    Liam Devine, Planning and Development, Adendum Item PC eight. Um PDD 21-7516 in the name of Kitty Campus University Inc. It is a zoning amendment from AR1, Agricultural Residential District, to PO1 Professional Office District. The subject site is located in the southwest corner of the intersection of State Road 54 and Meadowbrook Drive.

    The subject site is currently undeveloped and contains approximately 1.67 acres. The owner/slash applicant proposed to develop the site in conformance with the PO1 professional office district standards for development. On April 20th, 2021, the Board of County Commissioners denied a comprehensive plan amendment from Res 3, residential three dwelling units per acre, to commercial for the subject site. A companion rezoning application to C two General Commercial District had been filed.

    On April 22nd, 2021, and May 18th, 2021, the Planning Commission and Board of County Commissioners continued the rezoning to a date uncertain.

    On june seventh, twenty twenty one, the application the applicant amended the rezoning application from C two General Commercial commercial district to PO one professional office district. The subject site was reviewed by Long Range Planning Division and found to meet the location criteria for comprehensive plan policy flu 1.6.5, which provides criteria to permit the location of office development within residential flues. This is a look at the surrounding

    zoning. To the north is AR-1 and an MPUD, Sapphire Hills M Pud. To the east, south and west is AR-1. You'll also note on that one that there is already existing PO1 zoning to the west.

    And then next slide. And then this is a look at the future land use. To the north is Res 3 and EC, and to the east, south, and west is Res 3.

    This is a look from the access. As stated before, there's an MPUD, Zephyr Village MPUD, that is to the northeast of it. There's already professional offices located Caddy Corner to the subject site. And this is coming with a recommendation of approval.

    Good afternoon again. Good to see you all. So you'll recall that we brought this matter to you all sitting as the LPA for a comp plan change a few months back. Um after we left the planning commission with a recommendation of approval of the of a commercial land use for ultimately what the application was for a C two zoning we went to the Board of County Commissioners. A lot of opposition to commercial um development and specifically C two. um that the client was seeking

    at that time. In reaction to the board not wanting to ha see commercial uses at that location. We have amended our application for office. We heard over and over and over in both public hearing that office would be compatible, commercial would not. I think there was a recognition that this property is with is on State Road fifty four at a inters signalized intersection and that it was not appropriate for residential use. And so we took

    the rezoning, we went for we applied, excuse me, for the least intense rezoning district. We didn't go for PO two, we went for PO one. As you would call the neighbor said, What's nice about office is It's occupied during the day. It's not occupied at night, generally speaking, or on the weekends. So we have um followed the direction um and and brought came in with PO1. It's actually the best result. If my client doesn't

    isn't able to move forward, you'll have somebody else in here wanting to do C1, PO2, and at least this brings to closure the use and office use at this location. Because it's not going to be residential. And it's also consistent with the office use that was approved by the board to the west a couple lots down. Uh we have our team here and uh if there's any specific questions, but let's hear what the neighbors have to say. Okay. Thank you.

    Hello, my name is Jennifer Robertson. I reside at one seven two four five Riverstone Drive. Lutz, Florida, three three, five, five, eight. Um I don't object to it only because I know something will go there. Um, I do wanna point out that The second lot is well within our neighborhood. So I do want to recommend that um We have an input on

    the design of what goes in there and the um landscaping. There is a ditch that abuts that property. We've talked over and over and over about the um flooding from that. And the uh The last storm just shows that there is a problem. I realize that that problem is coming from Um Ballantry. They do need to reconfigure the boxes

    and slow down the water. Because it's not safe. If someone's walking from like leaving our neighborhood to Go to the sidewalk or whatever. they will get washed off the road if if we're within that s you know, floodwater situation. because the current is hard enough to push a small car. So um I don't know what anyone can do to um try and

    slow down that prop the water that's coming from Ballantre. 'Cause it is definitely coming from Ballantry. Um I know it's not his problem. but also the water coming from State Road 54 will come down the side of his property. So he's gonna need to mitigate that water to where it slows it down. Um maybe he can get the um DOT or whatever to try and contain their own water, which

    is the proper way to do it. Um But there is a neighbor um in the cul-de-sac uh that you see kind of coming up the side of his property. that his garage was flooded. So we do need to make sure that the water is mitigated on his property and we do want something that looks nice for our neighborhood since it's within our neighborhood.

