Following item is PC3. That's PDD 217504. It's a zoning amendment in the name of Life Church MPUD Master Plan Unit Development for Victorious Life Assembly of God, Inc. It's a rezoning request from an AR Agricultural Residential District to an MPUD Master Plan Unit Development District to allow 122 single-family detached residential district.
acres and it comes to you with a recommendation of approval with conditions as included in your agenda packet.
All right. Thank you. Is the applicant present?
The applicant is virtually present.
Okay. Is there anyone here to object?
I
do. I have a concern. Okay, so you want to take it off consent, Peter? Please.
Okay.
Okay, removed from consent. Um following item is PC4, PDD 21, CU14. This is a land excavation, operating permit, and conditional use request for Citex NR Holdings LLC. It's for an operating permit and conditional use for for land excavation in a master plan unit development district located in west central Pasco County on the east side of River Glen Boulevard, approximately 3,800 feet north of the intersection of State Road 54 and River Glen Boulevard. Contains approximately 19.6
acres. This comes to you with a recommendation of approval with conditions as included in your agenda packet.
All right. Is the applicant present?
Anyone here to object?
We don't have anyone here to object to that item.
Any comments from the days? If
not? I do. I have a question. Okay. Um and I I don't have an objection, but Richard was looking and didn't see where we were on the notification list. even though it runs right behind our school site. So I was just curious what the um And maybe we just He uh he looked at the list he thought of who was notified and he didn't see us on there, so I was just curious what the rules were for notification on that.
Yeah, so not that
we're necessarily opposed to it, we're just curious as to that.
Yeah, so certainly the rules for notification, if it's within um a res one or lower, so res one AG AGR land use classification, the notice requirements is a thousand feet from the project boundary. If it's res three or higher, so res three, res six, res nine, res twelve, twenty-four, com, so on and so forth, um, then that notification is five hundred feet. So if you're within any of those boundaries, certainly you should have been. Yeah. So
Um that of where they're digging, but they're we're certainly like adjacent to their hall road.
I see. Okay. We will um the engineer is on online and we will certainly check front with him why the school board was not notified on that item.
And so our only Yeah. So our only caution would be, you know, obviously that's a Not that they're infringing on our site, but it's going right by our site, so We're just
adjacent to the hall route but not adjacent to the actual lot. Yes. The parcel.
Yes.
Okay. Okay. We will we will certainly check that for you when you get past it.
Do you want to leave on consent or do you wanna I'm fine with it being on consent. You are? Yep. Okay.
Okay, let's see.
Is that the last consent?
That's the last item on your on your consent.
I'm sorry. Richard just texted me. I guess he did find it. We were notified. Okay, thank you so much. So anyway.
Thank you. I appreciate it.
He he kept looking. So thank you.
Yeah, sometimes all those addresses when you start looking at them you just lose. Yeah. I understand.
Okay. Um So uh I think we have one item m removed from consent. Remaining on consent was uh Uh PC four or P C five. Is that right? P C four. P C four and five.
P C four remains uh remains on consent. PC three was removed from consent.
Oh okay. Yeah, PC four's it. PC four is not PC five's not, yeah, okay. So um so do I have a motion?
So moved. Chris Poole? Jamie Jurardy second.
So we have a motion to re approve uh to approve consent as modified. Um Any further discussion on the motion? If not, all in favor of the motion signify by saying aye.
Aye. Aye.
Opposed? Okay. Motion carried.
So it it is at the pleasure of the Planning Commission. Um to go back to PC three if you'd like, or uh we could discuss PC six, which as I sent to the Planning Commission, it is a continuance to a date uncertain. We do have I d it because it was not It was not published that way. Um we do have uh objections to be read into record. We probably do also have some folks at the kiosk. So as you'd
like, we can go to to PC three and answer Mr. Hansel's questions.
Yeah. Um let's do that. Let's go to PC three for the right-of-way.
Okay, so on PC three we've got uh I believe that's Tammy Snyder's item. So I can pull up the PowerPoint if you give me a minute. Okay. And we'll get that Ready for you.
Let me share please. Can you give me the opportunity to share?
All right. Thank you, Denise. Good afternoon, Planning Commission members. This is Tammy Snyder, Planning and Development Department. And I present to you today the Life Church MPUD, PDD 217504. Next slide, please. Here's a location map. You can see it's a budding Old Pasco Road and just south of Overpass Road. Next slide.
Uh it's not showing up on my screen, is it supposed to be showing up over here?
Okay.
