The subject site is located on the east side of Henley Road, approximately 1,350 feet south of State Road 54. Here was

a look at the aerial view of the site. The surrounding future land use to the north is Res 6 and PD, to the east is Res 6 and Res9, to the south is Res 6, and to the west is Res 3. The surrounding zoning to the north is AC and MPUD. The M P U D is Cross Park. Um to the east is AC and AR and R1 M H. And to the south is AC, AR1, and RMH. And then to the west is A C

A R one and an M P U D, Woodville, Palms, which comprise of single family dwelling units. The subject site consists of single family, a single family dwelling, and agricultural pursuits on approximately 34.704 acres. Hi, my name is Susan Archer. I live at [address removed] and my house was the very first house built on this road back in the nineteen forties by my grandparents. And my husband and I bought it twenty-four years ago. And I live adjacent to my brothers and my dad who are right next door to us. And it was no surprise to us when we saw this. The surprise was that we didn't expect there to be a hundred and sixty four town homes. We were expecting single family homes, which

That would have been no surprise to us. That's something that we expected. But we're thinking with this many townhomes that we're gonna have at least 300 more cars on this road and the road has recently been paved. Before that was just a dirt road. uh when they built plantation the plant the preservation uh subdivision on either side of us. When we were reading and the agenda's findings and facts, it says that the developer

will pay for their fair share of all needed road improvements. And we're concerned That we're gonna have to pay for the roads to be improved since there's gonna be so many more cars on the road. and that we would have to share in that expense. It also refers to widening of the road. My house is sixty foot from the middle of the road and if the road gets widened then we are probably gonna be expected to give forty foot, which would leave

twenty foot a front yard for us. And years ago long before eve there was even a paved road, a car hit the corner of this house and my grandmother lived in that house and we're just worried about the safety of us being so close to the road when it gets widened. So my husband and I have Plans to retire? We're we're retired now. We have plans to live in this house for the rest of our life and We're just know we're getting ready to

deal with years worth of construction. And we're worried about having to pay for money that's gonna that we're gonna have to help pay for the road. And Living with all these extra people and uh more traffic. So what we would like to see is it not to be rezoned multifamily, but to be rezoned single family. And When the road is widened, we would Prefer that that the footage that needs to be taken be taken

from that side of the road and not our side of the road so that I don't have a road in my front yard. And We don't think that we should have to pay for those improvements. We wouldn't need those improvements if it wasn't for this new. subdivision going in across the street from us. We're perfectly fine with the road that we have now.

We wouldn't be here. That's a lot of homes. And on Henley Road. One hundred and sixty-four, we plugged some numbers. That works out about three hundred vehicles. on

Henley Road. Now I don't think there was I know there was a traffic study done. I don't know if it's uh uh I uh I don't know where all those numbers came from.

Uh Dusty Road exemption. Which really roughly means they just run over what's existing with asphalt. And that was paid for by I believe it was the development north and south of us. Now, honestly, we weren't very happy about that. But it turned out not to be a bad deal. They they've been decent neighbors and it hasn't been crazy. But then again, there's not 164 houses there. Town homes.

Hundred and sixty four crammed on Probably I don't know. So what is that, thirty-four acres of of that? probably maybe twenty five is usable. I don't know.

All of that traffic has to come out on Hindley. There's nowhere else for it to go. All of that traffic is either going to have to go to 54. or down Leonard to forty one. Or if they choose, they can go through the new development. It is to be Well, it would be the southwest of us.

Okay.

And if you can go d uh let's see, I'm trying to find Leonard Road. Can you go south? There you go. All of that is relatively new. Little road to the south, they can go out that way and go through that development. It goes out to I guess Sun Lake. Is that correct? Sun Lake? Okay. Long leg, something like that. J Rossy's old land.

So I I I just don't know how you can manage being reasonable about this. That's gonna be at least three hundred cars. And assume that half of those people go to work in the morning. How you're gonna be able to cram 150 hours within a short period of time, either going to work or coming from work. I don't know how that's possible. And then agreed with my sister there on the I went through all this building

for this new development here. And I believe was talked about dump trucks lined up. At four o'clock in the morning. They blocked the road. They wouldn't even pick up our garbage. And I th this is exactly what's gonna happen here.

