Approved to continue the item to the January 9, 2024 Board of County Commissioners meeting at 1:30 p.m. in Dade City with Commissioner Bradford absent from the vote.
4mJack MarianoChairAll right, so I'm gonna we'll okay. We don't have any action to take on that last item? No. Okay, so we're moving right along. Okay, so now we'll get to the public hearing.
Unidentified speakerVoice AWould you like me to read
Jack MarianoChairthe procedure? Mr. County Attorney, please.
Unidentified speakerVoice AThere are two rezoning agendas regulating consent. Staff will present each application to the Board of County Commissioners. If staff or planning commission has recommended approval and there is no opposition, the application will be considered by the board without further presentation. If staff or planning commission has recommended denial or if there is opposition to the application, the applicant will be given five minutes for presentation, the opposition will be given three minutes for each individual, or five minutes for a group representative, and the applicant will be
given three minutes for rebuttal. Any individual disagreeing with staff or planning commission recommendation or anyone wishing to object to any condition of the rezoning may at this time request the petition be pulled from the consent agenda, in which case that application will be heard under the regular agenda later on during the meeting. Otherwise, all rezoning applications on the consent agenda will be approved by a single motion and vote. If you wish to speak to any petition, please give me your name and address and whether or not you've been sworn
for the record. These are quasi-judicial public hearing. The law in Florida is that public support or opposition of an application is insufficient for this board to take action. Please limit your comments to those criteria found within the Board's Land Development Code. Madam Clerk, would you like to swear folks in?
Ron OakleyVice ChairYes, um Mr. Steinsnyder. If um if anyone here is in the public would like to speak to any of the remaining items, if you could please stand.
Please stand if you plan to um speak at the podium. All right. Please raise your right hands. Do you swear or affirm the testimony you're about to give is the truth, so help you God. Thank you.

7mUnidentified speakerVoice BYes, sir. P forty eight was advertised in the Tampa Bay Times January seventh, twenty twenty-four, and January fourteenth, twenty twenty-four.
Unidentified speakerVoice CGood afternoon, Commissioners. Uh the Real Property team has received a petition to vacate platted right-of-way and alleyway filed by Tabitha Wallace and Mark Evans. The purpose of this vacation is to create one property for a homestead exemption. There were no objections to this petition and the team recommends approval. And the petitioner is here if you have any questions.
Kathryn StarkeyI'm kinda a fan of alley's.
Ron OakleyChairLet's go back to the map where it shows uh right away.
Um maybe the next map. Okay.
Kathryn StarkeyI d I don't know where this is in context to anything else, but Does that does that red mean that we've been vacating those
Unidentified speakerVoice CThat's the re yeah, that's the portion that's being requested to vacate.
Kathryn StarkeyWell there there's two red lines, so what's that mean?
Unidentified speakerVoice CThere's the northern portion is an alleyway and the bottom portion is platted right of way.
Kathryn StarkeyWell how is there a house built in the alleyway?
Unidentified speakerVoice CIt w it's yeah, it was something that was done way before. I I'm unsure of how it was there. Wait, there are multiple houses in the outer.
Again, this is all all paper roads and alleyways that have been there for many years.
Kathryn StarkeyLike how like how long?
Unidentified speakerVoice CI I don't know an exact
Unidentified speakerVoice Ddivision, it's Miller Subdivision.
Ron OakleyChairCome up Okay.
Unidentified speakerVoice DOh sorry. Tabitha Wallace. You want my post office or my physical address? Physical address? [address removed]
Unidentified speakerVoice BAnd where you swore. Morning.
Unidentified speakerVoice AShe
Unidentified speakerVoice Bdoesn't need to be
Unidentified speakerVoice Dfor a vacation, but
Unidentified speakerVoice Bthat's
Unidentified speakerokay.
Unidentified speakerVoice BOkay. Then never mind.
Unidentified speakerVoice DDon't worry about it.
Unidentified speakerOkay.
