County attorney litigation update on boat lift covers
What the county recorded
This item is not from the published agenda
It is a stretch of the recording that this archive identified as a separate matter — a call to order, a recess, or something taken up that the agenda does not list. There is no official title, no staff recommendation and no disposition, because the county never recorded one. Everything below is inferred.

Uh no, you don't need don't need a litigation assessment meeting. Um as the as the board is where um there was pending litigation coastline boat lift covers versus Pasco County. Um On October 27th, 2025, the court dismissed their case against us based on the adoption of the new ordinance.
There was a motion for summary judgment that had been issued by the court April twentieth, twenty twenty three, which we appealed to the second DCA. uh based on the error we think in the court's language uh regarding the advertisement for the uh twenty nineteen ordinance. Second DCA said basically it was premature to appeal at that point because n
a final action had not been taken in the case. While I
Believe the court was in error in that summary judgment motion. Um I also am aware that. if and now it would be ripe to appeal Um I'm also aware that the District Courts of Appeal are highly unlikely to take a case which has been resolved in all other aspects. um and by your adoption of the new ordinance, I think that would be the position they would take. So Long
way of saying While I would like to appeal it, I am recommending that you not appeal it because I don't think we'll get anywhere. It'll just be good money after bad. So that makes sense. Um and at this point the the issue with regarding regarding boat covers and the uh that particular vendor Has been settled, I think we let sleeping dogs lie and move forward. Sounds good? And that's it.
Do you have anything?
And
Madam Clerk has nothing to bring forward.
