Item P fifty seven was published in the Tampa Bay Times on February twenty-fourth, twenty twenty one.

    Unidentified speakerVoice A

This is uh PWL 21-0023 Lake War Acres, Spevas number 3353. This is also one of the 2015-16 storm damage roads, which was temporarily repaired with um Chipseal. Uh this is a board-initiated project. There are two streets in this um In this project, their count maintained 91 lots, 46.39 ERUs. The estimated project cost is $477,300. Maximum cost per ERU

is $10,288. The discounted amount is $96,575. And the maximum cost per ERU after the discount is $7,966.

The repayment period is 10 years and the interest rate is uh 3.25%. This is a location map for both roads and um this is Cameo Drive at sunrise and um cameo drive.

    I'm I'm done.

    Kathryn StarkeyVice Chair

Is there any public is there any public comment?

Uh no one is on WebEx and no emails for P fifty seven.

    Ron OakleyChair

Move to approve. Anybody at the kiosks to speak to this item?

    Kathryn StarkeyVice Chair

Moved to approve P fifty seven. Second.

    Ron OakleyChair

    Wait a minute.

    Yeah. I'm sorry.

I'm waiting. I asked for it but I haven't received anything.

    Anybody at the kiocks?

    Mike Moore

    Yes. Yes.

    Ron OakleyChair

Amen. Just speaking for this item

    Mike Moore

P for this item fifty seven.

    Christina Fitzpatrick

For Lake Warrell Acres, P fifty seven. P fifty seven. Yes.

    Ron OakleyChair

    Okay.

    Unidentified speakerVoice B

My name's Frank Baylock. I'm at the [address removed]. Um this uh the picture that you you just showed on Sunrise, that's not gonna be repaired under this uh Yeah. I get because all the debris and stuff you see on the road is coming from World onto Cameo. And uh can't uh World's not being done, Adonis is not being done, and I know a lot of the residents are not in in having this project done.

Um it's not gonna use the flooding. that caused image in the first place. It's uh You know, re paving it was gonna fix the floor. Raised the anger from a foot to two feet. Yeah. Keep it out of thought zone. Okay. I don't know. You know, and I'm being assessed twice on two different lots that are side by on this project and I don't even uh have property on those uh roads that

are being paved, but I'm being assessed twice for the project.

    Ron OakleyChair

    Okay.

    Kathryn StarkeyVice Chair

    So um Mr. Chairman

    Ron OakleyChair

Mariano Okay. Is that the end of your comments, sir?

    Unidentified speakerVoice B

    Yes.

    Ron OakleyChair

Thank you for your comments. Well did we get it back? Did he get me else there to speak?

    Kathryn StarkeyVice Chair

Did he give his name and address?

    Unidentified speakerVoice B

    Yeah.

    Kathryn StarkeyVice Chair

    I don't think so.

    Unidentified speakerVoice B

I can give it to you again. It's Frank Bayonet Point.

    Kathryn StarkeyVice Chair

    Oh, that's right.

    Unidentified speakerVoice B

I can own the property over at [address removed].

    Kathryn StarkeyVice Chair

[address removed]. Okay, thank you. All right. Thank you.

    Unidentified speakerVoice B

    Thank you, sir.

    Ron OakleyChair

Is anyone else here to speak to this matter?

    Barbara Wilhite

There's no one else at the kiosk.

    Ron OakleyChair

    All right, thank you. Okay.

    Mike Moore

    Mr. Chairman Mariano.

    Ron OakleyChair

Now is this one a um board initiated

    Unidentified speakerVoice A

Yes, this is the storm damage board initiated. These were the roads that were chip sealed, d these two roads were chip sealed and we were directed to bring it back as board initiated projects.

    Ron OakleyChair

There are only two roads in in the whole

    Unidentified speakerVoice A

project? We only did the ones that were chip sealed. The other ro roads are mentioned, Laurel Drive, it's unpaved. Um so if we're gonna go do the paving, we'd have to go through with the the whole Swift Motor exemption entire process. Versus with the previous project, it was easier to include it because it was already paved.

    Mike Moore

    Right.

    Unidentified speakerVoice C

    Can we see the map

    Mike Moore

    again?

Um No. I typically go along most of the time, you know, with obviously the commissioner of the district because they're the ones that are meeting with the residents and doing the typically the community meetings and things like that and stuff. I'll s I'm still not a big fan of board initiated. That's why you've never seen me in seven years bring one from my district here. I don't I don't have you seen me bring one from my district? No, sir. No, I haven't. I never brought one forward. Um just want to make sure I was right.

    No, no, I don't but no no but I don't. But but I don't.

Yeah, if you go through all those areas or not. Um, I'm just m typically more of a fan of letting the residents vote. And if it's over fifty percent, it's over fifty percent. If it's not, it's not. That's just me though, you know. But I typically let me you know, this is not a debate of what I'm just giving my statement and my feeling on it. I understand. But I typically go along with it, what the district commissioner says because they know the area better than I do too. So, you know, I again if if the district commissioners feel it's this is needs to move forward, I mean I'll I'll play along, but

    Okay.