It's it will do that. Oh for this winter, okay. I apologize for that.
It's just as I see that's all it does. They did it for
the board meeting yesterday too, so
Yeah, keep banging yourself on that forget. Uh here we go.
There we go. Okay. Just give all time to come downhill here.
Okay, uh Tammy, could we start over?
Sure.
Thank you.
Can you reverse the slides for me, please?
There you go. All right, Tammy Snyder, Planning and Development. Um Life Church M PUD PDD twenty-one seven five zero four. Next slide.
Here is the location map. It is directly abutting on the east side of Oval. Pasco Road and it's just south of Overpass Road. Next slide. Proposed is a rezoning request from an AR Agricultural Residential Zoning District to an MPD Master Plant Unit Development District to allow 122 single-family detached residential units on approximately 41.8 acres. Next slide. Also requested
are variations from the Land Development Code, including neighborhood park landscaping, neighborhood park acreage. Um they would like to pay into the sidewalk fund in lieu of construction of the sidewalk. And they would like to request an allowance of an additional 10-foot lane at the entrance for an emergency access. Next slide, please. Here's their master plan. showing their um their access point, um the right-of-way that they're dedicating, and some additional right-of-way
that they will be dedicating as well for the widening of Old Casco Road. Next slide please.
The subparcel does currently reflect its original zoning of AR, agricultural residential. It contains approximately forty one point eight acres of vacant and unimproved land. And as you know, the LDC specifies that variations from the code may be reviewed and approved by the PC and BCC during the hearings on any application for an NPUD zoning amendment. variations shall be allowed where the BCC specifically finds in the particular case that the proposed variations meet or
exceed the intent of the code. The Planning and Development Department has reviewed the requested variations and found that they exceed the intent of the LDC. And this proposed request is consistent with the Pasco County Land Development Code and with the applicable provisions of the Pasco County Comprehensive Plan.
And with that, PDD recommends approval to the BCC with the conditions.
All right. Are there any questions? Yeah, I have some concerns.
In the document it states that you're gonna give up some
L uh let's see, the park. You're reducing the size of their park. They're gonna have a park within this community. You're reducing the size. Uh, based on the fact that uh uh you allege that the neighborhood park, which is in Wesley Chapel, I'm sorry. the neighborhood park is in this development. B Larger park which is La which you state uh indicates that you are therefore allowing this park to be reduced in size because of the Wesley Chapel park. But uh I
have a hard time understanding that due to the distance and the difficulty in getting to that Wesley Chapel Park, especially in light of the fact that Overpass Road is now gonna be a connector with I seventy five. Uh so I don't see as that having a a valid excuse to reduce the size of the park, even though it's probably about less than a half an acre. Um The other option the other objection I have is the location of the park. You're in here it states that you're gonna have the landscaping around
instead of around the perimeter of the park, you're gonna put it within s within the s hide the park, which reduces the park size down even further. and based on the fact that you're having what, a hundred and twenty two homes in there I would indicate that there would be at least two hundred children in this community. So I think the park is very important. I think the size should remain the same. The other option the other concern I have is the location of the park. Um You have a pond right behind that. uh part. Uh I
read through this document, I didn't see where there's gonna be any other than b the buffering, which I assume would be plant material between the pond and the park. I didn't see anything about a fence uh being installed. And I think this size park, which I would refer to as a kitty park, you would assume that there would be some type of barrier between the park And the pond. Especially in light of the fact that this w could be a what I refer to as a kiddie park. Uh
So I have a concern about those two areas and um I think they're valid concerns, especially the size of the park being reduced down. I don't I don't think that's fair to the people that live there. And so I don't think the fact that you're gonna put the buffering on the inside of the parameter that's on the reverse side of the slope. So if you can clear those for me, I'd appreciate that. Thank you. All right, Dan.
Okay, sure. Actually, one of the main reasons for the reduction in the size of the park is actually because they are dedicating an extra 1.23 acres in addition to the Um
according to the preservor the preservation tables. Um Because of the widening of Old Pasco Road, it was determined that the county actually needed a little bit more space. So it Um negotiated that that this project go ahead and dedicate an additional almost one and a quarter acres to the county for Old Pasco Road.
Okay, but how does that how does that benefit the residents that are gonna live there?
Well it it is in close proximity to the district park. Um even if they can't necessarily walk to it. you know, down Old Pasco Road, they can certainly get to it. And it's a it's a Very large part.
