Liam Devine, Planning and Development. P6 PDD twenty one-seven five three two in the name of Palm River Dairy. It is a special exception for a solar electric power collection facility, solar farm, and substation in an AR Agricultural Residential District and an AC Agricultural District. The subject site is located on the south sorry, the subject site is located east of Paul S. Buckman Highway, south of Jerry Road, west of Saunders Road,
and north of County Line Road.
The subject site contains a dairy farm and single family dwellings on approximately five hundred and seventy-six point one nine nine acres. The owner slash applicant proposed a solar elec Sorry. Solar electric generation facility that will de Employ thin film photo photovoltaic panels that absorb sunlight and directly produce electricity. The project will encompass approximately 133 acres of the total site under solar panels spread out
over approximately 300 and 344 acres. With the remaining of with the remainder of the area grassed. Between the arrays and having a maximum generation capacity of 74.9 megawatts or less.
The surrounding area is characterized by residential and agricultural, commercial and industrial uses. The subject site has the future land use classification of Res1, Res Residential One Dwelling Unit per acre, and IL, Industrial Light under the Comprehensive Plan. A solar electric power collection facility, solar farm and substation under 75 MW in capacity is a minor public/slash semi-public facility that is in allowable use in all future land use classifications.
Um this is a illustration or diagram conceptual of what the conditions for the buffers would be. Um you'll note that there is a twenty five twenty foot wide buffer with two rows of stagger trees along the north, that is the purple pink area. Um and then there is a type A which is on the west and southeast side of the subject site.
This is the conceptual with the buffers and the arrays in place on the subject site.
Well the those little black squares are the arrays. Those little black squares are not the arrays. So I I believe and and the applicant can verify, um, that the gray area is where the arrays would be and the spacing in between. The black areas I believe are are not um being filled in. I believe it's filled grass area. But the applicant can verify for that.
This is a look at the surrounding zoning. To note to the south is Martin Moretti MPUD site, which is approved for Agorit Transfer Station and Asphalt Plant, as well across County Line Road is Mosaic Plant.
And this is a look at the future land use surrounding. To the north is res1, to the east is res1, to the south is res1 and pd, and to the west is res1, pd and il.
And this is a look um for access to the site.
And this is coming with a recommendation of approval with conditions.

Certainly. My name is Kristen Mora and I'm with Tampa Electric Company, 702 North Franklin in Tampa. At first I just want to apologize for everyone's time last time. Um and I want you to know that I personally called and spoke with Mr. Schultz and apologized to him personally. It was certainly not our intent to misuse anyone's time um on this commission, so I'll Just wanted to open with that. I do have a binder of materials that I would like to provide you if that is acceptable.

