Good afternoon, Mr. Chairman, Commissioners. My name is Tuma. I'm here representing the applicant. Um we did receive the um concerns noted by the residents. I'd like to address those concerns based on the land development code. Concern number one regarding the scale of development, the residential treatment and care facility are expressly permitted as a conditional use within both the AR and AR, AR and R1 MH zoning districts, subject to the board's
approval. The applicant is proposing to accommodate a maximum of 125 beds, developed in two phases. Would be would be 45 beds, and phase two would be 80 beds, which is considered very small in scale. Additionally, the subject property was approved by the BCC with a special exception 1473 in 1981 for a child care center, and then special exception 2721 in 1984 for a convalescent home. Historically,
the site safely operated as a Central Pasco Girls Academy under the Florida Department of Juvenile Justice. Transitioning this site from the state-run juvenile residential program is a to a passive senior care program. community represents a significant reduction in the operation in the operational intensity for R uh Wilson Road. Number two, concern concern regarding the traffic on the Dead End Road. Residential treatment facilities are typically gener typically generate
lower peak traffic than other institutional commercial uses. The applicants submitted a timing and phasing application as well as a substandard road application prior to the submission of the conditional use application. Staff formally issued an exemption because the project volume is safely less.
50 peak hour trips threshold AM or P.M. staff also included that in your board package. This exemption formally proves that the traffic does not negatively impact the functioning the functionality of the surrounding roadways. Concern number three regarding noise. This facility is considered a is not considered a high noise generator under the land development code. Furthermore, this specific facility is dedicated solely to the use for the
senior community. Any foreseen noise violations would be entirely enforceable post-development through standard code compliance channels. Lastly, number four. Four concerned that the facility may operate as a drug treatment or rehabilitation center. Again, this application before the board is for a residential treatment and care facility as defined by the land development code. This classification is not synonymous with the drug rehabilitation center.
Um, the facility providing detoxification. or substance abuse treatment would require different licensing, different disclosures, and potentially different use um land use approvals. The county evaluates the um Use exactly as submitted. Operating a materially different use would constitute a violation of the conditional use approval. In summary, staff has reviewed the application under the applicable applicable provisions of the Pasco County Land Development Code. The Planning
Commission recommended approval with conditions. The concerns raised relate to the issues that are thoroughly addressed. in the site development review where the applicant must prove their development plans explicitly in line with the land development code prior to permit issuance. Therefore I respectfully request the board's approval. Thank you.

No. I uh I had looked at this property when I we got a letter that it was for sale. I think the federal government owns it. Is that right, Mike? Mike and I went and looked at it. We we wondered about a fire station over here. Uh but I think this is a good spot for something like this personally, yeah.

but okay. Betsy Law Lamoy and I'm on [address removed] and Land O' Lakeshore. In your sword. Yes. Um Chairman and Commissioners, thank you for allowing me to address issues or concerns on this property.
Forty beds doesn't sound like a large facility on an eight acre parcel. However, if you've looked at this parcel, as you say you had Ms. Starkey, there's a large pond that takes up quite a bit of that. There's um I'm not sure I'm I don't know how much of acreage a the pond is, but it is a small property. The road is small. There there's no center line. It's a dead end road. I i I live Toward the end of the road, And There are
only there's seven families toward the end of the road. We've been impacted when the juvenile detention center was there with trucks that are delivering items to the facility. They park in the road and we can't get around when we're trying to, you know, leave and come back to our homes. Um The noise level is a concern, and I understand that that would be addressed at a later time if that in fact was a was an issue. Uh my main concern
is the amount of traffic. Yeah. Vehicles aren't allowed, delivery trucks and other vehicles aren't allowed to block the road and lawn services, that's an another issue. Um I was hoping for th that they would show a picture. Okay. So
Um so the road is paved. south from fifty four for about a half a mile to three quarters of a mile, then it becomes Lime Rock and so I'm on the at the end of the Lime Rock road and um oh I've been there since eighty one. I knew when it was a property. I I grew up on land adjacent to that. So I've been in the area since pretty much all my life. Um I knew the people that lived in the house where this property is and then it was sold and sold again and it's become from in
eighty one was a um child care center and then gradually has evolved and then the juvenile detention center. Um It just it is the road is just very narrow right there. And I I don't know other than complain every time something blocks it, but you know, that's also blocking access to our houses for fire and emergency services. Just these are things I would I would like you to know. I
am I am the writer of the email to Ms. Yeager and And I am happy to hear it the it it is referred to as a passive senior care facility and doesn't have anything to do with um drug treatment, but I know things can change too 'cause this has evolved through the years as a d as different kind of um A center. I would also like to request stop signs at their driveways so that staff and other vehicles leaving the property stop because
you know our we're on the road and they're coming out from there with this has happened when it was operating as a different kind of facility. So And the signs that are put up I don't know if y'all can see that, but they kinda droop. They aren't like the old yellow signs that used they used to put up. This is the original one and about two weeks later it was unreadable.

