The subject site is located on the west side of McKendry Road, approximately two miles north of Overpass Road.
The subject site contains a single family dwelling on approximately 10.33 acres. The owner slash applicant proposed a private hockey school slash academy with an in-house shop for students. The shop will be for students to use to maintain gear and get snacks similar to a school bookstore. The surrounding area is characterized by residential and agricultural uses. The subject site has a future land use classification of AG, agricultural, 0.1
dwelling unit per acre under the comprehensive plan. This is a look at the surrounding zoning. All surrounding zoning to the adjacent properties are AC agricultural. This is a look at the future land use. All surrounding future land use is AG agricultural point one dwelling unit per acre. I would like to note that the subject site is located within the connected city boundary, within the business core zone.
And this is a look at the access to the site, accessed by McKendry Road. I would like to make a note that I would only recommend going to the site along McKendry Road using an SUV or a truck, not suitable for sedan cars. And this is coming with a recommendation of approval with conditions.

Hello? Ooh, that looks like it did something, yeah. Um I'm Dr. Jiu Jorvath. I own the property to the left of Russ, 9249 McKindry. We have an equine sanctuary there. We've been there about eight nine years, and we take care of the horses obviously, and we also do therapy for individuals that come out and we have a a therapist that will come and help the people with the horses. Um mostly it's taking care of the horses. Oh sure. Judith Horbaff.

Oh, sorry. Judith Warboss, H-O-R-V-A-T-H. And our address is there a site of Russ, 9249-McKindry Road. It's to the left of where the Russ is. Um so essentially the and Russ and his attorney have answered several of the questions. Our concern is obviously for the horses and the safety of the horses and people that visit them. We volunteers, it's an all-volunteer organization where 501. Yeah.

so I'm
I'm early. I apologize, but you're gonna have to slow down just a
bit and
speak a little louder. Okay.
So our concern is that we are worried about the safety of the horses because of the noise factor of the compressors and the chillers. uh we're hoping that and I've gotten verbal reassurance that those chillers will be somehow insulated or put on the other side, which would be wonderful. So I'd like that reassurance. The other thing is the roadway in front, as somebody mentioned earlier, it's all sort of rickety road from where you come from fifty
two down. So from that section two um our property, Russ's property, it's a washboard because of the w nature of the dirt road. So we think because of the amount of traffic that I believe the school will start um generating, if that could be paved or treated in a better way than it presently is, 'cause there'll be more traffic coming through. And the other item is um And I presume this will be taken care of. There's ammonia runoff
from ice from an ice rink. So we're hopeful that that will be taken care of appropriately because of the regulations of OSHA and EPA. Because again it could affect pastures, it could affect groundwater. So we're just looking for reassurances on that. And that was our concern.

quick questions and it's kinda just going through this. I know we we've heard a similar special exception use for a similar use, another private school. I think in this case it was a baseball school or something like that. And I know just going back through some of the questions that we had on that application, um, as far as I'm assuming it's gonna be even though it's a private school, it's gonna be open to the public. Is there parking considerations being done? Are there landscape buffers being proposed? Um, all that kind of stuff. I didn't see necessarily referenced on the site plan or in the memo, so Uh
similar questions. If you guys can address those.
It's actually the property is actually in the middle of um site plan approval as well, so the landscaping, the buffering, all that's being addressed through the site plan, but it's actually in process on site plan right now as well. It's actually being engineered. So yes, all that stuff is being addressed to comply with the code.
All right. So I noted a couple of questions that the lady before you had and uh what was what was your plan for the entry road? Do you have any plans?
So that right now it's gonna be a private school. We've only got it's gonna have maybe twenty people tops. Um so the trip count is under the hundred, but we've come to an agree with staff that we're going to pay, I think, our pro rat a share, which is thirty-two thousand eleven. little over thirty two thousand dollars. So we're gonna pay that pro rata which will go towards the coffers in terms of improving that road. If he were to come back and expand and start to trigger things, he's gonna obviously have to do some improvements to that road. So

the other question was about the ammonia runoff. Yes.

Uh 9175 McKindry Road is the property we're talking about. Um in regards to the ammonia, I just learned this myself because it was a very good question. Obviously that would trigger a lot of inspections as well as other permitting issues, but that applies to ice plants, not Ice rinks. The ice rink is literally just water put on the ground that gets shaved off. There's no ammonia used in what we do. And I just learned that myself, so 'cause I wanted to reassure Judy because the horses are important to me as well.

the uh and what about the chillers and the compressors and stuff?
Uh all the chillers are no located on the southeast corner of the uh property, which is the furthest point it can be away from the horses and the equine center. Uh additionally Uh the chillers we're using are brand new. Everything is being designed better and better depending on decibel level and everything else. And I actually have a phone call in to my um rink consultant trying to get those decibel uh levels for you, but I I don't think it's gonna be an issue for Judy or the horses.

