So this particular item is a modification or an amendment to the land development code based on uh one of the many preemptions that were handed down uh by the legislature in 2021. This particular preemption included um it's Chapter 2021 and 178 Laws of Florida, which is creating 163.3205 Lord statutes, which uh limits um how we can uh deal with solar facilities. So basically, as you may recall, back in 2018,

we uh the Board of County Commissioners adopted and you found consistent with a comprehensive plan. Ordinance 1818, which established solar electric power collection facilities, solar farms, especial exception uses in agricultural zoning designations, and permitted uses in C three, I one, and I two. So this last uh legislative session in 2021, the legislature said that Solar um facilities is what they're calling them, they are to be permitted uses in

all agricultural zoning designations and all agricultural land use classifications. So before you is a modification to the land development code, which basically what it does is that it I'll just go through um Some of the highlights. So basically, it renames solar electric power collection facility and solar farm to a solar facility, which is consistent with what the legislature calls it. It adds solar facility as a principal permitted use

in all agricultural zoning designations. So basically, in AC, agricultural district to AC1, agricultural district. Um AR Agricultural Residential District, AR1 Agricultural Residential District, AR5 Agricultural Residential District, and AR5 MH Agricultural Residential District. It adds solar facility as a special exception use. Remember it was previously a permitted use, now it's a special exception use because it's now available in all those other Agricultural classifications. So it adds

it as a special exception use in C3, I1, I2, and again removes it as a permitted use in said districts. And it also adds landscaping and buffering, which is something that the legislature said we can do. We can add landscaping and buffering as a specific. use so so as long as we treat it as other similar uses and we're treating them similarly to electrical substations, distribute distribution electrical substations. So that's

going to be a modification. Oh I hear myself much better now. Modification to 905.2 and then it also defines solar facility consistent with Florida statute. And everywhere the term solar electric power collection facility and solar farm is used, we were replacing that with solar facility and adds that to the definition of minor public, semi-public facilities. This went to the horizontal roundtable interested parties meeting on August 18, 2021. There were no comments

from that group.

Well. Yeah. So today we're asking you to find the proposed ordinance amendments consistent with the Pasco County Comprehensive Plan and recommend approval to the Board of County Commissioners. This is going to the Board of County Commissioners for first reading on September 28th at 1.30 in New Port Richey and for adoption on October 12th at 1.30 in Dade City. And I'm here for any questions you may have.

removed as a principal permitted use for a couple of reasons. One reason is because it is actually uh now permitted in so many other zones. And also because looking at C three, I one, and I two, those are districts that the Board of County Commissioners have specifically stated that they want employment generated uses there. So we just listed it as a special exception so that perhaps that they can place conditions on it.
