Locationally we're in northwest Pasco County in Commissioner Mariano's district.
The overview here is a rezoning petition from AR Agricultural Residential. to prospective MPUD master plan unit development. The prospective development would be 63 single family homes. All product types are 60-foot wide lots with 120-foot depth on approximately 34.24 acres. with related infrastructure.
The northernmost boundary of this project abuts Hudson Avenue, the southernmost boundary abuts Firefox Drive.
The property retains its original AR zoning. The immediate surrounding zoning types are AR, AC agricultural, and MPUD. The current density of this property is one dwelling unit per acre, allotting thirty-four units by gross acreage. Granted approval of prospective Sackleson Hudson MPUD, the property's density would increase to nearly two units an acre or 0.54. The increase in density is appropriate for the growth of this area without exhausting existing
infrastructure.
Our future land use of the subject property is residential three. Residential three dwelling units per acre. The permissible maximum development by gross acreage would be 102 units. This project seeks a maximum development of 63. nearly half the permissible by total gross acreage.
By our context map, perspective Sacklin Hudson is appropriate for the growth of Hudson, considering their immediate neighbor approved MPD Palm Wynn. approved for three hundred and nineteen homes. The grading of this neighborhood has begun. The paved portion of County Collective Roadway, Colony Road, ends at Firefox Drive. with the development of Sackleson and expansion of Colony Road, is to be constructed from Hudson Avenue to the project entrance.

Sackles in Hudson will convey one hundred and twenty four feet of right of way consistent with B C C P D and E study of fifty two in Colony from Hudson Avenue to the south Eastern Project boundary.
The maximum development of 63 single family homes will retain one product type, with the typical being illustrated here, with a 60-foot wide lot and 120 feet of depth. Next, I'd like to show the binding conceptual plan.
The development of phase one of colony road expansion Is the development of a 62-foot-wide two-lane roadway from Hudson Avenue to the project entrance. With a Dedication of 124 feet for ultimate development of a four-lane roadway. Additionally, the applicant has conveyed to Pasco County from the project access to their southeastern boundary. The first one. For
future development of Colony Road.
The stormwater pond located at the Hudson at the intersection of Hudson Avenue Colony Road is creditable. The two southern ponds were essential to the project. Therefore not credible. Uh internal capture of the residents is a priority. In lieu of a western vehicular connection, the applicant has committed to heightened um internal Pedestrian capture. Although faint on the binding concept plan, there are trail connections
to the north and the southwest of the project connecting to their sidewalks.
Landscaping requirements and prospective Sackleson Hudson Hudson, MPD here. Per condition of an approval number twelve come directly from PM twenty-six being the two trees per single family home, one of which required along the frontage. Next I'd like to show you the Connie exhibit.
Shaded. From Hudson to Project Access. is the sixty two foot expansion of Colony Road. Hudson to the south. eastern project boundary is the total conveyance of 124 feet of right away. The credible pond is also shaded at the intersection of Hudson and Future Colony.
The typical of the sixty two foot wide two lane roadway is at the bottom of This exhibit.
Two variations have been applied for in the design of Sacquis and Hudson, the first being 901.6.D point eleven street design and dedication, the applicant prioritizing pedestrian mobility and safety by their design.
In lieu of a western vehicular connection, they've heightened their internal capture and walkability, as before mentioned, by the trail connections and sidewalks. The second was to reduce the right-of-way width from Colony Road, originally 160 feet wide to 124 feet, consistent with BCC PD ⁇ E study. of State Road fifty two in Colony, file name PMA zero two Zero four two.
This agreement was also confirmed by our county's transportation engineering department.

Barbara WilhiteI don't want to be repetitive of of the PowerPoint because that was pretty um specific and exhaustive, but this is the location of the project. This is the um concept plan that you saw. Quite a lot of care putting into this, a lot of work with the TED, TED Department, new name. Transportation engineering department. um with regard to colony and accommodating the county's four-lane vision road, pretty significant vision road going all the way from 52 to um Hudson and then beyond. Um
our density is sixty-three single family detached the larger lots, what what I hear my builder clients say is the built the um step up. But at a sixty foot lot. The current comp plan allows 102 as the maximum density, so about half.
This i is a pretty good context of of what the board has approved um for palm wind. the shaded in the orange are the forty foot lots, shaded in the we can call that cream, I guess. Those are the fifty foot lots. Consistent with that we have we have do have single family detached, but we have the larger lots of 60 feet by 120, which will complement their product mix and provide an additional product mix.
These are the um some of the renderings of the homes that my client DRB off is going offers in the area and will likely offer here. I think they're very nice.

