County attorney conflict zoning conformance recommendation
What the county recorded
This item is not from the published agenda
It is a stretch of the recording that this archive identified as a separate matter — a call to order, a recess, or something taken up that the agenda does not list. There is no official title, no staff recommendation and no disposition, because the county never recorded one. Everything below is inferred.

What was said
Machine transcription of 3m of recording, with speaker names inferred from voice matching. 33% of 12 lines carry a name. It shows what was said, not what was decided, and both the words and the names can be wrong.
An update. Did we do Jeff? No. What do Jeff?
What's the order? Am I out am I out of order? A little. I thought we'll do Jeff first. I thought I do. Just do me later. Yes ma'am later. Okay, Jeff?
Um
I threw away my script. That's
okay, I'll help you. During the during the public hearing this afternoon, Ms. Will Hight re referenced um the issues with conflict zoning. And I tend to agree with her. In fact I di I agreed with her when I became county attorney. Um I'm not sure I agree with the proposed fix uh that she threw out today, which was That it needs to be done during the Comp plan updates. The the
issue is Is that um
In nineteen eighty nine, ninety, when the comprehensive plan was adopted and the future land use classifications were changed Um It created conflict zoning. In fact, most jurisdictions Addressed that conflict zoning in a one time county wide rezoning. shortly after they adopted their land or with their land development regulations. um administration
at the time um decided that they wished to proceed, or the board, I don't know which, um, they decided to proceed that they would identify the conflict zoning When the developer tried to or the homeowner or whoever the property owner Um adopt it uh wanted to do something with their property. Um so my recommendation at uh if if this is a if this
is a concern for the board is that we do conformance zoning um Like we should have done Um back in the early nineties. Um it I thought it was gonna be done when chapter five hundred was revised um A couple of years ago I realized the planning department is busy, but um at some point At some point we're gonna have to address um that issue
Um Because you have situations like occurred with Mr. Damsing today.
Yep. Anything else?
That's it.