When they start encroaching onto our property, which Took us most of our lives to pay for, but it is paid for. to have that taken away and or

Okay. Uh my name is Steve Mitchell. Um I live at [address removed], which is off Leonard, around the corner. I moved here and Five and I've seen a lot of changes in the area. Um I wanted to speak in opposition to this uh Just rezoning and for a couple of reasons. Um First, if you look at this map, I know they talk about uh multifamily being approved

in the area. If you look at the map there isn't uh It it's an established neighborhood, um single family homes, mobile homes. Some are on lots of several acres. Uh If so it it's not out in the middle of nowhere. It's in an established neighborhood. And to put that many town homes right in the middle to me is not consistent with what's in the area. Uh

I realized that, you know, eventually that that property would be developed, but I too was surprised that they wanted to put that many houses in there. They just developed across the street on the west side of Henley the uh But preservation woods and it's all single family houses. And um It's on the approximately the same size piece of property with wetlands and it's single family. I'm surprised there's not somebody from there that's complaining

about this these townhomes right across the street from 'em.

And down at the end of the street also there at Henley and and Leonard, you know, they put in the Morsani's property which just developed. It's it's rated R zone R3. The w reservation woods is R three. So I w I'm not opposed to it being developed, but I I feel that single family homes at R three would be more Appropriate. That piece of property on Preservation Woods is about the same size, and there's 57 houses on there. Which is

considerably less than a hundred and sixty four that they want to put on that piece of property. So that's my first point. My second point is the road. Um Henley Road, it was a dirt road forever, and it just recently Saved it. They haven't even bothered to stribe it. Um It gets a lot of extra traffic.

You know, Leonard Road used to it used to be dirt road and it it was pretty much a private road, Leonard, at one time. But when they paved that Uh people use Henley and Leonard as a shortcut to get around the intersection there fifty four and and forty one 'cause sometimes traffic backs up fifty four almost all the way to Henley. So there's quite a bit of traffic on that. So as it stands, I don't think Henley Road is is uh Appropriate substandard. There's no

sidewalks. Yeah. I I don't know who's gonna pay for the road improvement. I I believe it should be them. Um are they gonna put in sidewalks? Is it gonna be widened? It to me it's a safety issue. I don't know how much time I have left, but my neck

Flows um east to west across the road. I've seen flooding there when there's lots of rain. Leonard Road is flooded a new numerous times where there's a swamp right as you turn off of 41. And I'm afraid with all this, you know, development in here Uh we're gonna have flooding on that road. I also worry about I'm on Lake Linda and I'm worried about degradation of the lake. Where's all this runoff gonna go?

We are proposing townhomes, which is single family attached. We are not cramming anything in. This is a res six land use designation. A lot of times you see townhomes requesting a res 9 land use designation. So we're at the lower density for a single family attached project. We're one hundred our maximum was one hundred sixty four units, the comp plan would allow around 190 ish. Um so we were were below what the comp plan would allow. Certainly that's

the vision for the property, the way it's comp planned. To the north the the board has approved apartments. So you were stepping down apartments, single family attached, kind of classic planning. The neighborhood has different uses in it including mobile home parks which are probably higher density so it's not there are different uses in the surrounding area. Um sounds like a lot of conversation about Len uh excuse me about Henley Road, so we'll have to bring Ali

up to talk about that um specifically. We're not proposing to widen Henley Road. We don't necessitate the widening of Henley Road. We're not proposing to make any improvements to Henley Road other than if I want whatever sac site access improvements, I'm sure we'll have to do turn lanes. But again, I'll leave that to Ali to uh talk to you about um Jeremy Couch is our civil. I think he can just talk about his approach and flooding and those types of things. So we'll bring him up to to talk about that. But

I just don't know. The characterization that we're cramming something in is just not correct. I mean townhomes are attached and and they're actually You don't have pools in the backyards, so and you have common amenities. They're commonly maintained. There's instead of having single family homes where You pay for your HOA to run after your neighbor to maintain their house for townhomes. You pay the HOA to maintain you and your neighbor's townhomes. So they're always nicely maintained um and landscaped and kept. So uh

let me um Bring up uh Ali to uh talk about uh Henley Road.

not apartments. Okay. Yes, yes, cannot be apartments.