    Well

    Unidentified speakerVoice D

    this is different.

    Ron OakleyChair

I understand what you're talking about, but the fact of it is we have roads that really need to be Paved. They keep voting 'em down like you're talking about. And the fact of it is they keep complaining to us about repairing the roads or fixing the roads and never anything done, but it keeps being boated down in the process. And there's no other way unless you get to commission.

    Mike Moore

No, and I I and I don't disagree with you on those hard. Yeah, and I don't disagree with those issues and I think that's uh just a way of you know and it doesn't always work of communicating going, Okay, this is the option. If you don't take the option it's not gonna be done. Right. But don't come back to me and ask for it to be done thirty minutes, thirty you know, but I get what you're saying too. Yeah.

    Kathryn StarkeyVice Chair

Okay, Mr. Thank you. Because None of you were here except for Commissioner Mariano was when the hurricane hit.

    Ron OakleyChair

    Mm-hmm.

    Kathryn StarkeyVice Chair

I d I need you to remember this. I need you to remember this for Crane's roost. And I need you to remember this for this one. This is different and he said it. What happened, just so you all know the story, is that we got federal money that we could do anything we wanted to in the county within a certain um department. And We chose these roads were in really, really bad shape. Okay. They were full of potholes. Step back

    Unidentified speakerVoice E

step back a little bit more in the history though.

    Kathryn StarkeyVice Chair

    Okay. Well let me just

    Unidentified speakerVoice E

say that these were all the communities that came forward and said to us We can't get mail service, we can't get garbage service, we can't because their roads had been flood damaged.

    Kathryn StarkeyVice Chair

Right. And we tried to get C help from FEMA. For these roads. Because um you know, with C D B G some a D R some kind of money and um because these roads were undrivable after the hurricane. They were undrivable because they were in such bad shape. And FEMA took a look at our Google Earth and said We are not fixing those roads because they were

so bad. That's right. We're not you know, that was your responsibility. That wasn't because of this storm. They were so bad That you know, uh I don't know what that rule is and I'm kinda speaking your language, but I mean the roads were so bad FEMA wouldn't help us. But we took I don't know how many million dollars we got where we could have done storm s stops flooding and do other things, but this board made a decision because these people could not even drive home. They couldn't have

the bus, they couldn't have the mail, they couldn't have the garbage trucks. They went through the county and they picked, they said, these are the roads that are so bad. This is emergency, emergency chip seal. It's temporary, but we're gonna spend the other residents' money in this county on these roads with the gay that and we all agreed we would do that, and there would be board-initiated PVAS's on. when the time came. I'm shocked they've

lasted this long. I that Chip seal, how long does that normally last?

    Unidentified speakerVoice A

It'll be typical about four years. So we're about to end up

    Kathryn StarkeyVice Chair

so one there one big storm from having those roads explode again. And I know that Commissioner Oakley.

And I'm not kidding you that those roads look like a bowl of oatmeal. Yeah. Lumpy oatmeal.

    Christina Fitzpatrick

    Mm-hmm.

    Kathryn StarkeyVice Chair

And so th this is not this isn't This isn't out of the right-of-way. I don't know what to say. This is this is something we all agreed that we were gonna do and there really shouldn't be any discussion up here because we took money that could have gone to other things and these people have had this benefit. For four years. And that was the deal and now the the it's time to, you know, do what we needed to do way back before the storm ever hit. So I

gotta say it's not it's not

    Mike Moore

    What year

    Kathryn StarkeyVice Chair

    so what year

    Mike Moore

    stormw what year store

    Kathryn StarkeyVice Chair

    are you talking about?

    Unidentified speakerVoice A

    Two fifteen and sixteen.

    Kathryn StarkeyVice Chair

Charlie, the ABCs maybe. It was I'm

    Unidentified speakerVoice A

    saying

    Kathryn StarkeyVice Chair

    the pictures.

We can find the pictures because the governor came and we took him to some of those roads. The road that Cindy Jolly lives on, wherever that is. I tried to find it in my maps when we were in Tallahassee, but I don't have the picture anymore in the iCloud. But That is why we d chip field. We did it in Southern Oaks. We did it in Crane's Roost. And how much did you spend? How many millions of dollars did we spend?

    Jody Riddle

    a million?

    Ron OakleyChair

But we're almost to reach the or we're past

    Unidentified speakerVoice A

    the what 1.8

    Kathryn StarkeyVice Chair

Yeah, so we we took our federal money and that's what we used it on as a band-aid for these roads.

    Unidentified speakerVoice E

It wasn't federal money. It was we that that was money that we got from the BP law. BP settlement. Oh, okay. And it and it s had no Oh had no strings on it. The stuff that we got from the litigation that we joined in on had no strings when it came back to us, unlike the restore money that did have strings.