And coming back to our concept plan, we can't if if you can go down so we can see the So we do have a connection to Foxfire. Um, and I imagine that may be some of the comment from our neighbors. We'll see. But I wanted to explain that. Um Foxfire is a standard road, meets the county standards, and we have included the connection because it's a land development code requirement. The Board of County Commissioners in 901.6 D 11
have Have made um continuation of existing street pattern a priority. I can tell you in every one of my MPUDs it's a priority, not only with the staff in implementing it, but also when I get before the board. So that's why we have a connection to Foxfire because it's a standard road and the code requires it. Um I do have my team and we'll see what uh the neighbors uh what kind of questions and comments they have and we'll be back to uh talk further. All

Jen Kerouac, [address removed]. Um the the concern that I have and and really it's with you know continued development in regards to this And other areas as we know Um Florida statute, the governor signed into law at 125.02 public camping and public sleeping. And as the person and
individual that night by night as folks come into the church, and we're thankful to be able to do it, we partnered with the county and we give thanks to them for that. But it also brings kind of like to the forefront and again the same with the last I've I've watched and uh many apartment complexes many these are very nice homes I have I have I do not deny that they're beautiful Um, you know, but the concern
is is that we continue to develop and part of the development process is my understanding is, is that the county has to also do their share uh um with regards to all infrastructure and whether or not um this has been and it it appears to be a very um uh uh a big stress on the county. I went to the budget meetings, you know, people are concerned
about their taxes. Um and so as we continue to do these things Um And there is no area at this point. I'm I'm not hearing a lot about affordable housing. The apartment complexes are like eighteen hundred bucks a month for a one-bedroom apartment. You know, these homes I'm sure they're not gonna be like within most likely a hundred, two hundred thousand dollars. I don't know, that'd be great if
they were. were but I'm sure and and I understand all that. My concern again is and with regards to the connected cities moving for and as I've been before each and every one of you and the Board of County Commissioners asking for that building moratorium so that the county can catch up. And you know again it is not to to say that the county's not doing what they're supposed to do, but the rate of growth that Pasco
County has, and they say we're the third largest or fastest growing in in the nation. I mean there is a lot that goes with that with regards to roads, vision roads. They say it's a vision road. Uh they've called Shady Hills Road a vision road and when I went to the local Disadvantaged Transportation Board planning meeting uh They said that the one woman said Shady Hills has been uh a visionary road since I think she said 1992
when she first took her position there. So again, this is a you know concern of not just mine but many people. In the county.

I have thirty-six acres left. of our original hundred and fifty acres since nineteen fifty three. A lot of you guys know where I'm at. So My main thing is I'm here to talk on the Sackleson
property because I use so much of these roads connecting. I see the fatalities, I see the handicapped people with no sidewalks, I see no lights. I see mothers taking their kids to the school buses, stops with no lights. It's pitch black. If you want to go on that map, I enjoyed you getting into that with the map and the connecting roads. Mr. Goldstein. When you brought up the maps. Can we bring up one of the maps on the aerials?

Oh it's backwards. It's the operator. Operator error. All right, forget it. I'm not I'm time I I don't wanna lose my three minutes. Anyways, tropical breeze was not supposed to cut through to Fairwinds Road. Disappointingly, Captain Starkey s came up here during the c uh Board of County Commissioners meeting and said we're gonna put a gate there. It held up the project for three months 'cause they had to buy the property. And I wasn't trying to delay the project. I wasn't trying to be difficult. But they made it. the developer buy that property and then connect at the
fair wins. Fairwinds Road cannot sustain this. They've already got Maxfly, which is where the new Meadow Oaks entrance is gonna be going out at Hudson Avenue near the church. Okay. So you've got Hudson Avenue to Maxfly, Maxfly to Fair Winds, Fair Winds to Banyan. Ban you into Sugar Creek Boulevard to fifty two. We just had a fatality at Sugar Creek Boulevard in fifty-two. Okay. I know I'm sure there's been more. Then you got Fairwinds Road going to Colony, Colony to Fox Fire, not
Firefox. Peachtree to Hudson Avenue. Now we know those S curves guys on Peachtree and Foxfire are brutal. A friend of mine flipped his car there years ago. Um The flooding is another issue that we need to look at because I don't know some of you old timers remember. The original Hudson Avenue was Hamilton Road, which is now Suave, which comes into the Angeles. That's where Palm Road or Palm Development exits on that S curve, which is extremely dangerous. They've already widened
it and it's already uh just gonna be a mess in the hap in the um in the making. A couple more features. The twenty fifty and I go to all the twenty fifty meetings, I've been on the CAC, I've been on all these meet committees. Colony Road is a vision road. There's no funding, but yet they keep stacking these new developments in there. And they're choking us out, they're causing flooding. People's peace and quiet. We're gonna lose some of it, right? I don't wanna be New York City. I didn't live here in Pasco my whole time to be like New York City. But There's
some of these developments. I got eight developments in our immediate area, guys, from Hudson Avenue to Hicks Road. to Hayes. eight developments. That's over a thousand homes that are just right there with no infrastructure at all. The other issue was Meadow Oaks was approved like fifteen years ago. And then when it was approved it was idled 'cause of the economy. Well they just went ahead and put their plans in and started developing the two hundred and sixty-five homes And then you had You know, Taylor Morrison go, you have this one and all these other things.