Good afternoon. My name is Alia Tefi, uh Links and Associates, Tampa Bay, Florida. Um So Henley Road um I believe is recently paved and I I don't think County considers that as a substandard anymore. Um there was a mention about sidewalks. The the substandard road criteria does not include sidewalks. So I don't know whether this project when they go into the site plan approval process, they would be required to put sidewalks along

their own property line. But I don't think there is a requirement to uh construct sidewalk all the way to fifty four or beyond their sight. Um Also on Henley and fifty-four. Um the there is a commitment uh to pay funds for a signal and some geometry improvements that the county and a developer are sharing the cost to pay. Um and when this project comes in

uh for site plan approval um They can certainly contribute to that, but whatever they pay is gonna be mobility fee credit tableau because it's not access improvement at fifty four and Henley. Um Uh I'm I'm hundred percent sure when they come in with the site plan Um At that time uh the county would require to put a southbound left and into their site. I have never seen any Any

project that doesn't do a left turn. off of uh further site access because it's just for safety. Even if the left hand is not warranted uh is required to put one in. So that's all I have to say. If you want to know about the trips, I mean there was a mention about the lot of trips on Henley Road. We did a count recently and there were um

Right there at fifty-four and Henley

There were 34 cars turning into Henley from 54. And there were like 49 cars making a northbound left onto 54 and 28 cars making a right turn. So by traffic engineering standards, these are not very high numbers. And then when we added the the project traffic that is produced. Used. uh or generated by this project. Which is in the P M peak. is

fifty eight cars going in to the subdivision or the development and forty four cars getting out. When you add it To everything on Henley Road, the V over C ratio, which which is a demand over capacity, is only like 20%. So you still have eighty percent capacity not used. And so that's based on actual counts.

The neighbors expressed concern that the road would need to be widened and I hear you talking potentially about a left turn lane. Is there any possibility that the right of way for a widening or the left turn lane comes out of the neighbor's property and not this property?

Ali Atefi

Uh yeah. Yeah, the answer is no. Okay.

Jon Moody

I just wanted to assure them I wanted to hear that from you so that you all understand that In no way are you if if we approve this and the Board of Commissioners approves this, no one's gonna come looking for right of way from you because of the impacts caused by this development. And I don't think they're going to be looking for money from you to improve the road. That would be a cost borne by the developer.

I have a question. Yeah, David. Sorry, Barbara. So Ali what was the percentage distribution of your traffic going north to fifty four versus Bow to Leonard.

Most of our traffic went north to fifty four to Leonard, um

We only had of the um let's say total trips coming out of the project, only two trips went south. Okay. That's just give you a magnitude of the

I'm only asking because somebody was smart enough to require the developer. or Sani to have a connection out to Sun Lake, so It seems like some trips would be going Out to Sun Lake or to Dale Mabry on Leonard, but it doesn't this doesn't sound like you assumed very much going that way.

No, we didn't. We just wanted to have worst case. I mean, everybody go on fifty four. But yes. That that's good. But based on the traffic we're seeing, people using Henley is not that many.

Okay, and then my other question is for I don't it's either Ali or SN.

I'm not sure if I understand finding fourteen in the And this may be why the public is confused about what we're doing to Henling. So finding fourteen says that we're gonna do Substantive route analysis at site plan. And then says if it's considered substandard then You'll have to pay a fair share for acquiring right away, building, designing, constructing what's needed to meet our standard. So I actually see why that might scare the public that

we may be doing something to Henley, why was this decision of Whether Henley Road is substandard or not, why was that deferred to site plan?

W I normally we do do normally we do do this analysis at zoning. That's why I'm not understanding why it was Deferred to site plan.

I don't have any answer, but I can tell you that the county paved this uh and people paid propshare to make it standard.

I am actually came up that with that condition and I actually went out to the site and so that was put down just to make sure that everything was uh in order. I just wanted to make sure that the applicant had an opportunity to uh at the site plan uh level to look at the roadway again i if needed, but I

actually drove out there myself and the roadway was um standard.

David, I find that staff, because it's a Euclidean zoning, they'd like to put in a condition like this, citing what the code says.

But I've also seen staff say if a road's standard, I've seen

I guess I'm just saying I'm I don't know that we should be putting language like this that's just gonna scare people to thinking that we're doing something to the road if we're not really gonna do something to the road. I actually see why they're they're scared that it's gonna be widened and

We do. We submit an application and it's reviewed and I mean st uh Stacy Burgess said, you know, sh I remember all the email traffic 'cause I can't submit the rezoning until Timing and phasing is signed off on. And substandard vote. I can't even I allow to submit it. So all of that occurred and Stacy was um actually went out and looked at the road personally as well.

Okay, well between now and the board I think somebody needs to relook at Finding fourteen if we're not If we really think the road is standard, we should just say that so we're not scaring people.