    Okay. As you heard, the subject property is two separate lots. Both the lots are within Meadowbrook Estates. There's a northern lot at State Road 54 and a southern lot which is surrounded by agricultural residential properties with single family homes. I conditionally object to the proposed rezoning because the applicant includes the southern lot in their request for rezoning. Commercial use at the Southern Lot is an intrusion into

    the existing AR community. A county policy prohibits this condition. I refer to policy one point six point four that states Quote, New Neighborhood commercial uses shall not be located internally within existing family neighborhoods. The county includes offices in the definition of commercial use in the Comp Plan, and the southern lot is definitely internal to our neighborhood. Also, I'm concerned that commercial development on the southern

    lot will set a precedent to develop any lots in Meadowbrook estates that has the same offset from State Route 54. And regarding that precedent You don't need to look any further than the County's own pre application comments dated July first. where the county attempts to justify this rezoning by improperly citing an outdated, temporary and terminated special exemption that once applied to a space inside a neighboring home, as

    if that special exemption is comparable to this land rezoning. Also, commercial developer approached my neighbor, whose home is located two lots from State Road 54. Developers appear to be expecting rezoning deep into our neighborhood. And we're requesting that you honor this 1970s era community going forward. The county and developers have plenty of other land for commercial development, much larger than what we've done. point six acres that

    aren't among homes. Now I said earlier my objection is conditional. I might change my opinion if the southern lot is removed from the request or or rezoning or the developer voluntarily restricts the development as follows. Limit the layout so building structures are on the northern portion of the combined lots and use the southern portion for stormwater controls like a retention pond or detention pond. The architecture of a building Meshes with the residential community. There are more robust

    setbacks and buffers compared with the minimum setback and buffers allowed for the requested zoning. No special exemption for a daycare, and there is a ban on tenants that generate pollutants. And most importantly, we seek a mandate from the county that the landowner developer must coordinate development with a coalition of Meadowbrook Estates owners. Yeah. So the county and the developer and the homeowners can have assurances that every step of the development isn't combative. Thank you for your time. I appreciate it.

Policy flu 165 is office. And so this would this would Uh a rezoning to the to the professional office zoning district would um follow the office policies of the comprehensive plan. Um Uh one thing to note that I'm not sure

    it has been noted previously is that the special exception that was approved Uh back in two thousand I forget the date. Two thousand eleven. Um

    Is it is an important consideration when you're when when I'm thinking about the the intrusion question, because in order to find the special except exception Uh in order to approve a special exception, you have to find it consistent with the comprehensive plan. The extent of this property is directly across the street to the extent where the previous special exception was approved. So it it's already been found in the past at least that there is uh a consistency with the comprehensive plan

    to have such a use. come into uh the neighborhood up to the uh The creek there.

    On this item, PDD 217516, this is for Kitty Campus University Inc., it's for a change in zoning from AR1 to a P01. If you would move to the next slide, please. The parcel is located on the southwest corner of the intersection of State Route 54 and Meadowbrook Drive.

    And um the property is is 1.67 acres. They propose to develop the um property with PO1 district. standards for development. If this looks familiar, it's because this item came to the board with a comp plan amendment to COM, which was denied on April 20th, 2021. Um and a companion rezoning had been filed at that time for C two General Commercial District. If you would move on to the next one.

    On April 22nd, 2021, and May 18th, the Planning Commission and the Board of County Commissioners had continued the rezoning to a date uncertain. And on June 7th, the applicant amended the application from C2 to P01. So this is a request for P01. It was reviewed by the Long Range Planning Division and it was found to meet the locational criteria in the Comprehensive Plan, Future Land Use 1.6.5, which provides criteria to permit the location of office development within a residential future land use. This location is a Res 3

    future land use. Also, I do want to mention that just today, this is was not presented to the Planning Commission, but just the today the applicant has submitted that they voluntarily agreed a voluntarily agreed upon deed restriction, which I'm going to ask the board to please receive and move to receive and file. that it they agreed to limit the building height to a maximum of two stories. So as you know this area is located in an urban service area and without this particular deed restriction

    they would be able to have a no building, there's no building height. So um I do want that to be re received and filed, the uh the proposed deed restriction. The re deed restriction reads as follows. The following restriction is hereby imposed on the property for the benefit of the county unless otherwise approved by the county in connection with any subsequent rezoning of the property. Building height, two stories maximum. So would you please receive and file that deed restriction?