rumor that the Girl Scout camp is pending sale. That could hold 200 homes. And in closing, our crystal ball that we all look at is the flooding that happened in Trinity this last time. And our concern is like we spoke about the traffic and I moved here from Tampa to get away from traffic and it's everything is just growing at a rapid rate. We already have one subdivision being built down the street. And my thing is when you come out on colony to 52. If you if you're going west, you got to go all the way over to the third lane to make a U turn.
It's not like the traffic light is there. So with the traffic building. We already have an issue when you get there waiting to go out to make this U-turn. When you come home, same thing, you got to make a U-turn. to come back down to Colony. And then on Pea Tree, Pea Tree goes out to Hudson Avenue. Same thing. No traffic light. You're just sitting there waiting. for the traffic to clear, for you to make the right or the left. And it div it's already increasing
with the amount of time it takes us to get out of our homes and get where we're going. And when they put all these homes in our traffic is gonna be I don't see how we're gonna be able to even leave home and get back home. And then we have kids that walk to the bus stops and things and there's no lighting there. So it's a lot of issues for this small area to take on all this extra these extra subdivisions. And then I'm definitely concerned about the the flooding. Once they add any subdivisions.
And they could tell you during the last two storms, we did not flood. We did not and if they start putting these subdivisions in, where where's the water going?

Aluminum horse trailer It's gonna be fun for me to get in and out. Even the fact of My animal's making noises. Who's gonna call and make complaints? agricultural. That's gonna be residential.
I have children that walk down the road to the bus stop.
There's no lights. They leave at six thirty five in the morning. Do I stand out there? Most of the time.

And the same thing going out off a fifty two. And yes, I do cut through Shadow Ridge sometimes. Right. But there's been a lot of accidents there, so I don't usually do
that. I usually will do the U turn if I'm gonna go up like when I take my daughter to school at Classical Purpery.
MoodySo there's a lot of accidents at Shadow Ridge in fifty two too. Yes, sir. Because people can't make a left turn from colony road onto fifty two.

This has been a long time dealing with this and and I'll tell you, you know, some of the things they're not showing on that map is uh if you bring that map up just a little bit more, there's another hundred and eighty six houses in a subdivision going right at Fairwinds. So that is all cleared out. Um about Four months ago when they were still doing the landwork
they hit a spring and flooded out everybody on the other side of 'em. All right. Now, with that being said, Um I'm up on a corner. Right. caddy cornered from where they're trying to come out for Foxfire Drive. Now it's called Shady Oak R uh Shady Oak's Ranches. It is a small neighborhood. But um The reason most people purchase there is because It was Shady Oak's ranches, it was small, it's zoned agriculture and you must have one acre or more to build. So when
they talk about it's mandatory that they have another exit to come out of Foxfire Drive. The problem I have with it is If you're gonna make an exit to go out Colony Road to Hudson Avenue That means that the exit or whenever they get ready to connect colony road. The builder doesn't have to pay for that. The taxpayers do. All right. So they're gonna go
and buy this property out So that it costs them less money to inconvenience us. and it changed our way of life. That's not right. And at the end of the day With all this building going around, we've already experiencing the flooding and the extra water and stuff in the ditches and around our property. It's not settling in. Now there's at least four of us. on the corner and around the corner they're having troubles with our septic tank because the water's not draining the way it should because of all the developments. Now, I don't
know about you, but I know a new septic tank if you don't put a lift station in is over ten grand. You know, w why should I have to pay for that? Why they sit around and get rich off of building all these communities and inconvenience at everybody else. That means I'm gonna end up having to call and uh get flood insurance eventually. So With all this being said,
I don't understand why they can't connect. From Colony Road and connect it back to Colony Road, and that gives them their entrance. Therefore, we don't have all this traffic shooting out on Fox Fire. Let them pay for something for once. You know what I mean? But I thank you guys all for your time. I know my time's up. I don't wanna steer in another direction, but there is so much going on here and so much wrong with this that it really needs a second and a third look at. And I believe that extension that they're buying these people's

But When you build all this and you move all that darn, it changes the flow for the people that are not moved. That's the reason when you guys do your
flood Planes, it changes about every three to five years. Why? Because the people that have been there for fifteen or twenty years don't move. Everybody else does. So therefore it causes flooding inland. or in the areas that don't you know, that are still lower because you're building all these buildings up. So that's part of the problem. Because now the water is sitting there. When you have a rainstorm, it doesn't want to seep into the ground anymore. And I believe that's what the problem is.