    Kathryn StarkeyVice Chair

So so we used money that could go somewhere else to put these band aids on with the agreement that it would be board initiated when the time came. And I'm telling you The The roads were in really bad shape and that's why they blew up. So that people think they're driving on a good road. But they're one big storm from driving on Oakwheel. So Okay, Commissioner Fitzpatrick.

    Ron OakleyChair

    Mr. Chairman Mariano. I

    was born.

Just a minute. Go ahead, Ms. Fitzpatrick.

    Christina Fitzpatrick

    Oh, Commissioner Mariano can.

    Jack Mariano

Okay, thank you. Um And you know This The previous board made a great decision doing something for those roads. Something had to be done. Uh we could have gone a full paving assessment then. We decided not to go the other way. Uh with the money allocated, it's the way it fit in the budget. Could have gone the other way. I think, you know, it's been so long and I think better decisions are made when you involve the people to what's going on. Uh just in Crane's roost the discussion uh that came up with everything didn't get chip sealed over on cranes roost, a couple of got regul different

type of pavement. Now they're gonna get pulled out. That discussion point, had we not had that, we would have made a bad decision. Uh with this project here, uh with just even one person coming up, Mr. Frank Baylaw, talking about how he's affected on a couple of roads that aren't getting paved in part part of the project, maybe we need to look at the whole project. And with a brand new commissioner for the area, uh, she's already gonna have a a few public area meetings coming up. I think it benefits her and her citizens, as well as all of us, to let her go have some public

meetings out there to find out do we want to do just the roads will be chip sealed, or do we do these other two roads together, have a discussion, and then bring it in for the people to let them see. Even if we go through all that process and the board still decides. decides they want to do it, the board has the power after that public hearing process to make it board initiated and just pull the trigger anyway. But I think it serves the people better if we do have that discussion all the way through.

    Kathryn StarkeyVice Chair

    Mr. Chairman Mariano.

    Ron OakleyChair

    Ms. Darkey?

    Kathryn StarkeyVice Chair

Um I don't know what conversations happened at the meeting. Uh I'm guessing they had these conversations at the meeting. Um I take a different view than Commissioner Moore. Um And I I th probably I'm more with Commissioner Oakley on these roads. Frankly, I think if staff is bringing us a road that's in really bad shape, it's because the road is in really bad shape and the taxpayers of Pasco County are paying for it to repeatedly fix until the next rainstorm comes and pops those potholes out. I

I had to fight really hard for two years and to raise the five cent gas tax so that we could get the money to fix the potholes, because back then it was taking sixty days to fit a p fit a pothole. I personally You know, I think it's a good idea. I don't wanna keep throwing money out the window on a pothole. I I trust the staff that if they're bringing us a road that's in bad enough shape I don't even know why we do a vote. I think they should bring us so many roads

a year and let's just Sorry, you live on that road? There's a responsibility. to fix the road. I don't wanna keep paying for your road because you don't wanna pay for it. And that's what happens. When they don't fix their roads, we all pay for it. So As far as I'm concerned, if you fail a PVAS, we don't fix your potholes anymore. Y'all take it on yourself to get some cement and go out there or whatever. Fill your own holes. That's where I am looking at.

    Christina Fitzpatrick

P fifty seven I think had a motion in in a second.

    Kathryn StarkeyVice Chair

    You

    Ron OakleyChair

    have

    Kathryn StarkeyVice Chair

    a motion?

    Christina Fitzpatrick

    I think

    Kathryn StarkeyVice Chair

I made a motion to to

    Christina Fitzpatrick

    P fifty seven.

    Kathryn StarkeyVice Chair

To do P fifty seven. I'll second.

    Ron OakleyChair

Yeah, I got a motion of a second. Um

    Kathryn StarkeyVice Chair

    Roll Cov.

    Ron OakleyChair

    Roll Coba.

    Kathryn StarkeyVice Chair

District two, Commissioner Oakley. District three, Commissioner Starkey. Hi. District four, Commissioner Fitzpatrick. Aye. District five, Commissioner Mariano.

    Jack Mariano

    Nay.

    Kathryn StarkeyVice Chair

    District One, Chairman Oakley.

    Ron OakleyChair

    Night.

    Kathryn StarkeyVice Chair

    Hmm.

    Ron OakleyChair

Motion fails three, two. Okay, move on to uh

    Kathryn StarkeyVice Chair

The next CPU. So what happens with that that one then? Then uh the the road falls apart? Because I don't want to go in there and fix it. And then

    Mike Moore

I think taking the suggestion, Commissioner O Mariano made about looking

    at the easy.

On rural that closed and look at those two roads the gentleman spoke about and then bringing it back.

    Christina Fitzpatrick

    That's

    Kathryn StarkeyVice Chair

    an unpaved

    Christina Fitzpatrick

road. So then that would be a can can we reverse that and make a continuance for that one to be continued for staff to look in.