Um if you look uh Caddy Corner across the street where you see the MPUD and you kind of look see like building shapes, uh that is the the Suncoast Meadows MPUD and that specific area was approved by the Board of County Commissioners in 2002 for professional office use specifically for PO2, which is a step up from PO1, which is what these the

    current applicant is requesting. Additionally, if you look at three doors down to the west where you can see kind of the PO1, the Board of County Commissioners in 2018 approved a rezoning from AR1 to PO1 for that specific parcel as well. If you move on to the following slide, please. So the existing future land use as you can see is thro Res 3, which is also the future land use for the parcel that I explained to you in Sun Coast in Suncoast Meadows.

    And the parcel that's uh two doors or three doors to the west uh that received a similar zoning classification or designation rather than this one. Would you move on to the next parcel? I mean the next slide. It just shows the aerial of the property and the access. And the next slide, please. And this comes to you with a recommendation of approval from the Planning and Development Department and the Planning Commission, with the exception of course just to make it very clear that the Planning Commission did

    not see uh the uh the proposed um deed restriction. And I'm here for any questions you may have.

    Glad to be back here presenting this rezoning to you with staff with their recommendation of approval and planning commissions, unanimous recommendation of approval. We heard the board's concerns, we heard the neighbors' concerns, and we amended our application to P O one. It's the lowest intensity non-residential use in your code. We also left the comp plan at res three and that also is significant because that limits the maximum floor area ratio, limits the intensity on this parcel. If we would have

    changed it to com for an office use. The flora ratio is Double. of of what it is as a res three. So we very Strategically and purposely Limited the intensity both through the comp plan and through the zoning district we chose to amend our application to to have the least amount of of um density. Um excuse me, intensity. As you know, this parcel is at the corner of a major arterial road intersection, light lit intersection.

    It's not gonna be non-residential. I mean excuse me, it's not gonna be residential. So this is the this is the solution um next slide.

    I did want to show you how this fits very well. The purpose of P O One says P O one office district is i is designed to be compatible with residentially developed districts and enhanced land use development along county major highways and roads. I couldn't have written that to fit this situation. um any better. Uh so I wanted to show that to you in your zoning code. Next slide.

    These are the permitted uses in PO one. They're all office uses. The difference between PO one and PO two, PO two allows retail type. It allows a hair salon, nail salon, massage, personal services are allowed in PO two. And so we didn't want to bring forward anything that had anything commercial or retail oriented. Um So we we are are coming forward with the P O one. Next slide.

    These are the setbacks. Again, your code already sets up what the appropriate setbacks are from residential, your code, and these are what they are. We will meet those at a minimum. Next slide. These are your required landscape buffers. We will meet them at a minimum. I would point out on the south side, um not only do we have the requirement for a type ten foot buffer, um as well as a setback requirement, but there's also 30 feet there. You have a county parcel that intervenes that's 30 feet wide. So there'll be quite

    a distance on the south side. I did want to explain to you the deed restriction. listen very carefully at Planning Commission, listened to the concerns, looked at the P O one district and what um your zoning minister explained, Denise explained, is that in the P O one district height In the urban service area there is no height. So I could see the residents' concern. So we continue to work with Ms. Honeywell and her group throughout this process. My clients worked

    closely with them and my client agreed with her to do the two no more than two stories. And so we brought forth a deed restriction to reflect that agreement that they reached on that. Next slide.

    This aga this is the south side. Um this is an area where you could You'll see that This how it's how it looks. This is a thirty foot parcel for your creek and then our parcels to the north. The distance between our parcel and the home there to the south is over a hundred feet, about a hundred feet. Um next slide.

    Next slide. So this is the professional center to the north. east that Denise told you about. I drove by it the other day. I was um in the area, kind of just driving around looking at uh looking at some of the projects that have gone in. And this is how your code applies with PO PO two actually here in relative to um relative to houses and how they do coexist. Um Next slide. This

    is another example. Next slide. You can see this is the the Trinity Oaks Professional Center over in Trinity. We've got professional office on one side and you have homes on the other side. They exist very nicely together, they complement each other. I actually lived in this neighborhood for a while when I was in between in between uh houses. And uh the setbacks are much uh smaller um for the homes here. The homes are much closer to the road than the homes in Meadowbrook. So I think you'll have it'll

    be a nice fit for the P O one. Next slide. Just another ex picture of how that looks in Trinity and then the next slide. all the same, the area, um, and you can see they those uses complement each other very nice. One of the the last meetings Um there was a Pregnant person that was here and she and her husband went out there and measured the ditch and it was eighteen feet across. I think there's the county

