It's a zoning amendment for a change in zoning from an AR Agricultural Residential District and P01 Professional Office District to an AR Agricultural Residential District and C2 General Commercial District. The applicant has agreed to record a deed restriction on the property, which is in your attachment two, and it's
in your finding of fact number two. But some of the things that are going to be recorded in the deed restriction is limiting the uses to a 44 for to 4,400 square feet of casual restaurant and 5,000 square feet of retail, prohibiting access from Lehman's Drive and Fro Floralton Drive. Specific Requirements for landscaping and buffering. Um specific requirements for site lighting, limiting the uses in the C2 districts, so basically limiting those 5,000 square feet of retail to specific uses
that are in retail. And um again those are and and prohibiting certain uses. So that is um the the request on item PDD twenty two seven five seven five comes to you with a recommendation of approval.

I think the I mean my main question is the access, because I'm looking There's a curb cut that's already there, and then with the proposed Uh site plan that was there a couple of Pages back it has another curb cut. So Could we use the one that's existing instead of making a new one? Is there any way you know just to eliminate the right-of-way? The number of curb cuts.
Or even tie into that um auto parts store, either way. But if you look at the aerial, you can see a curve code that's there.

Uh we're actually moving it further east to get further get better spacing between what is there. So the reality is if we leave it where it is, it's closer to the one to the west. So the idea was to move it a little bit further to the east to get a little better separation. and circulation for the project. So that's why we remove but we are d we are m we are eliminating that access and putting one new one. So it's still one right in, right out to

There are several voluntarily agreed upon deed restrictions that are provided in your finding of fact number two, which go. Through from A through G. Some of them, just to provide quick information on those, it's
restricting the uses to 4,400 square feet of fast casual restaurant, 5,000 square feet of retail, no access to Lehman's Drive or Floraltone Drive. They're asking to actually buffer the property that in a greater way than what the land development code requires. And to limit the uses to professional office, business services, the retail part of the uses. Again, those are in your finding of fact number two, items A through G. Comes to you with a recommendation of approval from
the Planning and Development Department and the Planning Commission.

This is zoning amendment from AR Agricultural Residential District and P01 Professional Office District to an AR Agricultural Residential District and C2 General Commercial District. The subject site is located on the south side of County Line Road, approximately 500 feet east of Shady Hills Road.
There should be an aerial view. And then the surrounding future land use to the north is Res1, to the east is Res One and COM Commercial, to the south is Res One, COM Commercial, and to the west is ROR. The surrounding zoning to the north is AR, to the east is AR and AR1, to the south is AR, AR1, and to the west is C2. This subject site is currently undeveloped and consists of approximately 7.29 acres. The applicant proposes to develop a portion
of the property with 4,400 square feet of casual fast casual restaurant and 5,000 square feet of retail space in conformance with the C2 General Commercial District standards. Well while the rest of the property will be AR zoning.
The site has a two hundred and ninety-five foot wide Florida Power Corporation easement to the west and southwest portion of the property, and a drainage and utility easement along the east and southeast portion. The subject site has a future land use classification of comm commercial. The applicant has voluntarily re will voluntarily record a deed restriction and access to the property is along County Line Road. And then there should be a conceptual plan. And this is coming with a recommendation
for approval.

Jack MarianoYes, um one question. I I know you don't ha you you have as you set up with no access coming in from those side roads. Correct. But have you thought about it it's one of the places coming in is culverous, right?
Liam DevineYeah. Um, I believe that would be for the Apple and Clint uh
Jack Marianotop quality place. I think all the residents in that area probably want to go there. But what concerns me is if they wanted to walk to it, can they other is there a pedestrian access to that?

Liam DevineYeah, so that could be handled at the site plane review. Um there is a wall, there's no prohibiting it to have pedestrian access. However, there is a utility and stormwater easement that's quite large along that portion to the south.
Jack MarianoOkay. And about the as far as the access as far as water and sewer. It says you're gonna looks like you're gonna connect to Hernando. I believe that is the

Jack MarianoBecause from what I've heard from times down the road that they're not so uh willing to have us connect because of the demands they have above.
Mike CarballaWe have a in it excuse me, an interlocal agreement with Hernando County for sewage. So if this is in the right area and it makes sense, that's where it would go. We don't have sewer service in the area. I believe we have water service in this area.
Jack MarianoOkay. And I'll and I'll say for down the road though, for the board to to think about County Line Road, especially getting hopefully it gets expanded quickly with the uh Scopp ramp. But If we we can can take a look and just keep in mind that we're gonna eventually wanna get have our have our own line going up there. But Uh other than that I'll move for approval.