Aye. Aye. Could you explain what's in this binder please? Because it's pretty big. If you're expecting us to read all that now, it's unlikely. So what's in it?
I'm not expecting you to read it all now, most certainly. I did want to provide this information to you, some of which was actually provided in advance of the other hearing, but I wanted you to have it in paper format. So, some of the concerns that were raised by the Schultzes that were in opposition last time, one of them related to the safety of solar farms, and what is the safety of these? So actually, tab one of these binders goes over the safety of Solar farms and it includes a white paper from the North Carolina State Clean Energy Technology Center.
And they did a full research on all the safety aspects of solar farms. And there are two major conclusions. One is that actually the National Academies of Science in a congressional report determined that electronic fields and magnetic fields that would be associated with solar farms are not human health hazards. And the other aspect is that any EMF, so that's any any electronic device is going to have some electric magnetic field. So the electric magnetic field outside of a solar facility is actually one one
thousandth of the level at which you would even begin to test if there is any sort of interference problem or danger. So solar farms are actually extremely safe. There are people. and and there have been studies and reports that do conclude that these are not that these are very safe. And most of the electricity actually, so the solar panels themselves will be set back 50 feet from the property line. And then the inverters, which is where what collects all the electricity created by the solar panels, are all internal
to the site because that minimizes wiring. So you're actually any electricity that the site is generating is going to be extremely internal to the site, probably well over 150, 200 feet from any property boundaries. So wanted to address that. Oop. Better get moving. So I wanted to address that. And also a concern was raised about property value. Tab three of your binders is an MAI report on the fact that solar farms do not impact property values even in rural areas.
And that's a study of 77 solar farms throughout the United States of America, including over 30 in Florida. And then I am very briefly going to hand this over to Darren Stowe, who is a certified planner. I think some questions were raised last time about uh the buffer as well as the acreages, and so I wanted to make him available to address those points briefly. We're available for any questions.
Okay, you're Got around pretty short of time, so Because I don't think you asked for any extra time.
No, we did not. Uh my name is Darren Stowe, 1408 North West Shore Boulevard. I'm a certified planner with environmental consulting and technology. And very very quickly, uh we had indicated to you before that about 95 acres had been under uh uh under the solar panels. Uh it was actually that was a uh a preliminary uh layout that we had done and as Mr. As Liam had mentioned, it's about 133 acres of panels that are spread out over about close to three hundred and fifty acres. So that's the coverage of the of the panels.
And in between those, which they form to raise, is grassed land. And then the the the rest of the property, approximately two hundred acres, is wetlands and setbacks and the et cetera. And then the other uh issue I wanted to raise was the buffers. Uh we've worked with uh county staff. There are different buffers on different areas because you have industrial uses along the south, so there's reduced or no buffers there. On the southeast portion and the northern portion where there's residentials, there's a double row of staggered trees that we've committed to as
well as the continuous hedge. And then in other areas there's the type A buffer, which is the continuous hedge in one tree. So if there's we we can stand for questions and I I'll leave it at that. Uh very quickly there are specific standards for the special exception in your binder and I think it's tab five is my presentation and in writing and that addresses all of those standards as well as location, design and configuration, operation, and public need. And uh A couple concerns of like I all the re I I I'll bunch of googling is I I I I meant to hire appraiser trying to figure out how much would might be the property value decrease and uh you know, that fell through. I I do apologize. Then uh but like uh like just simple Google searches it shows that it does Uh It does show that is that low is your property value. So anyone
can just Google it. And uh uh another question, uh is there is there w uh are they don't do be adding dirt or anything building up the site to b because uh potential flooding or something like that?
That's a question they can answer when they come back up.

Uh we typically do very little fill on our site and there's almost no impervious service with the um and as you can see in your binders and I'll give you the tab, um They they actually stand up uh pretty high off of the ground and that's to allow our sheep to graze and and cut the grass for us. Um that's tab four of your binders so you can see what the panels look like. So there's very little impervious surface, some minor grading just to even things out for driving the piles for the uh for the solar panels.

Uh yeah, Ms. Mora, could you clarify what the black boxes on your your site plan are? Are those the inverter pads or are
Um I I'm not quite sure what those are. It I believe if you look cautiously, um there's some little red dots. I believe those are actually the inverter locations. That seems consistent with our inverter locations. I'm I'm not quite sure what the black boxes are. Apologize for that. It could be a printing error. Yeah,
I'm that's that's exactly what I was gonna say. I believe it's an artifact. We actually had a another version of this uh that doesn't show those.
I believe it's an artifact of the of this particular drawing. We have a su another drawing that doesn't show those black uh I'm not sure what it was, the printing or or artifact of some kind. It's not it's uh there's they're not inverters, they're not other inverters. impervious surfaces.
Okay. Yeah, because I d I do have a I mean just visually, y you're you're saying this represents 133 acres.
So the pan so when when you ask the engineers, which is what I did, what is what is what is under a panel They said 133 acres. And it's like, well I could see that it's greater than that. So it's 133 acres of panels in a three hundred and fifty acre area because you have grass areas be rows between because they form arrays. And then the arrays come in in blocks and then there'll be another block over here. So there'll be spaces between the arrays, the rows, and then the actual blocks
of of it. So there's a lot of open space between the panels and then of course underneath the panels that's that's an uh impervious our pervious land as well. So that's open space.
Okay, so you're you're essentially saying that the three hundred forty-four acres is represented by both the the gray or white and the the black areas that are represented on the site plan, so that is accurate?
That's cor that's correct, yep. And then the the wetlands and the setbacks would make up pretty much the rest of the of the property.
And and what are the setbacks from the wetlands?
Uh they're at least twenty five feet. Okay. And then the property boundaries are at least are are a minimum of fifty feet.
Okay. Mr. Chairman have a question from the same gentleman. Oh, sorry. Yes. So I quickly looked through the binder, but do you have a picture of what Mr. Schultz will see from his property in terms of the buffer? Like what what will what will did you want to see Shultz? What will he see from his property when he's looking at the far solar farm?
We we don't have a visual simulation. I think that may be what you're doing.
Or maybe you can just then describe what what will he see? Will he see a fence? Will he see trees? What kind of trees? What will
Uh initially there'd be a so uh what w what's uh being re being required is one of the conditions, so there'd be a twenty foot buffer that would be vegetated. In that twenty feet there would be uh a double row of trees and a continuous uh uh evergreen shrubs, uh a hedge, and then behind that would be the fence, and then behind that would be the panels.
And how high is the fence?
Uh the fence will be uh seven to eight feet tall. And it's a uh it's not a solid fence.
I guess what I'm basically asking, if he's looking at it from ground level, will he be able to see fit will he be able to see the solar panels or or is it all gonna be completely screened?
I would I my supposition would be that as the panel goes through its motion for the day, that there would be a period of time where he would be able to see the panels. Not all the time, because they'd be flat at one point, but as they rotated through the day, there would be portions of the day where he would be able to see uh either through the trees or above that hedge.
Okay, so the the panels are typically how high off the ground?
Uh no more than fifteen feet at at at maximum.

