clay.
So sir, the our land development code requires that they capture their own stormwater, that they shouldn't be generating excess stormwater off site.
They uh They got you know it it's it's it's not gonna It's not gonna perk. It's not gonna go through that ground. I've I've dug all over that place. We we we created that place in from nineteen eighty-eight. and you go down you'll hit Oh Gumbo Clay
What I would recommend, sir, is that you get a copy of their stormwater plans when they come in.

Diane, have you already submitted your stor your Stormwater approval for this site.
Um David, we are the planners for the uh amendment for the land use amendment. We are not the firm that submitted the construction plans. If you would like, if the Uh developer ha can have the opportunity to speak, she may be able to help expand on on this conversation.

What they have it. I was gonna say regardless, I don't think this is really an issue that should be decided at the Plan Amendment stage anyway. This is a stormwater issue that should really be addressed. It's site plan approval and my recommendation would be that Staff take this gentleman's name, And then when we get the actual stormwater plans in for review, we make him aware that he can come in and look at those plans. 'Cause I think that's his real issue. And we're not gonna be able to address it today during the Plan Amendment stage anyway. So If if you could sir
if you could just give your name and phone number to this gentleman. Or to her and she's on she's got it. Staff can contact you when we receive the stormwater plans for this project.