Um given the concern about drug treatment, would you have any concern of changing condition one to say Congregate care facility instead of residential treatment and care facility.
Uh the reason why it was um labeled as a residential and care facility is because of the land development code it was labeled that way. Um we don't have any
Well my only concern is that definition includes drug treatment and
it it includes drug treatment and rehabilitation. And I know you said you're not doing that But I think the objector is technically correct that it could it could be converted to that. So that's why I'm asking the question. Are you willing to limit condition one to So that's not that broad definition.

I mean because the agenda amendment says you intend to do a congregate care living facility. Is that accurate?
Right. But when we went through site development review or review with staff, they labeled it as um a residential and care facility based on what we were proposing in the land development code. So that's why we
I'm just saying to truly narrow it to the use that you're proposing and not have it potentially be drug treatment, I think that would have to be changed to congregate care facility. And I wanna know if you were okay with that change.

Let me before you you agree to that, let me just bring up one thing if I could. So my dad just being in an ALF, um, he went in for rehab. He had people that were in there that were gonna be in there as an assisted living facility and weren't pretty much coming out. My dad was only in there for a couple of weeks. So I'm fine to protect it against the drug rehab, but I think some of those people will come in, have a fall, had a have a surgery, they have to rehabilitate themselves, so it's not drug rehab. uh
physical rehab, which I think is fine to have in there.
But
I want to make sure you don't restrict yourself on that.

it could say Congregate Living Facility, Skilled Nursing Facility, or Convalescent Home, which is the other things that are listed under that definition. Or similar facilities. The problem is that definition also includes drug treatment and rehabilitation.
Right. So I'm just trying to get to the right definition, but it's not not prevent them from the uses that it's probably going to happen or be b beneficial to happen.
So my recommendation then would be to change it to say that it's limited to adult congregate living facilities, skilled nursing facilities. convalescent homes or similar facilities. Okay. Would you be okay with that?

Mr Chair, what about the uh since it isn't narrow the the the ability to bring in your you know, if there's a tractor trailer bringing in food or whatnot, is there a ability to unload and pull out without blocking the other neighbors?
So to address the neighbors concern about um delivery, we're only proposing um like meal prepping as far as like using somebody would bring in the meals and they they would just microwave it. It's not, you know, constant deliveries of supplies or anything like that for for the facility. And then as far as the roadway, there is um there is a condition on the approval. that we um convey 60 feet right of way, which
we did. We submitted a revised conceptual site plan for the w the proposed widening of Wilson Road down the road.
Um let's go a little further with that if I could. Um When you're saying that right now is it a dirt road all the way through up to your property?
No, it's not a dirt road. It's it's a collector road, yes sir.

you're gonna give that away. In case we ever do decide to pay for the court.
Yes, that was a condition of approval which we um agreed to and we provided a conditional um a convention uh I'm sorry, uh site plan, a revised site plan to show that um Mm-hmm. Convenience.
Okay. As far as access management goes, it's probably for staff to make sure that if they do have trucks coming in, they're not gonna be parking on the roadway.
