Basil cell cancer litigation assessment meeting
What the county recorded
This item is not from the published agenda
It is a stretch of the recording that this archive identified as a separate matter — a call to order, a recess, or something taken up that the agenda does not list. There is no official title, no staff recommendation and no disposition, because the county never recorded one. Everything below is inferred.

Based on the briefings you've all had, um my recommendation continues to be that you uh have a litigation assessment meeting uh at your next meeting, um, so that you all can candidly talk about the issues that are involved in this particular case. Um And
Have that candid candid discussion uh which will be court reported um as all litigation assessment meetings are. But that it's not out in the public, especially if you're inclined on settling this at a later date.
Uh
Commission Mariano. Thank you, Madam Chair. And uh just meeting with the County Attorney got a little bit more information, which there's a lot of information that's out there. Um We when we meet in a private litigation meeting, it's all recorded, all the documents there, so everybody gets to read what we said after we said it. But the flexibility we get to talk with each other with the county attorney puts us in a position to have that dialogue. We're going to have that dialogue. Um And I would just want some clarification which I didn't know, which I just found out
in in the briefing as well. is uh basil Uh cancer is a non-invasive, it's on the skin. Uh they freeze it when they take it off. There's not a lot of danger to it. Um and that's what the question was as far as did the legislation mean to go that far? Uh Aflack and Chubb both denied Basal cancer as far as that the twenty five thousand dollar settlement. We are going to look at it. Um I I I'm going to recommend to make a motion that we do, as the County Cer
Attorney suggests, at our next BOC meeting, we allocate time to do a litigation assessment meeting so we can talk about it and then we can make a recommendation at the end of the litigation assessment like we always do to come forward. I will tell you this whole board uh has tremendous respect for you and appreciation for you, firefighters, paramedics. Uh we appreciate everything we we want you to to to serve our people as best you can and we're going to continue to do that. This is just one of those steps. I
get a better appreciation. I think the end result would be good and we're going to take a look at this thing all the way through. What we need to make sure is we're protecting the county in full way. Um you know we spent a lot of money giving you guys In working to get there, it's taken time through education from you guys to us that we need to make sure your uniforms are clean right away, that you've got a decamination zone number one, number two, to protect yourselves, to protect everybody in there. So we're not blind to it, but we gotta go do this meeting the way we've got to go do it. We're gonna do it at the next next meeting,
and I think you'll see a decision shortly thereafterward. And I mean the same day.
Thank you, Commissioner Smariana.
That'll be my motion that we're going to do. Continue uh continue uh make a motion to have a litigation assessment meeting at the next Board of County Commissioners meeting.
Can I I think it's already set for the next meeting, so I don't I don't know that you that we need a motion, is that correct?
No, I i if you give me direction to set up a litigation assessment meeting, which I had at the last last board meeting, I couldn't get outside council to this meeting, that's why it was scheduled for the twelfth, or the next the next regularly scheduled meeting. All I really need is direction of whether you want to have it at Noon over the over the lunch break or before or at the conclusion of your business that day, so that I can get the
counsel there and a court reporter there. Um
Okay, raise your hand if noon is good.
That way you have more time to it's an hour.
Okay, it's noon.
Okay, okay. We want time.
Okay, we have a lot of public hearing, so I I do want to keep moving. Is that okay? Okay. All right. So we will continue. And I echo Commissioner Mariano's um sentiments. I think you see how much this uh county is investing in helping to keep you safe. And um but we never No matter what the topic is, discuss. Litigation. Here. It's just really, really bad Forum and we can't do that. Um we thank you