    Unidentified speakerVoice E

Do you have to reopen anybody who is on the prevailing side of that motion could reconsider it if they wish to have it continued rather than denied.

    Christina Fitzpatrick

Would you be more likely to reconsider if staff can go back and make sure all the roads that need to be included are included? Mm-hmm. Or not included if they were not chip sealed. Because we only have one opposition on that.

    Mike Moore

Well I I'm gonna refer back to Commissioner Mariano because he made a he made a pretty good statement when he referred to the some of the roads that gentlemen was talking about and

    Ron OakleyChair

    I don't have a problem with that.

    Christina Fitzpatrick

    He's on

    Kathryn StarkeyVice Chair

    War

    Ron OakleyChair

Elfers. He's on this one too. Mr. Mariano.

    Jack Mariano

Yes, uh and Commissioner Fitzpatrick, comfortable if you want to have a go have a public hearing with these people and get a better decision and which way to go and then However we take it to a vote or not take it to a vote, but at least get with the people and find out what they want to do and then you can put the new numbers together if that means including the roads. Uh I'm happy to go that way. It might be just as quick to start afresh. But I'm if that it's not what you want me to do, I'll do that for you.

    Christina Fitzpatrick

So then P fifty seven will go back and then no. We need

    Unidentified speakerVoice E

to ask the commissioner if he's it reconsider. Commissioner has asked you a question. If you're if that's you're answering him yes, then will Commissioner Mariano reconsider the previous motion. So

    Christina Fitzpatrick

Commissioner Mariano, would you reconsider the previous motion if I go back in because I know what the other ones I have, so Would you reconsider?

    Jack Mariano

Yes, I will. I will reconsider. Move move to reconsider. Thank you. Okay. So

    Ron OakleyChair

Okay, under discussion. No, no, under discuss under discussion.

    Kathryn StarkeyVice Chair

I can ask a question under discussion so we all know what we're voting on. Ainsley, War World is an unpaved road.

    Unidentified speakerVoice A

That's correct. And so is Adonis.

    Kathryn StarkeyVice Chair

And Adonis. So when you add Uh unpaved road to be paved. Who pays for that?

    Unidentified speakerVoice A

Other property owners, adjourned benefited property owners.

    Kathryn StarkeyVice Chair

Okay, so am I understanding that we're asking for the folks to pay to take an unpaved road to become paved. Is that what we're gonna be doing?

    Unidentified speakerVoice A

    Can I can I clarify?

    Kathryn StarkeyVice Chair

    Yeah.

    Unidentified speakerVoice A

Um can you put back up the mouth for me please?

    Kathryn StarkeyVice Chair

    'Cause talk about expensive.

    Unidentified speakerVoice A

So the two horizontal white lines are Adonis and Warrell and they're unpaved. Because of the PVAS methodology and policy guidelines, the folks who are on Warrell and Adonis, although they're on paved road, they have to, they must use um uh cameo and um broad street so they are included in the assessment So what would happen if we go ahead and pave Warrell and um Adonis,

that would be the whole uh a much longer process because you have to get a Swift Mod exemption. Also, we would um Have to determine whether or not we would have to FDR or um bring in new new you know virgin material. So the the two things are mixed in two different processes. The reconstruction is different versus the, you know, unpaved road, which is a much higher cost. But it's just something to consider that you combine in two different processes.

    Kathryn StarkeyVice Chair

So then what we would be looking at over here on the right, where you show the gentleman who spoke was getting assessed at 25%, he would be getting assessed at 25% plus a hundred percent of world drive.

    Unidentified speakerVoice A

Not not if if you combine everything, what happened is that the costs go up. So he would be assessed at 100% because if we do pave world. He would be at a hundred percent. But the cost per ERU would be much higher. And also that would be spread on the folks on Cameo and their ERU would also go up.

    Kathryn StarkeyVice Chair

Well, that's what y'all think is a good idea.

    Ron OakleyChair

Well I think that's what they're gonna do is go back and discuss it with the

    Unidentified speakerVoice E

neighborhood. But what you're voting on is reconsidering the denial of the project entirely.

    Christina Fitzpatrick

I'm gonna go back and have a public meeting. To look at those roads, 'cause I've spoken to Crane's Roost and I've been out there And I've also been out to Aristita. And that was supposed to be a microchip seal and that was Mm-hmm.

    But they wanna

    Kathryn StarkeyVice Chair

do an F D R now. Right. So Because the microchip lasts three to four years, they'd still be paying for the microchip when they would have to do the F D Right.

    Christina Fitzpatrick

    So she doesn't they

    Kathryn StarkeyVice Chair

    don't

    Christina Fitzpatrick

wanna do the microchip now and then come back in five years and do the F D R they'd rather just do the F D R once and not have to pay for it twice. Yeah.