I understand it's a large park. But I find it difficult to have adults or children walking Old Pasco Road, especially in the future, because it's gonna become a a four lane road eventually, and they have to use either Wesley Chapel Boulevard, going down further to the East. And to connect into all the park. park. You talked about Overpass Road. How how how to explain to me how Overpass Road,
which is being developed at the present time to be a connector to I seventy five. I don't see anyone be using uh Old Pasco Road. I'm sorry, or pass road.
In other words, what I'm saying to you is I see A hazardous For both children. parents or residents of this community to use the old park, uh I'm sorry, the Wesley Chapel Park. That's why I advocate for this park not to be reduced down and that the residents would benefit from a little larger park.
Would the Planning Commission like to hear from the applicant?
Yeah, as long as Peter's done asking questions of Tammy, so I'm done. Okay. Thank you, Tammy. We'll hear from the applicant and we'll get back to you.
We can try to unmute Justina Gale or um Alba Luca.
Hello, this is Justina Gale and Al Belluccia from Florida Design Consultants. And um in your concerns with the park. We are willing to um even though um it is being reduced, we are willing in the conditions of approval to add additional amenities. To the park. So that a lot of these parks sometimes they're just open uh we'll add ameniti we can amenitize the park and um that will
be a significant improvement And the landscaping is for shade to provide for shade trees and so forth in the park. It's not going to reduce the amount of park. You don't just want an open space area without any shade provided for the children to play in. And we are also will agree to put the But then if you have a con start with the score more con so that there will be no um No danger um associated
with the park at the stormwater pond. Hopefully this will clear all your concerns. Thank you.
Justina, um you know what, we should have started this way. Provide your name and address for the record and the clerk will swear you in. Sorry about that.
Lina Gale, [address removed].
And if you could raise your right hand for me. Do you swear or affirm the testimony you're about to give the truth so help you, God?
I do.
Thank you.
And the testimony you just gave.
I do.
Okay, so what I heard is that you're gonna go ahead and add amenities to the park itself, which is basically playground equipment, little rocking horses, that type of thing, which will take the space up that would be considered free space within the park. I guess if the trade-off if I can't get everything I want out of it, which is a larger park or the original size, according to the land development code. If you're willing to put that cyclone fence in there to make sure that uh no child can run towards the pond. And
make sure that it is secure. Uh At least I won half the battle. I still re maintain the fact that the park should be larger, but Yeah, rather than prelung this.
I still think I'm in the right. I don't think the I don't think using the Wesley Chapel Park as a trade off Considering that is not within a walking distance. I wish I would have taken the time to go ahead and figure out the distance between point A and point B via Road mileage. But uh
What what was the original size of the park, if I can ask? They have a What was the original size?
One point one point two two acres is what would be required by the code.
And what is it now? So
Point seven acres.
Okay, so it's a substantial reduction.
And I I I guess the only thing just to add or to clarify um again is Jamie Girardi, um You mentioned the dedication, the additional right away. However The applicant is getting impact fee credits for the dedication of the additional right-of-correct? I thought the approval memo indicated like two hundred eighty five thousand dollars of impact fee credits that they were kidding. to offset that additional right-of-way dedication. So it's not like it's they're giving that
up for nothing.
So Could I can I also ask a question on the timing of the proposed Chris Pool. Yeah. Sorry, Chris Poole. Um the timing of the proposed velvet in relation to the widening of old old Pasco.
The application or or Tammy, is there any clarification on that?
I'll let the applicant respond to that. Okay.
Hi,
this is Al Baluka, [address removed]. Can you all hear me?
Yeah.
Excuse me, sir, can I swear you in first? Yes. Okay. If you could raise your right hand. Do you swear or affirm the testimony you're about to give is a true so help you God?
Yes, I do. Thank you.
Thank you.
Okay. And we got his address, the name and address right. Yes. Okay. Very good. Go right ahead.
So we think that the timing of the two, the timing of the project and the timing of the widening are going to probably coincide at the same time. So uh there's gonna have to be some coordination between the two, uh especially regarding the turn lanes that are required for the project. And and I think one of the conditions addresses that. So there's gonna be close up uh coordination between project management. And and the the applicant.
Okay.
And if I can ask uh Chair Chairman Gray. Um How does the fact that the uh The park is a approximately a third smaller than it the r the original requirement.
How
does that impact you in terms of your lot numbers?
So it would impact the size of the pond is what it impacts. Uh so h how about if we uh possibly meet somewhere in the middle, we'll increase the ponds a bit. maybe half 0.2 acres, would that be a consideration? So then you'll have a 0.9 acre site, which is fairly substantial and there's a lot you can do within a 0.9 acre site.