Just going going back to my questions and and being a special exception, David, is are there no I mean, do we need to cover any of that other stuff on the site plane? Is all that handled through the development?
I mean only if you think that there's some impact that is not going to be addressed through the typical site plan approval process. Okay. So I mean so for example, noise is something that would not be dealt with through the typical site plan approval process and sometimes there's conditions that require them to meet certain decibel levels with regard to noise. Um so There are things that aren't addressed, but I I think as a general rule landscaping is addressed and I'll let Denise say if I'm wrong, but
landscaping is. Um drain drainages.
Yes, that's all addressed at the side plan level.
So if there's something that you think Yeah. Some impact that you don't think will be addressed through the cyclone approval process, yes you can make it a condition of approval.
Well, I guess and I know I didn't bring this up at first, but the property zoned A C, correct? That's correct. Setback requirement for A C is
twenty five on the side, fifty in the front, fifty in the rear.
Okay. And it looks like on their site plan they submitted their twenty-five foot setback from The right of way preservation easement. Is that not where you do the setback from? Do you do it from the property line?
The setback is from the property line.
Okay, so in the future. if that road is ever constructed They're gonna be twenty-five foot back. from from the future road. That's that's my only concern. I I think personally I think this is pretty close to the future road if that road's really gonna be constructed. And if the site I mean if if they're If they could build this at twenty five feet from that future right-of-way line, I think that's problematic personally.
If I may, which road are you talking about being constructed?

You're actually on what's submitted, it looks like you're sixty foot from the existing right-of-way, but there's a thirty five foot if I'm reading this correctly, there's a thirty-five foot perpetual right-of-easement being set aside.

So you're twenty-five feet behind the back of that perpetual right-of-way easement.
Okay. I just want to understand uh your question and make sure we're not talking about the vision road.

do you have a recommendation on that?
Um
So if you want a setback that's greater than what the land involvement code would require, yes that would be an appropriate condition to put under special accepted.
Well I mean how how likely is McKenzie Road to be built? I mean that the the perpetual the easement's being dedicated.
So I may be able to answer that question if none of our transportation people are here. Um I think the county's plans for in terms of long term improvements would be to build
Rather than widen McKindry Road. That's why there's a condition that says that they can, instead of paying their fair share towards McKindry, that they can donate the right-of-way from Boyette instead, because they think the county's long term goal is to build Boyette as a true county collector facility rather than make improvements to McKinley. I don't know if that answers your question. So it's probably less likely that the county would improve McKinley.

Okay, I'm glad you can hear me. Uh I just want to clarify because I heard Shelley Johnson say something different than what the states and the end's uh today's memo. We were writing the memo Saying that in lieu of the 32,700 fair share contribution from the 10 V road being substantial road, they will submit an alternative standard to offset it for
the right-of-way dedication that will be done for the future.
Like 'Cause She just mentioned that they will take their fit and move forward. So are we not about the right of way for future Indian road anymore and does that memo needs to be changed.
S and this is Shelley Johnson, 6400 Madison. Um what you said initially is exactly the agreement. It's it it's an either-or option. Thirty-two one seventy-two is the pro rata or you know, do the alternative standard and then you know, or do the vision road dedication. And then when they come back in if they do anything else, they're obviously gonna have to address a lot more stuff. So but

Right, that's what I meant. Uh the extension only takes out what turns into yes.

And the other question that was uh uh you know David being our uh Transportation planner also. uh we answered it correctly the machine remover will be uh improved because it is substandard and as development occurs along McHenry they will all be tagged for substandard roads then it would be improved as developed occurs over the term.

Mr Mr. Chairman Mariano. Yeah, I'm sorry. You know, back to David and Jamie's point. So I know the site plan shows the cooler looks like and the chillers and stuff on the opposite side from the sore bath. Do we need to make that a condition or is that

Well if your concern is noise
Well noise and and with the horse situation to
with noise I it's probably better just to impose our standard condition that re that sets the decibel limits. And Denise, you know what I'm talking about, the standard condition?

Okay. Sure. So basically um the uh the noise condition is the site will comply with the Pasco County With Pasco County noise regulations as follows. Noise emanating from the site shall not exceed the following sound level limits when measured from the property line of the noise source. 66 DBA between the hours of 7 a.m. and 6 PM, 60 DBA between the hours of 6 PM to 10 PM, and 55 DBA between the hours of 10 PM to 7 AM. That's the standard noise condition that we place.
I think that probably better addresses it because then regardless of where they put the coolers, I mean the equipment, they just can't exceed those decimal levels. That's fine.