Um some of my neighbors and myself are opposed to the planning housing development that we believe will cause um more traffic and safety problems, um, possibly destroy local wildlife in this area and potentially lower our property values. Um So concerning the traffic and
safety, uh just to add on to Ms. Harris, um as we do could go out the that way down Colony to 52, uh I do work in Newport Ritchie, so I have to make a U-turn there and I usually typically go down Moon Lake Road to my job. Now there's a stop sign. On there and there's three lanes of oncoming traffic that have fifty five mile an hour. speed limits.
Um typically Um it's it people travel uh higher speed limits down there as I see. Um so that is a concern of mine as well. Um trying to make that U-turn. It would be awesome if uh you could possibly put a light there or maybe a four-way stop. Um to help with um some of the difficulty as to coming out on to fifty four uh fifty two. I would also like
to speak about the wildlife. As I bought I bought my place five years ago here as a single mom, I w was looking for some acreage, do have a one-acre lot. I could have bought in a brand new uh housing development, uh, but that's not what I want. And from my life or my kids. So I have property here, and just this morning
I'm
teen peacocks in my front yard. Um I see owls. Um I also have uh woodpeckers. Um so I I'd I would like to request um that maybe an investigator be appointed uh by appropriate agency to investigate uh the area for endangered
this how this development starts um building. Also I'd like to talk about the property values.
I was disappointed to to see that this entrance is going to be within walking distance of of my driveway.
I'm also concerned about the flooding in the area as well. Um, I mean I do have a manufactured home on my property that sits up, sits up high. I've never had to worry about flooding. Um But I I am concerned with uh the building of this development, having to build up the land back there. Um so the this development is uh is right behind
my home. Um, so I'm concerned about that as well. I do ask uh you to take um into consideration these things um that I spoke about and my neighbors as well. Um Thank you so much for giving me this time.

Barbara WilhiteGood afternoon again. Barbara Wilhite for the applicant. One thing I I want to make clear is that our entrance is off of Hudson Avenue. We are constructing that portion of our entrance actually we're constructing to Colony Boulevard Vision Road standards. But our entrance is off of of colony and we're constructing that entrance off of colony. We are interconnecting to Foxfire because the code requires us to continue street patterns. under nine oh one, section nine oh one of the code. With regard to
wildlife, we had to do a wildlife um assessment at the time of zoning. Staff is going out and very carefully. Um I know there's a staff person now that's been hired on county staff that's going out and checking. checking as well. And then when we come to do a preliminary development plan and develop We have to redo that study because it's only good for eighteen months. if there's any gopher tortoises, there's a whole process because they are protected for gopher tortoises. So there's a lot that goes on with regard to
wildlife. There's a lot that goes on with regard to stormwater as well, as our many engineers here on the um on the the board know.
Lowering property values, the these homes will be expensive homes. Um The other thing I would point out is that you and you can see the development pattern that's that is coming along. You can see palm winds actually has smaller lots. This this is the res three land use designation. And as Mr. Wynne said, he did participate in the cap the comp plan for these areas, as did I, as did I. That would have been in 2005-2006,
probably, the last time we had a CAC for a comp plan update. Obviously, there's now the 2015 update going. This area was is designated Res 3. This prop this this is not rural. It wasn't designated agricultural. So when you see that in the comprehensive plan, you see an area designated Res three, you're going to see this type of development. Actually, and we are at the lower end of the development with what we're proposing because we're proposing the lots. We are going to be
on, we will not be on septic, we will be on water and sewer. There's water and sewer. The infrastructure is already there in place for us to have water and sewer to this project. Again, that's an investment in infrastructure that's been made. Um So we will be using that investment. We will be continuing the investment by extending and paying to have water and sewer in our project.

What am I gaining by having that little entrance on Fox fire when f Colony Road will be kinda the main Road. I'm I'm not understanding the purpose.

When you have an existing street at this a that's a standard road, the board's regulation that the board adopted says that you have to connect your streets to that existing street. And that is what we are doing. We get the comment all the time. We get asked by it by the the staff gets asked. They can speak for themselves. They get asked about it all the time. Did by the board to enforce this section of the code.
MoodyI I understand that and I understand it's in the code. But I I can think of examples. throughout the county. And I'm thinking about even somebody who buys in this neighborhood. So I live out here. I go up colony to Hudson Ave and I make the hard left ninety dangerous ninety degree turn on Fox Fire and Peachtree and I'm not sure how that's standard, but Nonetheless.
And when I'm going there. It's usually 'cause I'm headed out towards Hayes Road or trying to get over to Shady Hills Road. So why would I drive all the way down Fox Fire, make a hard right turn on Peachtree, to make a hard right turn on Hudson Avenue to go back toward Shady Hills I could just cut right through this neighborhood. think those people in that neighborhood would like me cutting through Making a shortcut out of their residential street. And I can see where we've done
this in the county all over the place. I'm not saying it's your developer's fault or your fault. Think about Fox Hollow Drive. Or Jasmine Boulevard. Mm-hmm. These were nice residential. residences that faced Jasmine or that fronted on Fox Hollow Drive. and now they're cut through streets from US nineteen to Little Road. In both cases.
and the people's lives, the people's homes Who front those now cut through streets, are not well maintained. Nobody there with nobody wants to live there that has children because they're going to get hit by a car.
You've got You've created de facto highway through people's front yards that were quiet little neighborhoods. So I understand the code may require it. I question some of the wisdom of it. I understand why one might want to create a grid network of streets. But I don't think we should do that at the expense of people's peaceful enjoyment of their property, I mean When I see this I'm concerned for the peaceful enjoyment of the people who might buy on that street that connects to Foxfire
because I know I'm gonna use it as a shortcut, because it's gonna be a while before colonies connected. There's There's a s section between Fox fire And the end of your property. That's all one and two acre parcels back there that Unfortunately, you know, nobody's gonna come in and develop a one acre MPUD down there, so that means the county's gonna have to condemn those properties to ultimately to Make that connection. I'm actually even questioning I know it has nothing to do with your case. What
the heck is the point of making Colony Road a four lane roadway from nowhere to nowhere? Then you can't make a left or a right turn. You can't make a left turn when you get to fifty two? I'm trying to figure out what is the purpose of this. Somebody saw a black line on the map and said, Hey, let's put a four lane road here for what purpose?