And minimum what are they?
Six. Okay.
So they'd be considerably above the fence.
About how many hours a day is that that they're above the f above the height of the fence?
Well do you know that, Robert? Repeat questions. Uh how many hours of the day?

So the question was the we you stated that the fence is about seven or eight feet high. How many hours a day are the panels above that height?
Well, the uh panels track the sun. So uh it's basically going to be when the sun is at its highest position in the sky. And um so uh no let me take that back. It'll be when it's the sun's at their lowest position in the sky, because it's gonna they're gonna be facing the sun, you know, early morning, late in the evening.
Okay, so how many hours a day about is that? I'm not an expert on how these panels work. So
And so you're probably looking at approximately an hour in the morning, hour in the evening.
That they're above the height of the fence.
They would be slightly above the height of the fence. So the fence uh is seven foot uh and uh the panels will probably extend maybe another foot or two above that, and it varies because of uh the uh lay of the site and uh you know the varying uh Uh heights of the uh piles that we set uh the panels on.
Is the landscaping that you're planning projected to go above that seven or eight feet in height? I mean I don't know what you're planting there, but I guess what I'm asking is there a point at which when the landscaping is mature, he won't be able to see the panels at all.
There w uh so if the landscaping grows the way we want it to grow, that's correct.
Okay. What are you planting? What what kind of trees are you planting then?
Uh uh they're going to be of Florida native evergreens. Typically what we use are red cedars, but you know, depending on availability and requirements, we could be using other other foliage.
And do you have provisions to uh maintain the landscaping as well?
We we have to maintain the landscaping, correct.
I believe the landscaping's all on their property, so they would have to

Fence Fence is six foot chain link with uh uh an additional one foot of barbed wire. Uh we we do have to protect the public from the site.
So y it is you can see right through it, other words.
Yes.
And and just for clarity, I know one of you mentioned that there was gonna be evergreen shrubs. The landscaping adjacent to to the person that's here is there's no shrub requirement. Is it it's just trees? Or is there a shrub requirement? Yeah. All I see is reference in the memo to the to the two staggered rows, sixty foot on center per row for the trees. That's all I
see.
I should it should read type A plus. So you start with you start with the type A against uh uh uh uh for residential, which is an evergreen a continuous evergreen hedge, then added to that for the residential will be the second row of trees.
Liam, do you have your I know you had that diagram where you had the purple and the where you had the buffers labeled?
Yeah, so you can go back. Sorry. I
I can clarify that condition. So that condition for that twenty foot buffer that is not a type A plus. It is a twenty foot wide staggered two row tree buffer. Um there is no hedge included into that condition.
So what what
is the minimum height of those trees that
they're planting?
Um it's not specified in the condition. It would be whatever the land development code would specify. What does it specify?

Well she's looking it up Liam. I was staff's intent to make this a opaque visual screen that that Mr Schultz wouldn't be able to see through, 'cause it doesn't sound like it is.
It wasn't the intent to fully block the view. Um, it was to to screen it um as the trees matured over time.

