Used car lot moratorium and enforcement

What the county recorded

This item is not from the published agenda

It is a stretch of the recording that this archive identified as a separate matter — a call to order, a recess, or something taken up that the agenda does not list. There is no official title, no staff recommendation and no disposition, because the county never recorded one. Everything below is inferred.

StarkeyChair

Thank you. Okay, so um Commissioner Moore, I want to thank you for driving the 19 corridor. If I'd known you were doing that, I would have said drive down Mile Stretch, drive down Grand. Maybe drive down fifty two. And because um, Yeah, so when we move 'em off some t you know, we've moved some off at nineteen and they just show up Uh uh uh in any e anywhere. So um I would ask, has Sally, have have we taken any action

on any used car dealership yet? And um while she's coming up, if you don't mind um Getting ready to post those photos. Um I do have the Newport when we had the workshop with City of Newport Ritchie, we talked about their moratorium on um car lots. And um theirs is on new or used. I'm I'm really more Upset with the used car locks, although I think there is some tweaking if we haven't done already on

the new ones that I'll bring up in a second. But have we taken any action? On any of the used card lots. Yeah.

Sally Sherman

Uh good morning, Commissioner Sally Sherman, Assistant County Administrator for Development Services. Commissioner Chair Starkey, yes ma'am, we have. you will we will be sharing a report that's being prepared right now that shows the activity for 67 car lots that have been visited. uh re um reviewed as far as what has transpired on the lot, some that have complied, some

that are grandfathered in and we have 'em all categorized, that report is going to be finalized and to I could share it with each one of you um next week.

StarkeyChair

Um what I'm most interested in is when we talked about um enforcement of some of the issues. One of the main tools that we were told we had was enforcing the amount of car spaces that these dealerships were allowed to have. parking spaces. Has anyone Um then told to You know, That they can only have X amount of cars on their lots yet?

Sally Sherman

Mm, what has occurred is those that have been in violation, they're now required to go for site plan approval where that will be determined. Um, they all differ to a certain degree, Chair, because some of them, if they're grandfathered, there's nothing that limit them, just that they have to keep driveways um and access available for emergency. Um

StarkeyChair

Let me let me ask, well, I'm not sure if this is a place to get in depth on that either, but But I'm not sure that's correct because even if they're grandfathered on our new used car overlay ordinance, they still had to have some kind of approval that allowed a certain kind of parking spaces for right on site and so I think that's our tool to clean up some

Unidentified speakerVoice A

of these, right? Pre seventy

StarkeyChair

we unless they're pre

Unidentified speakerVoice A

seventy eight, Eight, I think, was when the board first adopted a zoning code.

Sally Sherman

And they all differ, uh Chair. So with all due respect, I don't want to speculate. We do have a very comprehensive report that is being prepared on um each one of those lots. And as you indicated, as we um get with those properties that are in violations, some of them will close and then they'll open up somewhere else. And and so we're we're chasing that um continuously those properties.

StarkeyChair

So that's why um it it was my wish before and I thought we had some consensus. So I just want to check again that while we're still cleaning up the mess and the so that it doesn't prol proliferate, I think we should do a moratorium on used car lots. Um, because I think we have so much work to do on the ones we have, and I'm telling you, they're popping up. All over. They're on 41. I don't drive 301, but so they're 401. Yeah, they're just they're coming more and more.

So I think we've got to put a stop to it till we have it under control. Also portion. Would

Oakley

you make a motion? I don't see a great number of them popping up here, but I'm sure they probably would

Moore

41. They're on 41, 52, and obviously we know 19. And then and then you see a couple on your side of 54 closer to 19 as well.

Oakley

Yeah, I just don't see it as you see it on the west side.

Moore

I'm I'm I'll make that motion for you. But

StarkeyChair

how long? How long can we have a more

Unidentified speakerVoice A

to

StarkeyChair

bring it back?

Unidentified speakerVoice A

So one, it's you've gonna adopt a moratorium by ordinance. Two is there has to be a plan for fixing it.

StarkeyChair

Yep.

Unidentified speakerVoice A

Um three is a year is about as sustainable as you can get.

Well I I I last time the last time we did one it was I think it was six months with an the ability to extend it for another six months.

StarkeyChair

Well I would recommend that. Six months with the ability to extend.

Unidentified speakerVoice A

But you

StarkeyChair

can bring that bring it back to us.

Unidentified speakerVoice A

It's gonna have to be advertised and it's it's gonna come back before you as a public hearing item. But but my concern is that the planning department has to have the resources to actually develop standards for a fix. You just can't do that. I bet they're out there. I bet they're out there. Moratorium to To stop used car lots from pr from being established. There has to be some land development code regulation

that is in the works. To do that.

StarkeyChair

Okay. Well I I think we can Find some one one of them is what is the minimum size of one of these? Um I I think we can come up with some some good ideas. We'll call it. All in favor? Aye. Opposed? Yay. Thank you. Um I'm not gonna talk about it here. Thank you, Sally. Um I'm not going to talk about it here. I think we'll bring it up at the M at the MPO meeting, but Commissioner Moore, thank