    has I wanna say thirty feet. Yeah, thirty feet. So, you know I just want to make sure that The picture they have is dry. Right now it's very, very full. Um the problem is That ditch runs along um And on the next street over, which I think there's some people opposing online. Um the water runs through

    and the county I've tried to talk with before about Clearing the way so that the the water will flow. Um, it backs up and it's covered our road just recently. Um and it's because there's a cattle gate on Brookside Drive. the they'll clean all the way up to the cattle gate and then it it goes from eight feet to two feet. And that's there's a water flow problem. So I do want that

    entered in there. Um I know Paul has talked about and I know that they have to keep their own water on their own property, so Um I know it's not his problem, but I do want to point it out. Okay,

You guys are doing a phenomenal job. There's an I know there's a lot of thought that goes into the planning and development of what's going on in this county and i it's amazing. It's

    notable. It's it's even national news. So it's wonderful. Thank you for that. So I guess What I'm observing is in the new development, the residential neighborhoods. The the entrances are are big, they're expansive, the the developments, the residences are set back off the road. The commercial development in the on the road in front is well thought, thought about and and executed. It's amazing. That's

    today. What I'm I'm trying to get my arms wrapped around is the idea that we are trying to change something in front of a neighborhood that was established in the late seventies. So Back then, when the Dais was different with you know other people who were probably putting as much thought and effort into the development of the county at that point in time, they approved Meadowbrook Estates

    for what it is today, and it didn't include the way things are today. So I'm not opposed to change. I'm just I'm just saying that. Just because something can change, it doesn't mean that it should. So if you look at the entrance to Meadowbrook, it doesn't look anything like what's being established new today with these wonderful commercial establishments in front of them. That's great. But I'm worried I'm a little worried about the safety pulling on and off a skinny long parcel that

    we're trying in, I'll use my words. Cuarn.

    commercial property onto that could number one I we've you've heard it before the aquifer issue is one thing the flooding the storm drains is another um the the noise that it would cause in the neighborhood. I guess what I'm asking here is that again I'm not opposed to change. I'm just asking for your thoughtful appreciation

    neighborhood fifty years ago. and not try and make it into something it was never meant to be. Um I'm I'm asking for your thoughtful consideration in whatever you guys decide so that it doesn't negatively impact the residents of Meadowbrook, especially the ones that are going to adjoin whatever future development happens on fifty four our our property values, our you know the stormwater. the the safety of the the traffic on that

    I object to resolution with 2K transfer floods for office development. My objections are based on a pass-control policy that prohibits office development and intriguing to make residential neighborhood. An office complex was established by flooding and surrounding property industry. Also, this information the applicant and John staff provided to support the policy during the previous hearing. Next slide. And then the focus date has one up as complex the two parcels, one presumably. Consultant

    who's kind of a medical president suggesting an office building instead of a gas station. That's one voice. So it's misleading when the applicant claims all medical come over to me. The applicant in the county show the puppy is one lot. That's off. There are two separate lots, which is important because they don't qualify for rezoning that's office under fleet policy 1.615, especially the SNAP lot. Next slide. The applicant of County Wyoming property three lots west to justify the zone low Q campus lots. That's in

    Mountain. The upper lot is Mount 1,000 feet plus a G campus one for next to a commercial lot, a storage warehouse, which has several lot west of G campus out. So two lots don't match those conditions because they're surrounded by a hay bar off. An office would definitely be an intrusion into your line. the Metro community. Next slide. Intrusion on the left slide would look like this slide to justify reserving the key campus lots because the county is usable tributary as a boundary for development. Next slide. By the way, the

    tributary flows to protect the wetland and that's why it's our neighborhood recovered by the learning water development at its bank. Next slide regarding that storage complex. The county development originally assured us that we developed a two-story class A office building with Metaphyding or UK and activity. Thus I have doubts that the key campus rezoning will result in construction element office complex because of the big and switch tactics afforded to developers. Next slide.

