Good afternoon, Commissioners. Uh the Real Property team has received a petition to vacate platted right-of-way and alleyway filed by Tabitha Wallace and Mark Evans. The purpose of this vacation is to create one property for a homestead exemption. There were no objections to this petition and the team recommends approval. And the petitioner is here if you have any questions.

Kathryn Starkey

I'm kinda a fan of alley's.

Ron OakleyChair

Let's go back to the map where it shows uh right away.

Um maybe the next map. Okay.

Kathryn Starkey

I d I don't know where this is in context to anything else, but Does that does that red mean that we've been vacating those

Unidentified speakerVoice B

That's the re yeah, that's the portion that's being requested to vacate.

Kathryn Starkey

Well there there's two red lines, so what's that mean?

Unidentified speakerVoice B

There's the northern portion is an alleyway and the bottom portion is platted right of way.

Kathryn Starkey

Well how is there a house built in the alleyway?

Unidentified speakerVoice B

It w it's yeah, it was something that was done way before. I I'm unsure of how it was there. Wait, there are multiple houses in the outer.

Again, this is all all paper roads and alleyways that have been there for many years.

Kathryn Starkey

Like how like how long?

Unidentified speakerVoice B

I I don't know an exact

Unidentified speakerVoice C

division, it's Miller Subdivision.

Ron OakleyChair

Come up Okay.

Unidentified speakerVoice C

Oh sorry. Tabitha Wallace. You want my post office or my physical address? Physical address? [address removed]

Unidentified speakerVoice A

And where you swore. Morning.

Unidentified speakerVoice D

She

Unidentified speakerVoice A

doesn't need to be

Unidentified speakerVoice C

for a vacation, but

Unidentified speakerVoice A

that's

Unidentified speaker

okay.

Unidentified speakerVoice A

Okay. Then never mind.

Unidentified speakerVoice C

Don't worry about it.

Unidentified speaker

Okay.

Unidentified speakerVoice C

So the the property was own is been owned by my grandfather in the family for my mother is seventy will be seventy-seven, seventy-eight this year. And she was about ten years old when my grandfather was in the service. Each month my grandmother bought a lot of Miller's Miller Subdivision is what this is called. and the house built there my grandfather built, my mother put in the pool and the other house you see there that's the pool house in between and the big house that I live in and my mother lives in the pool house. and in the field and

my brother Mark Evans is my brother. and he lives over in the corner here. So because of the property, my mom put it in our name. She split up the field and all to him and put the house and everything in my name. And so now I wanna file Homestead as one and I can't because of the road the the street and the alleyway that's never been used. It my grandfather memory home gar um growing a garden there. Always had the the shop. That's a big shop you see there is not a house there beside my house in the garage. It's

never been a road, it's never been an alleyway ever. And I am older too, so in my in my life not gonna say how nice. So but it's never. It's always been our family property and my father and my grandfather has always maintained it and we've maintained it. It's never been maintained by the county. Right. And the p we got permits for the pool, we got permits for the buildings. How that was? In the alley? In the alley, yes. And my my stepfather, which is not uh with us anymore, he actually came down and did something at

the property wherever you made all that years ago. I wasn't involved in it then but so he come in and paid for the get the permits and did everything this so we thought actually all that was taken care of years ago. But now that it's in my name I'm having to pay full tax and not able to file homestead and that's the reason I'm here today, is to try and get it all as one.

Ron OakleyChair

And this is in the Licucci area, right? It is

Unidentified speakerVoice C

in Likucci, yes sir.

Ron OakleyChair

So this area where it is Platbook Two. So it's really old. Wow. It's been like this for a long time and and because for sixty four years Lakucci's been going backwards because of the comer plant leaving uh many years ago. So uh that's why some of this was planted this way, I suppose, but

Kathryn Starkey

I wonder if there's some cleanup we need to do in that area. I I mean does the county ever go in and clean up? Yeah, not make the doesn't have to hire attorneys or whatever to I don't know what you had to do to get to this point but I've been working

Unidentified speakerVoice D

for two years. No, the county the county doesn't go in and vacate Vacate it vacate its right-of-way unless there's a request.

Kathryn Starkey

Well I'm thinking that with you know, I I love alleys but I see what's going on here and we're not getting any taxable income from those alleys.

Ron OakleyChair

No.

Kathryn Starkey

And if they were in the property, wouldn't it be better for us? us?

Unidentified speakerVoice D

Yeah.

I I don't don't know all over the this would be a Full team job.

Kathryn Starkey

Yeah, yeah. It's a big one. I mean look at Wayne Road. That's not I don't I don't even understand what's going on whose property is Wayne Road.

Unidentified speakerVoice C

Wayne Avenue, that road you see right there is actually my property. That's part of my property goes over. If you look at the how each subdivision, how the line the green lines, it's it's crazy the way they did that uh however many years ago, like as you were saying uh hundred years ago, yes. So it's it's very hard. Maybe that's the reason it's never nothing been done with it, because it is very tricks your mind or what have you. It's very confusing and very probably very hard to do that. But I just wanna

build a file homestead exemption on all my property. I was hoping with my brother um part of it 'cause he owns more property up this way, but because him and his wife's name is on some of it, we had to actually stop where we stopped at.

Kathryn Starkey

So that piece along the bottom, the wider one, is that supposed to be a road? That is a

Ron OakleyChair

road,

Kathryn Starkey

yes.

Ron OakleyChair

And it will never be a road because you got Yeah. There's a house down there building it. There's a lot of stuff in that. Yeah,

Unidentified speakerVoice C

there's there were there were two more houses there from um some older generations. that have passed and and one of the places my mother bought and the house came down and then there was another house beside my brother's house here on the corner. He lives there, him and his wife, and there was a house beside them that they um actually tore down whenever they purchased all that property. So It's it's just a mess.

Ron OakleyChair

I assume this will not be uh the last time we actually see this in our redevelopment of the Lakchi area. Yeah. I think this will come before us more and more. Okay that we'll find things that don't like this. Yeah. So

Unidentified speakerVoice D

you need public you need to have public