So now we've made a highway out of a parking lot. over to the entrance of Shadow Ridge. My personal preference when I look at this thing Is that Would the developer would
would you as the applicant, assuming the board didn't enforce their continuation policy? Would it be a problem just to make this an emergency access only?

And The board basically overturned it and said no it's going to be full access and in that case They had to go out and buy property to make it a full access. That's not the case here. I mean at least they don't have to go buy property. And by the way, I think Fairwinds is not a standard road.

It's been around a long time. But if we don't have an Connectivity to Foxfire. then our our way to get to colony is via peach tree. So again, that's why the board does this. The Board has this policy because they want traffic to have different ways to go.

That's great. And it works great. Jamie, in your neighborhood in River Crossing Boulevard, where homes do not front on River Crossing Boulevard. That continues the existing street pattern, it gets you out to Starkey, it gets you out to Decubelus, but it doesn't destroy the peaceful enjoyment of somebody's property. What I'm saying and I understand this has nothing to do with you or your development is that particular policy when we take it down to the residential street level destroys people's
quality of life. Go look at Fox Hollow Drive. That's that's the one of and Jasmine Boulevard. That is one of the poster childs for making a residential street a cut-through street. street. Destroys the property values, it destroys the aesthetics. It's not a place where families want to live, and I question that policy. I'm not criticizing this development or you or your developer for following what the code is, I'm saying
to the staff and to the board. if we're applying that policy to the point where it's a detriment to the value and the peaceful enjoyment of people's property, then we need to relook at the p the that policy.
And I've said that here before. The other thing I've said in here before. When we were talking about palm winds and I think it's Brighton Park or whatever the name of the D R. Horton development is down there at Fair Winds and Colony. That the developer managed to flood everybody out while he was digging his retention ponds there for a few weeks?
You're putting all this traffic on Colony Road, Has anybody been down to the DOT and said, How are we gonna undo this mistake we made 30 years, 40 years ago? When because we didn't like a nudist colony, on Colony Road that we cut the access off to Colony Road to give an exclusive access to Shadow Ridge. Well now we're getting all this development on Colony Road. And we got a whole we're planning on making it a four lane roadway down between
Hudson Avenue and fifty two. and there's no way to make a left turn. Everybody's forced to make a U turn. And I'm gonna t and I realize you don't you guys don't control what the D O T does for decisions. I live right around the corner and I use Lakewood to get out to fifty two and you just cut off our access there too. so that we can have an exclusive left turn into a three story climate control building that literally has zero traffic and now nobody in our neighborhood can make
a left turn out of any of the connecting streets in our neighborhood. We can't make a left turn to go get groceries. We have to cut through the parking lot of a Dunkin' Donuts and a family dollar so we can get over to Shadow Ridge and try to make a left turn out there and to the ladies point, If you've ever s I I'll to in fact tonight I'll take a video of that and send you as you see twenty cars piled up in that median opening and there are nonstop accidents
there. That needs to get fixed. I'm not against development of this area and I understand it's res three and eventually there probably will be more development. But somebody needs to be looking at from a long range transportation planning, what you're gonna do. These houses are imminent. Somebody needs to fix that intersection at calling it fifty two. I don't know whether that's the county or the DOT or you need to work together, but some transportation planning needs to happen here or this is gonna be a major traffic disaster.

What are you gonna what are we gonna do for all those people there? Just think about that we did that with Little Road. How'd you like to own a residence that used
to be on Plaza Drive and Posh Golden Acres and now you've got a six lane roadway as your front yard?

Yeah, th these kinds of problems happen all over the place, bec like Belcher Road, Clearwater. They were that was a residential road. You know, and You just can't foresee sometimes in the future. But obviously, you know. Colony Road, in my mind. would be a natural connection going north. Because it's always Uh but you gotta do it, you gotta put it in and you gotta put the light there to m to to really accomplish anything. And that's what I'm saying.
We got a future, we got a vision road there, but w what's the vision? When is it going to be done?

