Okay, now we're on to um sixty sixty
Unidentified speakerVoice Aone.
Kathryn StarkeyChairSixty one.
Unidentified speakerVoice AUm on sixty one Ms. Wilhite had offered up a condition. Um I didn't get the parameters of it. Do do you want Do you wanna delegate to the county attorney to come up with a condition or Do you want Barbara to put it on the record? Uh Um There is a We do need to make it clear that this is a this is the applicant offering this up
because of language in 163 that says you can't have payment before building permit. But I think If the applicant realizes the conditions in the area and they're offering it up as a voluntary commitment.
Barbara WilhiteSo yes, on behalf of the applicant, I will put that on the record that this is a voluntary commitment to be part of a solution. I'll just we'll work on the language, but the what it is is it's half the payment of mobility fees at the time of site development permit issuance and half of paym half of the mobility fees at the time of the CO for the seventh. built seventh unit, because we've got our one, our first six being the model center. So it's the seventh CO, which will be our second
building, that will pay the other half.
Unidentified speakerVoice BAnd
Barbara Wilhitewe'll work on the language.
Unidentified speakerVoice BClarity. If our fees go up after you made the first payment, are you committing to pay the difference?
Because we're in the middle of a mobility fee update. So it's possible that the fees could increase from the time you made the half payment to the time they're actually due at CO.
Barbara WilhiteThat's a good question.
Unidentified speakerVoice BWell I'm asking. I guess
Barbara WilhiteI wanna know what the commitment is.
Yeah, I mean I I'm not sure uh that's I think When we make the payments that's the feeble. We'll pay. Um
Unidentified speakerVoice BWell I'm only ra raising it because arguably we may get less money if we if you're not committing.
Barbara WilhiteOkay. Well maybe we could figure out some language to address that so that we it's fair to us and fair to you and I It's hard for me just to do that right on the fly. We'll work on the language on that. Commissioner Oakley.
Ron OakleyYeah, I was just wondering if we could put that in the in the motion for approval that that be worked out between the county attorney or is that allowed or And that's
Unidentified speakerVoice Along as as long as there is enough specifics on the record, we can we can craft a condition that has been represented to the board if the board is comfortable with that, yes. That's what I'm asking.
Barbara WilhiteAnd I can put on the record that I don't intend to write this condition so that you that you lose money. So we we can David and I can put our brains together and figure out how to write that, but It's not our intent to do this to prepay and end up paying less. So thank you.
Jack MarianoVice ChairMadam Chairman
Barbara WilhiteMariano.
Jack MarianoVice ChairI'm going to make a motion for approval. And part of it is the comp plan is now done. So as I said, you're more restricted to the zoning, so I think now it's more appropriate for that. Uh kind of like with Saddlebrook, I voted against it because I didn't like land use change, but when the zoning was when that was changed, then it it changed. So I'm going to mo uh support the mo uh support The uh recommendation by the board, uh by the staff, and with the conditions Barbara just stated, and just with as we
look at this redesign that we do look at closer that turnpike or lane that can change and other improvements for the intersections. Right.
Ron OakleyI second that.
Kathryn StarkeyChairAnd uh uh under discussion, I I would not have supported this if it was res nine. I'm just saying that kinda to staff. But this is r like res five point something, six nine or something. So um six point six. I mean I mean it's five point six. What is it? Six point six. Oh, I think there might be a few.
Ron OakleyA lot of times it fits in a nine, but it won't necessarily be a nine and it might be seven.
Kathryn StarkeyChairNine would have been too much here.
Ron OakleyYeah.
Kathryn StarkeyChairUm Okay. So all in favor? Aye. Opposed? Okay. That one's done. I'm gonna check the number that's set in here because I'm for I wanna make sure we don't have an error.
All right, next one.