Um Peter, you're the
I don't have a problem with that 'cause it at least it helps the community there. I think it gives them actually it helps you because you're gonna sell this property and parks play a large role. Uh also uh we talked about one pond with fencing. You have an additional pond over there. I'm sure you're gonna concur with my request to have a cyclone fence or some type of attractive barrier between uh the homes that are on that uh entrance, whereas a pond behind their home too, to
to ensure that there's safety and security of any small toddlers because I assume that your target is either going to be individuals who are retired or young families. So therefore I would suggest that and encourage that be done and that also be put in as a change order for this particular project. That's that's a fair that's a fair request.
Yes, if I if I could paraphrase what I think I heard as you're breaking up, uh some sort of fence, you know, protective barrier between the pond that's at the east end of the project and the rear of the locks. Is that correct?
Yeah, you have two ponds out there and I think you should put some type of security barrier between those ponds to prevent small children. Who may decide to take off and are attracted to the water. So that's a s safety issue as far as I'm concerned.
Right. D the fencing does not have to be uh opaque. It could be some sort of cause. It's a barrier to keep the fen to keep the kids out.
If I heard you correctly you said as long as it keeps children out.
Yes.
Right. And at the same time maybe keep the view for for some of those resonance.
Yes, I think it's it's correct. You can see through the fence but it's uh protects from children from going through.
Mr. Chairman Mariano I was gonna ask Mr uh answer Mr. Hansel's question about mileage so it's five point four miles to west of Chipel Park via fifty four. That's quite a quite a walk. So I mean it'd be a little closer I couldn't do it 'cause Overpass is not existent right now, but it'd be a little bit closer with Overpass, but
Yeah.
Okay.
Well
before let's get back to the fencing there. There are many projects that we do that don't have fencing between the ponds and the rear lots.
Well we're not talking about we're not talking about any other ones. We're talking about this one. So um Peter, if you wanna make a motion to include those items.
I'll make the motion that we app that this P D. twenty one seven five zero four be approved with the additional Uh size of the Playground. And additional Uh barrier between the playground and the pond. And I would approve that. So
the additional size you're talking about is a point two, right? Yeah, I don't have of an acre. Correct. And we're talking about a uh Uh oh. uh barrier that can be seen through but not Traveled through by children. Correct.
Just between the playground and the pond, right?
Yes sir.
And uh I believe they said they were gonna add an amenity package. Is that correct? That's correct. They said they would uh add that. Okay. So if we can incorporate that language in that In that motion, you're making a motion to approve it subject to those changes?
Yes, I'm making the motion uh subject to approval of of a re uh increase in the size of the park. A barrier between the park and the pond. and that the uh developer will increase several uh amenities to the playground itself. Yeah,
they're
f therefore. That's my motion.
Okay. So we have a motion. Do we have a second of that motion?
Jamie Girardi, I'll second.
Do we have any further discussion of the motion?
I've got one question, Mr. Chairman, if I could, just for my own clarification of staff. Um so there's an additional ten foot lane that's being added for emergency access, ingress, egress to this development. Is that Typical to allow that versus a second dedicated or not dedicated but second ingress egress point for emergency access, considering that. It's on Old Pasco Road, could get bottlenecks, traffic could be a a concern there.
It it is uh occasionally, yes, it is traditional to um allow something like that and it has been reviewed our Access management folks. But this project also does have a potential second emergency access to the south. If the roadway that's that's proposed to the staff of this project gets built, then they will connect to that roadway with another emergency access.
Okay. Thank you. Okay, and uh before we vote, uh were there e was there anybody else that was here to speak on the I've
been told that there's no one here to speak on that item and we have not received any emails of objection for it. Any two records.
All right, thank you. So we have a motion and we have a second. Any further discussion? If not, all in favor of the motion signified by saying aye.
Aye.
Opposed signify by saying nay. Okay, motion carries.
Mr Chairman, if we can um just so that we won't be swearing every single person in as they speak, and we do a one fail swoop um swearing in, I think that probably makes the most sense.
Can we gather everybody together out there and
Raise your right hand and Outside as well.
Yeah.
If everybody at the public kiosk could raise their right hand for me. Do you swear or affirm the testimony you are about to give is a truth to help you God?
All right.
All right, great.
Absolutely. Shall we move on to P five or do you want to go to P six where there is a a request on that one to continue to a date on certain