It collects uh development basically and directs them either to additional collector roads or to the ar arterials. That's what's happening in the case of Colony Road here, where Point A is actually in the midst of Hudson and State Road 52. It's all the neighborhoods that are linking to colony. And those
people then are able to get out to the collector road on Hudson or the Collect or the Arterial Road down on State Road 52. Um that's the main function of the of the collector itself. It's not unusual that homes open onto collector roads across the country, even here in Florida and in Pasco County. Um the the thing that I would add is that You know, if congestion is a concern, one legitimate solution to congestion is actually creating more connections and creating
a wider network. If this development were to connect Foxfire to uh Hudson Avenue, uh that would only add to the network of roads that are doing exactly the same thing, which is Foxfire to Peachtree, Colony to Fairwinds, even fairwinds to I think I think it's um Meadow Gulf Avenue to Win Lane. I'm looking at it from a very high level here. Anyway, the point is that there's a number of connections that are gonna
lead up to Hudson Avenue. So Keep that in mind in terms of what a collector can do and how congestion can be mitigated. Um I'm sure that Today we do not build collector roads that f that have residences fronting onto them with driveways, et cetera. Um but in the nineteen eighties it certainly was the case when these neighborhoods were developed that Colony Road was forming up to collect all of the neighborhoods,
including those residents that were fronting onto it.
MoodyWell, I've been here and I can tell you where Colony Road is and why it's named Colony Road. 'Cause it goes to a Dudas colony. That's why it's there. That's what its purpose was. It wasn't built as a collector road, it was built as a road to get to the nudest colony. Which I understand may be for sale now, but

This is a rezoning request from AR, Agricultural Residential to Master Planned Unit Development and PUD to allow for the maximum development of 63 single-family detached homes and associated infrastructure on 34.24 acres. Just south of Hudson Avenue.
Here's the location map south of Hudson Avenue.
Like I mentioned before, this is for 63 single family detached with the minimum lot size of 60 feet by 120. And associated infrastructure on that 34 acres in the northwest of Pasco County in the north market area.

Of the location of this M P Um just to the east we have the Palm Wind MPUD that was approved about a year, year and a half ago for three hundred and nineteen single family homes that extends all the way down to uh Sheik's Road from the north or from the south all the way up to Hudson Avenue. And this shows Firefox Drive and the current end of Colony Road.
This M PUD with this master plan will be constructing a two-lane segment of the future colony road to their project access and then dedicating the rest down to the southern boundary as well as dedicating right of way for a connection from the Palm Wind imputee that can be sh that can be seen on the arrow there on the bottom or the right-of-way for Colony Road extends south.
A couple things with the the binding conceptual plan on this one. Staff worked with the applicant to ensure proper pedestrian circulation throughout this project. It is faint to see, but the applicant did provide A pedestrian interconnect. to the northwest as well as to the west in lieu of vehicular connections as they're seeking a variation from nine oh one sixty eleven street design and dedication requirements. those pedestrian interconnects flow through the entirety of the project as
it's currently laid out. To ensure uh proper pedestrian circulation for if and when those pieces of land are ultimately developed. Can can

also continue along the the regular residential pattern. For if you're not going to be able to Um that property is developed. The reason a vehicular interconnect wasn't provided there, there's a significant elevation grade change that didn't permit um vehicular access, it wouldn't have been safe, but a pedestrian access would be feasible.
These are the exhibits for the colony road improvement that that hatched lining showing. the portion of the road that's gonna be constructed by the applicant for their project access. It's gonna be the the two lanes of the ultimate 124 foot segment that was approved by the the PD and E by the Board of County Commissioners some years ago, as well as the rest of the dedication of the 124 feet down to the southern property line. that pond of its highlighted up at the corner of Hudson. Yes. That
pond is roughly.
As it's gonna be holding uh water from Hudson Avenue and this uh this Vision Road. the the rest of the pond sites aren't credible.
Like I mentioned before, the variation from nine and one sixty eleven street design and dedication requirements In lieu of those vehicular connections Um to the west, we provided enhanced pedestrian mobility in lieu of that connection. as well as a variation from nine oh one two I, which I just spoke to Uh originally this was Uh expected to be 160 feet of right-of-way for Colony Road. After P D and E study was approved by the Board of County Commissioners, it was determined it needed to be reduced. To
124 feet, and this is consistent with that BCC route study for 124 feet of an urban cross section.