    Kathryn StarkeyVice Chair

Well that's what's gonna happen here. So Yeah.

    Mike Moore

So Mr. Chairman, you have a motion a second to reconsider now it's just to reconsider. So we need

    Ron OakleyChair

to take that motion and a second for reconsidering this project. And Rocal vote

    Kathryn StarkeyVice Chair

District two, Commissioner Moore. District three, Commissioner Starkey. Aye. District four, Commissioner Fitzpatrick. Ay. District five, Commissioner Mariano.

    Ron OakleyChair

    Okay.

    Kathryn StarkeyVice Chair

    District One, Chairman Oakley.

    Ron OakleyChair

Aye. So it's five it motion pass five oh to reconsider now.

    Christina Fitzpatrick

Now may I move to continue so I can have a public meeting. There you go.

    Mike Moore

    Second. Thank you.

    Ron OakleyChair

    Continue what day?

    Christina Fitzpatrick

    April

    twentieth.

    Kathryn StarkeyVice Chair

    I wanna be

    Mike Moore

    backed up.

    Kathryn StarkeyVice Chair

We're gonna have a long April twentieth. We're putting

    Mike Moore

    back on long

    Unidentified speakerVoice F

to think about continuing these different things.

    Mike Moore

    Is that

    Ron OakleyChair

the right time to do it April twentieth?

    Mike Moore

You might wanna Mr. Chairman. I don't but at the same time just I'm t I'm looking out for Commissioner Fitzpatrick here for a second. Um You have a couple of these already continued. You just a suggestion for your own well being. You might want to spread these out a little bit or you're gonna be very busy for about a week. And you might not have time to do all that.

    I think it's a good move. Second.

    Christina Fitzpatrick

    Yeah.

    Mike Moore

    Thank you.

    Christina Fitzpatrick

    Yeah.

    Unidentified speakerVoice E

    Day eighteenth at one thirty P. M. We're assuming there's a

    Ron OakleyChair

motion and second. Uh those in favor, roll call vote.

    Kathryn StarkeyVice Chair

    Commissioner Moore.

    Ron OakleyChair

    Aye.

    Kathryn StarkeyVice Chair

District three, Commissioner Starkey. Aye. District four, Commissioner Fitzpatrick. Aye. District five, Commissioner Mariano.

    Ron OakleyChair

    Aye.

    Kathryn StarkeyVice Chair

    District One, Chairman Oakley.

    Ron OakleyChair

Aye. Motion passed five zero. And

    Kathryn StarkeyVice Chair

AC those are those the last of the chip seal we did with that extra No, we have a few more?

    Unidentified speakerVoice G

There are two more. Two more. Okay.

    Christina Fitzpatrick

    Are these the last two?

    Unidentified speakerVoice G

No. We said there's two more. Two more. Okay. Okay, now we'll go through. After we get through today there are two more.

    Kathryn StarkeyVice Chair

Find those pictures from the past. The governor was here. Sorry, the pictures of the roads before we chip sealed.

    Unidentified speakerVoice A

    Okay.

    Kathryn StarkeyVice Chair

    I know there's

    Christina Fitzpatrick

I've also taken photos of the one neighborhood on the roads that should probably be included. And I believe my aide has already submitted those. So if you want to pull them up there for Yellow Lake and Share and drive.

    Ron OakleyChair

    Oh okay. You're right.

    Christina Fitzpatrick

    Photos.

    Ron OakleyChair

You're supposed to be right. Yeah.

    Unidentified speakerVoice F

Christie's arma. It would be restoring damage

    Kathryn StarkeyVice Chair

for Dharma. Yeah. That was Arma. Remove.

I'm gonna text Cindy Jolly She was

    Ron OakleyChair

    Okay.

    Christina Fitzpatrick

These are the ones on Sharon.

Sixty five, P sixty five? Yes,

    Kathryn StarkeyVice Chair

    sir.

    Yep.

Item P sixty five was published in the Tampa Times on February twenty fourth, twenty twenty one.

    Nope.

    Unidentified speakerVoice A

It's the call of public works. Um this is the Lake War Acres Pivas project. Um at the March twenty-third meeting the public um Hearing was opened and continued to today, May eighteenth, twenty twenty one. On April twenty sixth, uh Commissioner Fitzpatrick had a committee meeting. And here's so just some background information with regards to this project. This is a board initiated project. Um this was as a result of the um Temporary repairs

to storm damage road approved by the board back in 2017. There are two streets in this project. Um County maintained PAVE, 91 lots involved, 46.39 ERUs. Next please. Estimated cost is four seventy-seven thousand two hundred and ninety-nine. Maximum cost per ERU ten thousand two hundred and eighty-eight. The discounted amount is ninety-six thousand five hundred and fifty seventy-five. Uh maximum cost after the discount is seven thousand. Nine hundred and sixty-six dollars

and sixty three cents. The annual installment over ten year period and the interest rate is three point two five um percent interest. Next please. This is a location map. The two roads in questions uh run north south and um next slide. And this is some condition of the roads uh a couple weeks ago.