Unidentified speakerVoice DSo the the property was own is been owned by my grandfather in the family for my mother is seventy will be seventy-seven, seventy-eight this year. And she was about ten years old when my grandfather was in the service. Each month my grandmother bought a lot of Miller's Miller Subdivision is what this is called. and the house built there my grandfather built, my mother put in the pool and the other house you see there that's the pool house in between and the big house that I live in and my mother lives in the pool house. and in the field and
my brother Mark Evans is my brother. and he lives over in the corner here. So because of the property, my mom put it in our name. She split up the field and all to him and put the house and everything in my name. And so now I wanna file Homestead as one and I can't because of the road the the street and the alleyway that's never been used. It my grandfather memory home gar um growing a garden there. Always had the the shop. That's a big shop you see there is not a house there beside my house in the garage. It's
never been a road, it's never been an alleyway ever. And I am older too, so in my in my life not gonna say how nice. So but it's never. It's always been our family property and my father and my grandfather has always maintained it and we've maintained it. It's never been maintained by the county. Right. And the p we got permits for the pool, we got permits for the buildings. How that was? In the alley? In the alley, yes. And my my stepfather, which is not uh with us anymore, he actually came down and did something at
the property wherever you made all that years ago. I wasn't involved in it then but so he come in and paid for the get the permits and did everything this so we thought actually all that was taken care of years ago. But now that it's in my name I'm having to pay full tax and not able to file homestead and that's the reason I'm here today, is to try and get it all as one.
Ron OakleyChairAnd this is in the Licucci area, right? It is
Unidentified speakerVoice Din Likucci, yes sir.
Ron OakleyChairSo this area where it is Platbook Two. So it's really old. Wow. It's been like this for a long time and and because for sixty four years Lakucci's been going backwards because of the comer plant leaving uh many years ago. So uh that's why some of this was planted this way, I suppose, but
Kathryn StarkeyI wonder if there's some cleanup we need to do in that area. I I mean does the county ever go in and clean up? Yeah, not make the doesn't have to hire attorneys or whatever to I don't know what you had to do to get to this point but I've been working
Unidentified speakerVoice Afor two years. No, the county the county doesn't go in and vacate Vacate it vacate its right-of-way unless there's a request.
Kathryn StarkeyWell I'm thinking that with you know, I I love alleys but I see what's going on here and we're not getting any taxable income from those alleys.
Ron OakleyChairNo.
Kathryn StarkeyAnd if they were in the property, wouldn't it be better for us? us?
Unidentified speakerVoice AYeah.
I I don't don't know all over the this would be a Full team job.
Kathryn StarkeyYeah, yeah. It's a big one. I mean look at Wayne Road. That's not I don't I don't even understand what's going on whose property is Wayne Road.
Unidentified speakerVoice DWayne Avenue, that road you see right there is actually my property. That's part of my property goes over. If you look at the how each subdivision, how the line the green lines, it's it's crazy the way they did that uh however many years ago, like as you were saying uh hundred years ago, yes. So it's it's very hard. Maybe that's the reason it's never nothing been done with it, because it is very tricks your mind or what have you. It's very confusing and very probably very hard to do that. But I just wanna
build a file homestead exemption on all my property. I was hoping with my brother um part of it 'cause he owns more property up this way, but because him and his wife's name is on some of it, we had to actually stop where we stopped at.
Kathryn StarkeySo that piece along the bottom, the wider one, is that supposed to be a road? That is a
Ron OakleyChairroad,
Kathryn Starkeyyes.
Ron OakleyChairAnd it will never be a road because you got Yeah. There's a house down there building it. There's a lot of stuff in that. Yeah,
Unidentified speakerVoice Dthere's there were there were two more houses there from um some older generations. that have passed and and one of the places my mother bought and the house came down and then there was another house beside my brother's house here on the corner. He lives there, him and his wife, and there was a house beside them that they um actually tore down whenever they purchased all that property. So It's it's just a mess.
Ron OakleyChairI assume this will not be uh the last time we actually see this in our redevelopment of the Lakchi area. Yeah. I think this will come before us more and more. Okay that we'll find things that don't like this. Yeah. So
Unidentified speakerVoice Ayou need public you need to have public
Ron OakleyChaircomment if there is any is anyone here to speak to this item?
Unidentified speakerVoice BAnd there's no one signed up and no one on
Ron OakleyChairWebEx. Nobody on WebX. So pleasure of the board more pool
Unidentified speakerVoice Bsecond
Ron OakleyChairgot a motion second by roll call vote
Unidentified speakerVoice BDistrict two, Commissioner Weightman. District three, Commissioner Starkey. Hi. District four, Commissioner Bradford. District five, Commissioner Mariano. Aye. District one, Chairman Oakley.
Ron OakleyChairAye. Motion passed. Move on to P49. Thank you. Thank you.