Staff did a very good job going through the details, so let me kind of just highlight a few things. I mean you can see our project here on Hudson Avenue. We always know where the schools are is important. So we've measured we've measured how far they are. They're more than two miles. Um our kids will be bused to those schools. This is the site plan which um William showed you. Showing we did a lot quite a bit of work. This one took work as well because we have a a Vision Road coming through. So we worked
with um the County Engineer and the County Attorney's Office on ultimately how we're gonna design um Colony Road. There was a difference between your right-of-way tables and your adopted PDE. So we are using the section from the PDE, which is a little different from your tables, but the PDE is more specific than your tables. We will be doing Colony Road, our portion from Hudson Avenue to our entrance and then donating the rest of the right-of-way. We will also there's also a little sliver which
David Goldstein caught at um at Planning Commission to make sure that Palm Winds, which is to our east, w can connect to future colony roads. So we actually have a little bit of extra right of way that we're gonna to um You convey as well so that palm woods can have connectivity to to uh colony road. Ultimately the land use in this is for this property is res three, this whole area is res three. Which allows a maximum of 102 units. We are
proposing 63. Current zoning is 34. We are also proposing 60 by 120 foot lots. Those are 7,200 square foot lots. Your R4 district, which is your most dense district of a the Euclidean district, are 6,000 square foot lots. Ultimately, again, talking about this area in context of developing the development and the growth in this area. You put a vision road in, which means you're com you're looking to have growth. You have a res 3 land use in
all of this area and central water and sewer. In context. In June of 2023, this board approved the Palmwinds MPUD, which you can see our project, how it complements. The Palmlands MPUD has 40 and 50 foot lots, 313 of them. Their gross acreage is two point six seven dwelling units per acre. To complement that, we are proposing sixty by one hundred and
twenty foot lots here at one point eight dwelling units per acre. So we thought it'd be important to see how the two projects fit. We will be providing a housing type that that's not um being provided over at Palmlands. This is D R B. Uh the client is D R B and they these are their elevations of some of their products. We included this because I think you'll find these products to be, you know What they call these are things step up, the sixty foot lots, the seventy two
hundred square foot lots, and and this is the step up renderings.
And with that, I know there's some public comment ultimately I n I would tell you that One of the things that probably will come up, which maybe we'll just talk about now, is that We have provided the interconnectivity that's required by the code. From our project to Foxfire Drive. Foxfire Drive is a standard county maintained road meeting your minimum standard requirements. Got asked a lot about this at at Planning Commission and I ultimately my answer is that Your
code says it. I get asked about it all the time, obviously. We just talked about connectivity for a while there. And that the reason why we have connectivity to Foxfire is that your code requires it. So it's 901.6.11. It allows for Additional traffic circulation, additional way way for traffic that's coming from the south. They don't have to go down Foxfire and then go over to Peachtree Road. They ultimately will be able to come through our project. providing different ways to get to Hudson Avenue, which is what your code's
encouraging, and that's why we have c the connectivity to um Box Fair Drive.

The the typical section that was approved in 2002 had five foot sidewalks, four foot bike lanes. and twelve foot travel lanes. I think what they're now showing is four uh they I think they've mislabeled the bike lanes as eight feet instead of four. And they're showing a reduction from the travel lanes that were approved in the route study in 2002 from twelve to eleven. Honestly,
I I would love to have a a more protracted discussion with the board about what the typical sections should be that we are typically that we're going to construct on our Vision Road Network. There's a twenty nineteen resolution that the board adopted at that time directing my predecessor to build roads with on-street bike lanes every time we touched a road. And and then a twelve foot path on one side and a five foot path on the other side. If the board wants to revisit that, we can certainly bring alternatives back for
consideration. They do have implications with respect to comprehensive planning because we establish a footprint for our vision road network based on the components of the road that we expect to construct.

palm wind. You guys crammed palm wind through to fair winds. Um There are three different hearings. On the third and final hearing, you guys did not allow public comment. You went back, you day di delayed this ninety days. He'd opened up in the fair winds. Where we have no sidewalks. We have mothers and fathers walking their kids in the mud to the school bus. We have no infrastructure. We have fatalities at colony in fifty-two. We have fair winds now connected
through the colony. Bumper to bumper, no light. No street signs, nothing. You guys do a field trip and come to our neighborhood and see how it is. Um so I have a question about that. Um As you can tell I'm pretty heated. When Palm Wind was originally approved, it was approved for 305 homes, but now it was 319. Where did that change and who did that? There's twenty-two homes right now there. What I want to know is how the Shoman
property is being rezoned aggressive. into this development. This is a place called Shady Oaks Ranches, and it's comprised of thirty properties that are agricultural. These families invested They have animals and this is gonna affect code enforcement big time. So now do we have to now not be able to shoot? Not be able to clean. work out there on our property, have a bonfire. I was silenced by the county and to do a burn on my ag land Because of
the new development. So if there's ever a bonfire from some of the neighbors and it spreads through my pine tree forest, am I now liable? That's it that's unacceptable. I'm doing all my property to preserve my agricultural heritage here. Um I'm requesting a 90-day table this. Because I think you owe it to the residents.
Fox fire And Colony Road. Colony Road is a major issue, guys. We all know it. And then th this is an invisible road. Colony Road needs to be handled by the builders, not by the taxpayer or anything else. So all this development that you're bringing in there were not properly planted. And I'm gonna keep complaining on all my committees. Infrastructure, infrastructure, infrastructure. I also go to all your meetings The twenty fifty plan. I think that's just a pile of you know what. Because
I go, I draw little trees on all the pastures, I draw little animals, all the things you guys tell us to do as citizens, we put our time in. And it's ignored. So I know I come up here hostile. I'm not against development, so understand that. I want proper infrastructure. Thank you.