    Kathryn StarkeyVice Chair

    What number is this one?

    Unidentified speakerVoice A

    This is fifty-six. Sorry, sixty-five. Sixty-five. P sixty-five. P sixty-five.

    Ron OakleyChair

    Last item on the gym.

    Kathryn StarkeyVice Chair

Okay. Is that the white limelk coming up out of the roofs?

    Unidentified speakerVoice A

Yeah. And the potholes is a scamia drive.

    Christina Fitzpatrick

It was before the last one.

    Ron OakleyChair

This was done about the same time as other road was done. This almost looks like a gravel road. Well it almost looked like.

    Mm-hmm.

    Kathryn StarkeyVice Chair

Um So Ainsley, are you gonna take public comment? 'Cause I have some questions for Ainsley. When when's the right time for me to ask 'em?

    Ron OakleyChair

Well during the discussion we are do we have anybody signed up for

    Kathryn StarkeyVice Chair

I have um no one on w no one submitted an email, no one on WebEx and no one signed up. So

    Ron OakleyChair

okay. So we can have a discussion pairs, no one public comment.

    Kathryn StarkeyVice Chair

I so I actually have some issues on this one. I mean I I think we should you know I I am No We made an agreement that we're gonna do the board initiated PVAS, so of course I'm gonna stick with what I said I was gonna do, even though they're hard votes before. But I have a little problem with this one on the methodology. And so um I think I was l I was looking at some of the sites on here and I I'm sorry, I d I don't know what I do with my notes, but I went to One of the houses on Cameo

because I was looking I was looking at the um ownership That's right. Here. And so for example, and I think I sent this to you and Mike, if you look at um five Oh um let's see here. [address removed] is that the ones?

Um or say [address removed] and [address removed] or there's some others where you have Um Um two people are listed there twice. It it's an it's an odd development because it looks like they're little teeny tiny lots. And then people have built one house on like five lots.

    Unidentified speakerVoice A

Are you referring to the email you sent about the two parcels?

    Kathryn StarkeyVice Chair

    Yeah, so then

    Unidentified speakerVoice A

    they are

    Kathryn StarkeyVice Chair

    getting like five ERUs.

    Unidentified speakerVoice A

    So

    Kathryn StarkeyVice Chair

    So

    Unidentified speakerVoice A

the methodology I I responded to your email with the with regards to those two parcels. They

    are

not combined. They are separate parcels, so they are separate assessments. The assessment is based on the size of the parcel and the zoning. So based on I had staff recalculate that and the calculations for those two parses that you emailed me are correct. So although you may have Um just a simple example. Um I have one acre, you have one acre, it's zone yours zoned for ten units, mine is zone for one. Your assessment will be greater than mine because it's based on the l the

the entitlement, what you can bill on.

    Kathryn StarkeyVice Chair

No, I understand that, but there's only one house there. I I went to the property appraiser's website. And there's one house.

    Unidentified speakerVoice A

It's not it has nothing to do with the number of hosts. So they can

    Kathryn StarkeyVice Chair

down zone themselves. It's not about if

    Unidentified speakerVoice A

they want to down zone they can. Well heck

    Kathryn StarkeyVice Chair

yeah, because theirs is seven thousand nine hundred each.

    Unidentified speakerVoice A

If they cure the down zone they can't.

    Kathryn StarkeyVice Chair

And it's one house. So it's one it w should be one ERU. No and that's all over the place in there. So that's a problem.

    Ron OakleyChair

Commissioner Yeah, each unit's gonna take an ERU. No, it's not a good thing.

    Christina Fitzpatrick

I had someone address uh uh citizen address that's a good idea. Commissioner Starkey. And they were actually there was two ERUs on one lot and it was told that they could rezone it. But then they're not gonna be allowed to ever build and it's gonna depreciate their value. So if they wanna convert it to one ERU they can do that. But later on they can't just keep flipping back and forth and later on and say, Well, I want it to be five and I wanna sell off each lot.

    Kathryn StarkeyVice Chair

Yeah, so then then they would have to they would get assessed another ERU. Because We've had this happen in my district where there was someone on say a five acre lot and um they were getting hit with five ERUs and we told them they could down zone it to one. And they'd only pay one, but if they ever wanted to split it, they would get hit with an assessment. That's true. But what maybe I'm wrong, but when I looked at that house It was one house on like Four

    lots.

    Unidentified speakerVoice A

Yes, Commissioner. So just one comment on that. So if the entitlement is say four Dwellings, four houses. but they only have one existing. the methodology allows for a reduction because they do not have the additional three. So we we're not fully assessing them for four ERUs.

    Kathryn StarkeyVice Chair

    Okay, there

    are

a lot of people in here with mul with mul with addresses that are right next to each other on the street with multiple assessments. It's it's all over the place in here.