Well, I I mean if if Planning Commission wants to impose a more substantial buffer on in that corner, Planning Commission has that discretion to do that. You heard what staff was recommending and what they're actually planning on doing, but that would up be up to the Planning Commissioner Yeah.
Yeah.
Well, my personal feeling is is that it should be uh not visible from the adjoining residence property owner. I don't think if I lived there suddenly wouldn't want to look out my backyard and see a bunch of solar panels. And so in my mind it's so it's totally insufficient to uh to satisfy me. And uh I think that's gotta be rethought. I also disagree with uh your
assertion or your appraisals assertion. about how it affects property values. I mean that's a that's my area of expertise. I've been in the business for fifty years and I know what affects property values and what doesn't. And I don't think anybody in this room could say in all in all honesty that they'd love to live next to a solar panel site. And uh so I
know that we're trying to develop them. I know that we're working toward uh you know that kind of uh energy, but if we're gonna do it, we're gonna have to pay the price to do it. And I don't think we should expect the neighbors to pay the price. And uh personally I think if it were up to me, I I think we should they should have to be compensated for the for the uh
amount of decrease in the value that a property may experience because I think they will experience it. Yeah and um
But I think number one, right off the bat, you've gotta come up with a better uh idea to buffer that property. I think that's really unfair to expect to put trees sixty feet apart, two rows of of skinny trees, and and a and a chain link fence and think that's gonna be sufficient. That's my feeling. And now the rest of you don't.
Can can I ask one redirect, Mr. Chair? Um so there's a fairly comprehensive appraisal study that's that's provided, probably value impact studies provided in the binder. And of course we haven't had the chance to review all under five pages, but just question for you if that has been provided to the residents, Mr. Schultz and and the others, has that been information that's been provided to them for their Their review?
We have submitted it into the record previously. I have not personally given it to them, but I'm happy to.
Okay. Yeah, 'cause I again we haven't the opportunity to review this yet, but this might answer some of his questions regarding proper evaluation.

I have I have a question. I can't resist asking. Um I wasn't here l I think I missed last time, so it was answered last time. So why why this particular sheep from Maine? I'm just curious. I just my brain works that particular way. Curious why that particular breed of sheep.

I it may not be a magic of the sheep, so we we have an agreement with a sheep herder and these are the sheep that he raises, so it it might be that simple. Okay.

Uh yeah, uh Brad Tippin, Planning and Development. Uh one of the things that that comes into play, our code typically buffers against taller uses next door. This is actually of a fairly low use, these panels only being fifty feet high, that's shorter than a typical house. So our buffers don't really work the way they are laid out in the code for this. Uh so I believe part of the problem is you're looking at the the the area that's going to be underneath the canopy of the tree you're s you're gonna be able to see some of
what's happening on the site. And there's really two ways that we address that. Typically, one is with a hedge, a continuous hedge that's six feet high uh at maturity, that kind of covers that piece that falls underneath the canopy. The other is to make a fence that's impervious or uh uh that you can't see through. And you can you can kind of choose that and combinations of that. There may still be slivers that can be seen depending on the growth of the trees, the age of the trees, and the type of the trees, uh but that's
generally the way that our options are to address this. We've gone with more trees to try and fill in that space above, but we can certainly as a condition of approval you can request something more for that lower piece.
Yeah, I think that's really important because and I d I really um Personally, I th I'm I I don't really want a solid fence. Because that and then that it hurts airflow, you know, and uh so if we have some kind of a living hedge And I don't mean I don't wanna somebody to come in and plant a f a hedge a foot high and have to wait ten years for it to grow. You know, it needs to be a substantial
hedge when it's planted. Yeah.
We we can request a six foot minimum height maturity, uh so it can grow to at least six feet of maturity. Now granted when it's installed, chances are it's not gonna be that. You just physically can't get those types of plants. You know, they have to install them at a smaller size and then they grow. So there is a there is a period of time where there could be some limited buffering, but as everything matures, you can create that.