    House and office. The property was not rezoning, and yet the applicant can continue to use that expired retention as they fought present with the rezoning. Next slide. Applicant claims that the chain campus lots are not suitable for agriculture. That's in the because the south lot is surrounded by AR with land single family house. Someone can build a nice family home there. Other properties and then built the states along that same phone. Distance from State Boat 54 or Auth. Kitty Campus may label find AM property

Um I the um engineer is here um from Beacon Civil actually Jarriss he's a planner but he's representing the engineering firm and he will talk to and work with any of the residents. I've seen him do it many, many times so as he goes through with his firm to design the project the I encourage the neighbors to reach out to Beacon Silvil and talk about, you know, the different things that they've seen out there regarding flooding. We can we

    can't make the flooding worse. There's plenty of regulations on the books regarding flooding. But what is important is for neighbors to talk to neighbors. And so I I uh put that out there that um the civil on the project is is willing to do that. The second thing is the comp plan you heard. There's a specific long range consistency review report in your record prepared by the long range planning department. I know Mr. Pitos spoke at Planning Commission too, so if you had any questions about comp plan It's already covered. Um I won't belabor that, but I know Mr.

    Pitos can speak to it as well. And the third thing is there won't be any bait and switch. Unlike an MPUD that sometimes you can't see what's in it, can't see what's on the face of the zoning map, this is P01. It's a it's a Euclidean zoning district. It's got a it's gonna have a recorded deed restriction, can't be more than two stories, and that's what it's gonna be. And any change to that comes back through a public hearing process that would go back through the same process we've been through. Thank you.

    Good afternoon, Brian Tippin, Playing and Development. We don't have our stormwater people in the room, but generally the requirement is that the post-development rate of discharge off of the site cannot be any worse than the discharge off of the site prior to development. Whether they are able to further restrict that flow. There are some downstream things. There's water is very tricky. It's one of those things where you don't want to cut off water supply to other folks downstream that previously had water

    supply. So there's a balance that they keep. We review that very carefully during the process and we make sure that there's not going to be adverse effects.

Um but I can tell you that we will go through SWIFT mode requirements, FDEP requirements, and Pasco County requirements, and Pasco County requirements are generally a little bit above and beyond that of Swift MUD. And also if we impact any of the floodplain, we'll have additional floodplain compensation. So there will be both in the designs that we have put forth so far, we would have storm tech

    design as well as some detention that's above grade.

    Okay. We had a situation um A few years ago when a Hampton came in along US nineteen and there was a Florida dental place beside it. And we structured an agreement to where instead of building eight one pond here and another pond right beside it. They thought in work with Swiftman on it that they combined both together and it created a better capacity for flow. So instead of just having that narrow ditch running down through and not not to be narrow but fourteen,

    eighteen feet wide, but it could be larger uh Incre increate, I think, even more still mark capacity. Um is that something you guys would be willing

Um I would I would say we would be willing to to look at doing whatever we can to help out the situation there, but the ultimate requirements of that would would fall on my client to answer that specific question of whether or not we would do above and beyond improvements outside of our limits of our property.     Hey Mr. Chairman Mariano and and I appreciate everybody that spoke today and and uh as we saw this the the public hearing uh the last public hearing when there was there was a um different application that that that came through there were quite a few Not not quite a few, very many residents obviously that and we appreciate that that showed up um and that was at the um apologize let me get a little closer here at the New Port Richey uh location and and we did listen, you know, and I and uh have had conversations with quite a few folks

    over the last uh few months. So I do appreciate the applicant and um his team working together with quite a f if I'm not correct quite a few residents there to come to a you know a a happy median. You know I would say that you know you look at office and and what impact this will have.

    There's not a whole lot they can do now um at at this location. So the the traffic really will be minimal under under this classification. Um We're not looking at like the heavy commercial. I know we didn't know what was gonna happen last time, but the rumors abound or that it might have been a filming station of or a convenience store of some type. Obviously we know that would have had a a dramatic impact on the on the community, especially with the ingress egress

    being um on that Meadow Book Drive. Um but you know, when you think about office You know, if this was gonna be, you know, in the middle of the neighborhood There's no way I would let this I would let it fly 'cause that's not the right fit. And that was talked about earlier, right? It's on the front, it's on fifty four, very small impact. But working with the residents and and the majority of the people I've spoken with are fine with this and and uh I I and I'm fine with it. So So I I'll make a motion for approval.

I know it took the opposition of the residents to make that happen, but uh I'm glad the compromise was done with the residents as well. Uh I will say after the hearing I did talk to the county attorney about doing this exact type of thing, uh but it's glad to see that you made it happen working with the residents to make it happen because I think something has to go here. This is the least of intrusive that can go in that does make sense. So it's it's a great resolution I think.