    Unidentified speakerVoice A

We follow the methodology, the policies, and the guidelines, and for the two examples you sent to me, I had staff recheck their correct and I responded to your email. Well I think.

    Kathryn StarkeyVice Chair

I think I think you know, we made this mistake in Aristida. that some you thought th there was there was uh in the plat, an ability to have larger lots, but Originally, but then they were all Downsized, but they still got us some people got assessed for multiple ERUs, even though the the Homeowners Association rule said only one house per lot. And so it was remember it? And you had to throw out that first.

    Unidentified speakerVoice A

And this is exactly why the moment I got their email, I had staff double check it. So I'm comfortable with the calculations.

    Kathryn StarkeyVice Chair

So you think that there's a house on [address removed] and a house on [address removed]?

    Unidentified speakerVoice A

There's two houses. Yes. One's a mobile home and one is a more permanent structure.

    Kathryn StarkeyVice Chair

Okay. And that's the same all through here? With all these things.

    Unidentified speakerVoice A

The only two I double check was the two that you sent to me, Commissioner.

    Kathryn StarkeyVice Chair

Okay. All right. But I don't think it's gonna go through anyway.

    Mike Moore

    I can't vote on this

    Christina Fitzpatrick

    one.

    Mike Moore

I'll make a motion to deny.

    Christina Fitzpatrick

    I'm in because I've had

    Mike Moore

    double second.

    Christina Fitzpatrick

We only had one person here last time.

    Mike Moore

    No, we already went there.

    Christina Fitzpatrick

And rejecting, although I had a room full of people here that night. Now My two concerns are Worrell Drive and Adonis are both dirt roads and have you been able to my photos were right below the other photos from Cypress Drive because my meeting was with Lake Warrell and then I had a meeting that night right after.

    Kathryn StarkeyVice Chair

My brother is very bummed. If he can't drive this moment to his house

    Christina Fitzpatrick

    after

    Kathryn StarkeyVice Chair

    the storm. Okay.

    Christina Fitzpatrick

So my biggest concern, that's it, if you want to stay there for a second. This is on Broad Street and Adonis. Now Adonis is An unpaved road. All of the dirt from Adonis and Worrell Drive run. East. to the end and then they back up everywhere. So if you want to move forward

And then I think this is Warwell Drive. So I actually had two citizens that said they own property on both north and south sides sides of World Drive. And they w actually wanted to see if they could get Don't uh transferred.

    Unidentified speakerVoice E

    Vacated.

    Christina Fitzpatrick

    Vacated.

    Unidentified speakerVoice E

They wanted the road vacated. But that can't Can't that's can't be

    Christina Fitzpatrick

    that's

    Unidentified speakerVoice E

    not yeah, that's not part

    Christina Fitzpatrick

    of

    Unidentified speakerVoice E

    this.

    Christina Fitzpatrick

So but that being said, they wanted to pave it. So I would be okay going through with the project if Adonis was included because you have all of that debris and they have to go out and grade this all the time. So if they're gonna continuously have to go out and grade Adonis. I just have concerns with that.

So it doesn't their their dirt doesn't run down the road, that'd be a different story. But if you keep going through the photos Because that road isn't included. This road isn't even included in the paving, but all of their dirt ends up at the bottom. If you want to keep moving forward please.

    Is this an alley? Was

    Kathryn StarkeyVice Chair

    that an alley?

    Christina Fitzpatrick

That's Warrell Drive. So if you have your This page out.

    Ron OakleyChair

This is not part of a PVAS?

    Christina Fitzpatrick

This okay, so this neighborhood is part of the PVAS, but World Drive This road specifically In the middle right here is not.

    Ron OakleyChair

    That's not covered.

    Christina Fitzpatrick

Isn't covered. But the res the those two residents said they would be willing to pave it. Okay, if you want to keep going. Now on the other side of this road, it runs down into this drain. And then they're creating a Well if you go back.

They were creating is that swale on the other side? A burn. And then the water would go into the lake.

Is that the road? Okay. That's going in to where the berm would be and then into the lake in the back. And if you want to keep going forward, we should be on Cameo at this next point. This is cameo.

    Is that the line

    Kathryn StarkeyVice Chair

mark coming out of the road?

    Christina Fitzpatrick

    Uh

    Kathryn StarkeyVice Chair

    yes.

    Christina Fitzpatrick

There's there's nothing there. If you want to continue.

So they actually put p pipes underneath in two of these areas to get water from one side of the road to the other. And that was permitted. But this is their road. And if you want to keep going north on Cameo? Is cameo and sunrise. And that's their road. And you can keep going. I went up through Cameo.

And then this must be a d no, this is still on cameo. This is all the dirt that comes from Adonis and sits on cameo. And when you back up you're actually gonna see the Tilt. Because back then they had the roads that were inverted and then the water went underneath and then it went off to the side. Now all the roads are Uh no. Opposite of inverted.