I I guess really a couple of things here on this one. I mean first off I I think this is in an area that's pretty heavily Industrial uses and these heavy industrial uses down there. I mean you got the aggregate facility to the south. Um I mean I think this site physically makes sense. Um I think they have done some things in how they've laid this out by keeping the 50-foot buffers around the surrounding property. Um they are making some landscape provisions. Um I mean my main concern I mean is I as I look at the conditions the way they're written I mean along
County Line Road they're providing a type A buffer which requires the shrubs the way I read the type A buffer in the code. Um there there's a type C buffer that sounds like what they think they're providing is a twenty foot staggered row of trees, double row of trees, sixty foot on center with shrubs. Um I I personally I I don't know why it's not written like that. Um I mean I'd like to see some revisions made to the to the conditions here for the buffering to um address these
concerns.
And I can make some revisions or I don't know if you guys have some suggestions or comments on that.
Uh we would be welcome to a condition along Mr. Schultz's property to do a six foot at maturity hedge if that would give the commission additional comfort.
What what I wanna emphasize is that if if we agree to that, I wanna emphasize is that I don't want somebody to come in there and plant a six inch Plant. Stinking blah yeah, it'll be six feet of maturity. I mean we'll be all be dead by that time that happens. So, you know, it needs to be a substantial plant at when you plant it. It won't be six feet tall, I understand that, but
Well you could require a minimum planting planting size and a minimum maturity size. I mean you if you want it to be minimum h I mean Brad's recommendation, but what's sort of the highest you can get it at planting?

They can be blown back and forth. Yeah, the uh there's there's some options there and it depends. I'm not a landscape architect but but there are different varieties so it really depends and some of them grow faster than others. So if you just set a minimum they can find a variety that meets those requirements. What
would you recommend? Like four feet?
Uh uh three feet at installation probably is reasonable, uh with a minimum six feet at maturity. Um I think that that's probably gonna give a wide variety of options to make sure that the pl that it's available in the quantity is needed. Um you can go higher than that if you feel that that's what you want to do. You could probably require six feet but it would be difficult to get and unfortunately from what I've understood, uh sometimes they have difficulty surviving uh that because they're already mature when they're being planted and there's some issues there.
So It's better to plant them a little bit smaller and let them grow into their space.
Well personally I'd like to go with at least a minimum of four feet and six feet of maturity.
And I believe our code actually says they have to reach maturity within a certain duration. Uh within twelve months or so.
I wanna take compliments.
Yeah, there it yeah, there is an actual so so it's not something that it can grow very slowly over ten years. This is something that has to pretty much be there a particular period of time.

Oh yes, I have a neighbor directly behind me and uh it's the same s you know, the exact same boat.

Yeah, I mean 'cause if there's some other folks who are in the same position, I'd like to make sure that we
I mean I think to address the concern if we're addressing the residential concern i it's it's recommended condition six D that needs the language needs to be changed. Um the references all those parcels. Right. Because I think that's the intention is all those parcels that are referenced are the residential parcels along the north property boundary. Correct?
That's the intent, I'm sorry. Yes. And I can read the parcel numbers that the Schultzes and the neighbor to the Schultzes if you'd like.

they're on your list. They're the third and fourth parcel ID numbers on your list in condition number six. I guess

Yes, and I'm gonna allow Tico to actually answer some of those questions because there are some residential properties that are in Palm River Dairy that are not gonna be buffered and there is an agre a private agreement between those owners because that is Palm River Dairy.

So i i if I may be heard the the the shrub, you know, we're we're certainly willing to commit to that for Mr. Schultz's property and and his adjoining neighbor. But the reason that we're planting the cedars is they are very big or other similar evergreen is they're very big bushy trees and they get very tall and big and bushy. You might notice them along I4 for example um or some other DOT roads. They get huge and they get huge trees you know, not fast, but at a relatively decent time frame. So
the hedge is actually going to be somewhat redundant. Um, we're certainly happy to, you know, put that in to address Mr. Schultz's concerns, but uh but I raise that because it the hedge is gonna be very much redundant of the very large of the cedars. When the cedars grow, they get big, bushy, and tall. So they're big columns. They're not like a um like an oak tree that has, you know, a little stem and and goes up and branches out. They're big columns that go up and they get very bushy and there will be a an absolute buffer once these things grow and bush
out.
My my only concern along those lines is the spacing. I mean essentially you have a tree every thirty feet. Um, I have I have seen them grow and and I've personally had them installed on several projects that I've been involved in, but I I mean Even at sixty feet I don't think in in five or ten years they provide a you know opaque screen that everybody's looking for here.

Oh just I want to add to to what Jamie was saying, this was a double staggered row, so they're sixty feet on center, but they're staggered. So the ones in the front are sixty feet from each other, the ones in the back are sixty feet from each other, but because they're staggered there will be a tree every thirty feet when you're looking on them head on.

condition six A only says fences will be a minimum six feet in height. That's the only reason I I don't if you're committing to provide the seven foot fence, then why don't we change that to be a seven foot fence?
