Donation Bins ordinance amendment

What the county recorded

This item is not from the published agenda

It is a stretch of the recording that this archive identified as a separate matter — a call to order, a recess, or something taken up that the agenda does not list. There is no official title, no staff recommendation and no disposition, because the county never recorded one. Everything below is inferred.

On this following item, Denise Hernandez Planning and Development. On this follow following item you're sitting as a local planning agency?

Item P ten, I'm going to read the ordinance title. The ordinance by the Pasco County Board of County Commissioners amending the Pasco County Land Development Code. Section 530.22 Donation Bins. Providing for applicability, repealer, providing for severability, inclusion into the land development code, and an effective date. So in two thousand in twenty sixteen the Board of County Commissioners adopted ordinance sixteen thirty-three which regulated donation bins and established standards for permitting and other procedures. In 2017, uh that ordinance was amended to establish review

time timelines for the issuance of domain donation bin. permit applications and it also incorporated some appeal language that's included in the land development code. On August 6, 2019, the Pasco County Attorney's Office provided an update to the Board of County Commissioners explaining that their intent was to make some changes to 530.22 in order to make the ordinance consistent with junk and debris and consistent with court rulings concerning charitable and commercial speech. So

the Board of County Commissioners directed the County Attorney's Office to move forward with that item. And the proposed amendments before you are there to are here to actually clarify those items to make the regulations consistent with the ordinance concerning junk and debris and consistent with court rulings concerning jet charitable and commercial speech. So today we're just asking you to find the ordinance consistent ordinance amendments consistent with the Pasco County Comprehensive Plan and recommend approval to the Board of County Commissioners.