You can keep going. But this is on Adonis and Cameo. If you want to go back to that photo.

And then that's the curve. But this is still the road that's getting paved. So if you want to keep moving forward. But that's my concern is Adonis is all this dirt is still gonna continue to flood down and get stuck on this road. Adonis isn't even included. Although they said Adonis to be included would Be Cost prohibitive. So we're going in doing part of a project here.

    Kathryn StarkeyVice Chair

    Maybe not. Yeah.

    Christina Fitzpatrick

    Well it's a start.

    Kathryn StarkeyVice Chair

They're all gonna be dirt roads after one storm.

    Christina Fitzpatrick

    Yeah.

    Ron OakleyChair

Does anybody sign up to speak on the side of?

    Christina Fitzpatrick

I had the one gentleman that said that he actually would have preferred to have Warwell Drive, but they also said that was prohibitive, cost prohibitive, but they were willing to pave it themselves if we would vacate it to them because they're the only two owners on the north and south side of Warwell and no one else has access to those roads. But that is uh that's the road right there.

    Ron OakleyChair

    Pleasure of the board.

    Christina Fitzpatrick

    Move to approve the PVAS

    Kathryn StarkeyVice Chair

    second.

    Kathryn StarkeyVice Chair

And there's there's no one objecting.

    Kathryn StarkeyVice Chair

Um didn't Commissioner Moore have a motion?

    Mike Moore

Well I I mean it was to die earlier, but no

    Kathryn StarkeyVice Chair

one seconded it. It died for a lack of second.

    Jack Mariano

    So we didn't get a

    Ron OakleyChair

we didn't get a second on Mr. Morse. Uh but now we have a

    Kathryn StarkeyVice Chair

second on d staff's intelligent expert approval.

    Christina Fitzpatrick

And I think it would really fix Cameo.

    Jack Mariano

    More discussion, please. More discussion?

    Kathryn StarkeyVice Chair

    Yes.

    Jack Mariano

    There's

    Kathryn StarkeyVice Chair

no one opposing it. Not much more.

    Jack Mariano

    No, I

    Kathryn StarkeyVice Chair

    I understand that.

    Jack Mariano

But um I'm listening to uh uh Commissioner Fitzpatrick talking about Adonis Road, I'm listening to about World Drive. What about Fair Avenue? What's the deal with that road?

    Unidentified speakerVoice H

    I mean.

    Jack Mariano

Is it that is that a dirt road? It's not in the list. I'm just wondering why. Probably not the dirt, right?

    Unidentified speakerVoice A

Um just to remind the board, the roads that are included in the projects. Other roads that were chip sealed. So we did not include any other pro uh any other roads in this project. So we were directed the roads that were chipsy should be brought back to be board initiated.

    Jack Mariano

Forcing just what what's done here. You haven't got any objections Completely different from The last one we just had, right? Dramatically different scenario. We know we're not gonna go do the neighborhood the best way we can possibly do it. I don't know why we just don't pull it back. Go do all the roads, go out to the residence, do a p get a petition leader out there, I'm sure you can get one. Yeah, let's Try to do it all right. By

    Christina Fitzpatrick

    the

    Jack Mariano

    ordinance.

    Ron OakleyChair

You're saying but do it by the ordinance.

    Jack Mariano

    Yeah,

    Christina Fitzpatrick

    the

    Jack Mariano

    regular way. By the

    Ron OakleyChair

    ordinance. Yeah. Okay.

    Christina Fitzpatrick

It's not gonna go through. Half of the roads are flooded and half of 'em.

    Ron OakleyChair

Yeah. I have a motion. To approve and a second. All those in favor say aye.

    Kathryn StarkeyVice Chair

I I made the motion. I did. Oh no, I made the motion. Commissioner

    Christina Fitzpatrick

Fitzpatrick. Commissioner Fitzpatrick. I'm looking up that street.

    Ron OakleyChair

    All those opposed?

    Mike Moore

Isn't somebody not a label to vote in this?

    Christina Fitzpatrick

    No.

    Ron OakleyChair

    They voted. I'll probably

    Mike Moore

put somebody not able to vote on this one.

    Ron OakleyChair

    No.

    Mike Moore

    Oh I was wrong, full

    Unidentified speakerVoice E

    board vote.

    Ron OakleyChair

    Full

    board vote.

    Mike Moore

No, I don't know now. I thought you said that's what you said earlier than the next one or something.

    Ron OakleyChair

Well let's do that again. I have a motion on second to approve the project. All those in favor of the project. Going forward. I say aye.

    Kathryn StarkeyVice Chair

    Hi.

    Ron OakleyChair

All those to not approve that. Nee,

    Mike Moore

    nee,

    Ron OakleyChair

    nee.

So it fails to pass uh three two. Thank you. All right. That includes everything on the agenda except for um some very short comments.

    Kathryn StarkeyVice Chair

    We don't need