Agreed. I would just say we do have to do a sidewalk along Henley for our portion. Um the project to the north will have to do on their portion. I would also note that Henley I think it might also be helpful to for them to understand not only the this condition was might have got caused concern, but it's a collector road. So if when the county goes to make any improvements to that road or repave it, I think it's done through their um program maintenance. It's not assessed to the homeowners. I think that's helpful. If I'm saying that wrong anybody it's funny

but we had just have voices here. Any voices up there if I'm saying that wrong, please correct it, but that's my understanding. We don't

They're up there somewhere. Um and I would just add that Henley's also a Vision Road, so that's another reason why staff was finding this to be an appropriate density on a Vision Road, on a collector, and in a where you're where uh six units per acre is the uh what the board has set uh for the property. In the comp plan.

Jeremy Couch, Tampa Civil, 17937 Hunting Boat, Circle Lutz 33558. This the project is going to follow county criteria, Swift MUD criteria, and any DEP criteria for stormwater and treatment. Um typically these type of projects provide an improvement to the area. Thank you. Thank you, Jeremy.

So yeah, I think the I guess the m main thing I kept hearing was road, you know, the access and the widening and so forth. So the situation as I understand it is if they widen the road It's not gonna come off their property, is that correct, David?

Jaimie Girardi

Well Yeah, but that gets to the point of I don't think we are gonna widen this road. That's why I think I wanted the finding. Change to say it's If this is a standard road, Well I guess it's possible in the distant future it could be widened as a collector road. But If the question is for the turn lane That's only going to come from the applicant's project. Right.

Like to a four lane road in the distant future, That will come from the

think there's any immediate plans. This the developer is uh uh dedicating forty feet of right away on their project. In case we ever widen it to four lanes in the future. But I don't think we have any meeting plans to widen it to four lanes. If we ever did it would have to go through Probably the eminent domain process to acquire all that right away.

Okay, so it's not something we can stipulate now.

It that's gonna I mean that's gonna require right away acquisition from multiple property owners Yeah, it's not a good idea. This project is doing what they've been told to do, which is they're giving us forty feet of right-way In case we ever have that w I mean there's not much else they can do. They're giving us what our corridor preservation tables require. If we need right away from somebody else That'll be decided in the future whenever we four lane this road. But what I'm hearing is that We

do not have any immediate plans to four lane this road. or widen it to deal with substituent road issues because What I'm hearing Stacy say is it's basically standard. Yeah.

And also this is Stacey Burgess again. Also on our on our uh corridor preservation table, it has a right of way of eighty feet, but the lanes are for two. So there's nothing on the tables that stating. Oh, so we're not even gonna four lanes.

But we might add sidewalks or something else in the future which might require additional right of way. Um But what I'm hearing is there's no immediate plans to do any of that.

Okay. So that should give uh give you all some comfort level that they have no plans to do that. And they've already They're already providing forty additional feeder right away. Uh Beyond their property, there's not much We can do because that's not really a topic of this conversation. There's other property owners on down that road. So Um Anyway, are there any other questions or comments?

This is Stacey Burchis. Again, there's one thing that I wanted to make sure that was read into the record and for the applicant at time of sight plan to evaluate Henley Road and State Road 54. As was mentioned earlier, that it will probably warrant a traffic signal and that a fair share would be expected. But we also we just staff just wanted to make sure that that went into the record and we also had in the finding of facts that when they go to evaluating that the distribution will also look

at a different distribution than what they showed initially. So we also wanted to look at that as well.

It sounds like staff can address all these issues that they just mentioned, including Henley being a standard road. Before this gets to the board. I think they're gonna need to amend some of the findings of fact to address Not just that issue, but also the issue that Stacey just mentioned. So I don't think there's anything the Planning Commission needs to do if you if you're willing to recommend approval.

Um Because those are all findings of fact. You can't condition this project. So I think staff just letting you know that there's gonna be changes to the findings of fact. Okay.

I just I mean as far as compatibility I think it is an issue. I if you look at the Res three it's on the west side of the road, or S six is on the east side. I don't know why the county did that. Doesn't make a whole lot of I don't know the rhyme or reason of it, but I can see it was uh there's single family there, it's been developed and now to go multifamily one. And then when I finally zoomed out and saw all of the surrounding development I said I had a different opinion, so I maybe we could get kind of

a big picture photo and zoning map and future land use map included in future agenda packets.
