Appeals overturned and reappointment update
What the county recorded
This item is not from the published agenda
It is a stretch of the recording that this archive identified as a separate matter — a call to order, a recess, or something taken up that the agenda does not list. There is no official title, no staff recommendation and no disposition, because the county never recorded one. Everything below is inferred.
The source document
The county’s agenda for Planning Commission, Aug 8, 2019
The published PDF, as served by the county. This item is one entry in it.
The county’s minutes for Planning Commission, Aug 8, 2019
The published PDF. Its text could not be extracted — it is an image-only scan — so nothing in it is searchable here, but it reads normally.
What was said
Machine transcription of 5m of recording, with speaker names inferred from voice matching. 100% of 30 lines carry a name. It shows what was said, not what was decided, and both the words and the names can be wrong.
Will you move to adjourn?
Quickly. Denise, since yesterday was the first time we had an appeal from the new planning commission to the board, I do think it would be helpful if we tell if you told the planning commission when they've been overturned. Okay. So I think you should tell them what happened yesterday.
Sure. So at the Board of County Commissioners meeting on Tuesday. Is that what you're speaking of, David? At Tuesday's Board of County Commissioners meeting, um, the Board of County Commissioners move to reappoint Charles Gray and Kevin Ryman to the Planning Commission for two-year reappointment terms that will begin. I'm committing this is from my member. And I apologize, August 9th, 2019, and will expire August 10th,
2021. Um that was approved by the Board of County Commissioners on Tuesday.
Okay, that wasn't I'm glad you told them that too, but
additionally
yes, I was referring to the appeal.
Oh the appeal, I apologize. Okay, well thank you. So um yes, uh as you may have recalled, um in February February twenty-first of twenty nineteen, the Planning Commission denied on a vote on a three-two vote a special exception for a baseball and softball school, private school, in an Agricultural Residential District. That item was heard on appeal on Tuesday by the Board
of County Commissioners and the Board of County Commissioners overturned staff's I mean so I'm I apologize overturned the Planning Planning Commission's decision and uh granted the appeal uh with some modifications to three conditions. Uh they struck out condition four which required the applicant to improve hadlock drive. And also they struck out condition number 10, which required the applicant to obtain building permits. In addition, uh they
modified condition number three. Which basically extended the hours of operation. Originally the applicant had requested from 3 PM to 8.30 PM, Monday through Saturday, I believe, and it was changed to 9 a.m. to 8.30 P.M. So that's what occurred on Tuesday on the Ryan Pryor and Elizabeth Pryor appeal.
So that blew us out of the water on that one.
And they made the residents there very happy. Um by by eliminating all those conditions.
I just thought you should know what you should know when you've been overturned. So that's
Yeah. That's what we're here for.
You know, I I it it would be nice to know, um, you know, as these things go down the pike w what ultimately is the happens to all these things. I mean, even the ones that I assume you're not going to be able to do and you know, I mean they they may they may disagree with us and
Well I think Denise could probably report back to you the ones where they've gone against your recommendation. Either your approval but for her to have to report back on every single consent item would be a little burdensome. I mean because you're well I get that. You approved twelve items today on consent that uh they're probably just gonna stay on consent in front of the board. So but I wasn't referring to those. You should probably could report back to you at any time the board goes against your recommendation or your decision so that you're aware of that. I'll be happy
to do that. I'll no I'll be happy to do that. Do you want that in an actual written report or would you is it okay for me to verbalize it as I did
What's the pleasure
of the Planet Commissioner Oakley for you, it's more verbally.
We don't get that many where you where the board does something differently than what you did. So the it there probably wouldn't be more than one every meeting where that happens.
Yes.
If that.
And uh another question on the reappointments. Um I'm certainly glad that Kevin Chucker reappointed, but what was the process uh of that?
Um the process for the reappointment um was I spoke to each individual commissioner separately and asked if they had any reservations on the reappointments and um there was a no. In the future I have been directed for the future reappointments to actually open up the application for the Planning Commission. So basically state the Planning Commission is looking for members and have a pool of folks coming in together with the potential
future reappointments and get the board's buy in collectively. as to um whether they want to move forward with a reappointment.
So who d who directed you to do that?
Um the our county administrator.
So why wasn't that done in this case?
I believe because the reappointment was um it's very a very short time frame, I believe. But I that was that's just my thinking. Ooh.
Okay.