This is really gonna affect our lifestyles. I I didn't buy into a neighborhood, into a subdivision per se. But it's being brought to my doorste literally to my doorstep. Our properties Are parallel. Probably exactly across the street.
I've got kids that go to the bus stop. My son almost got hit two weeks ago. Because Of the traffic already. Because you opened up um what is that neighborhood called? Not Shadow Ridge? Meadow Oaks onto Fairwinds.
Now they come over and they they're gonna go to Hudson Avenue, so obviously they come up Colony Road. Foxfire, Depeach. The traffic, it's already there. Just from opening up. And I don't even oh, I think that was opened up maybe three years ago. And then I heard about the poem. I know I'm not sure if I have that. proper neighborhood that y'all have been talking about Home Windsor something. That comes all the way from Hudson Avenue
to Fair winds. Hmm. So obviously there's more and more traffic and now you're gonna have an entrance From a subdivision. Right directly on Fox Fire Drive.
So there's two main topics is the traffic. M my children aren't safe for walking. God forbid if one of my goats or sheep get out there. Or dogs? Uh how many people are gonna stick their hands over I've got horses. I can't even go horseback riding anymore. I bought out there. 'Cause we did go horseback riding. There used to be places to go and now there's nowhere. I don't dare to go out there with the horses. 'Cause you have all these cars and do they go around
you? No, they only go around the school buses. But school buses are going too slow. And the road's not wide enough legally to pass, in my opinion. So that makes for dangerous.
And I've been there twenty five years. When I first moved there, we did go riding down the road. And it it was nice now.

But Palmwoods and this are both affecting the traffic patterns in our area. Um I am concerned about the infrastructure and not being able to support the traffic that this will add. We have a bus stop literally outside our property. There
is one little boy that gets picked up on that blind corner on the S turn. And I am concerned every day for him. Um I don't think that we have the infrastructure to support even more without a full study of some kind because this is getting crazy. Traffic is getting busy, it's getting insane, it is dangerous for students walking. for everything and yes, we bought in a rural area. We have seventeen acres. We're rural, our neighbors were rural, and now it's not
being that way anymore. And I know people are building, and I know people are coming into the community, and that's great for support. But I am concerned over the infrastructure for the whole area just because of these traffic patterns. There's no lights, there's no Sidewalk on Hudson Avenue. And that's just the north side. And I know you're talking about further south, but it's gonna be coming north. And that is our concern. Um, not only for the community, but my residents, because my residents

Um In the twenty fifty year plan, Colony Road was set Slated. to run all the way through to
Hudson. Now with that being said I've been living in that spot that I built my house. on three acres for Fifteen years. And when I bought it until right now You must have one acre or more to build. And Shady Oak Ranches. With them buying that piece of parcel. that connects into Shady Oaks Ranches. is a violation as far as I'm
concerned because now you're taking away the credibility of our one acre and up plots. which is losing value to our houses and our property. Now, with that being said, in a twenty, fifty year plan, I was gonna build another house on the other side of my property. But permitting wouldn't allow me to pull permits for the simple fact that I was in the twenty fifty year land uh plan for colony road. Now with that being said, I see all these buildings going around me that the permitting and the
board is allowing to build. But yet They won't let me build anything on my property because that roadway is in a twenty-fifty year plan. Now, if you actually look where the road comes out, the only thing that they're going to do is from out their subdivision and up to Hudson Avenue. There's another way. They didn't have to try to have this piece of property built, they could have ran straight across and ran as a second outlet to the road that they're showing there
that's not even a road, it's just a connection. That is about Mm, I'd say a little more than five hundred yards. That they can tie into Colony Road and make that an easier pathway straight to Hudson Avenue, like is in the twenty fifty year plan, instead of running everybody through our neighborhood. We already have a hard time getting in and out. The traffic is ridiculous and the subdivisions are not even done yet. You're talking thirteen thirteen hundred houses and possibly more because there's more subdivisions around us that have already
been proved approved and it's it's just absolutely ridiculous and the traffic's getting worse and worse. Every time a car or a big truck goes by my house Everything in the house shakes. You know, and and you know, you guys have a plan, a vision, twenty fifty, but you don't stick to it. You inconvenience everybody else. Thank you very much for your time. I do appreciate it.

taxes for all the time that we've lived here? What about the people that have contributed to Pasco County? You're pushing us out to bring new people in, and it's not fair to all of us. We where's the give where's this give and take here? You're taking, taking, taking from Pasco County residents, but you're not giving us anything back. And again, main point, that's my home. You gotta go right through my living room. That's not gonna happen. You cannot take my livelihood. You can't take my life away. You can't take my home away. This needs
to be reconstructed, redone, and uh It needs to be re-looked at so they can plan another way to put they can go colony road straight up. Why do they have to go to the corner like that? Why do you have to go through my land? Why do you have to go through my living room? Why can't you just go straight up? I mean I don't care about your sidewalks. I don't care about your little ponds. But they're hard working people like me and they just can't be here 'cause they're they're doing their jobs. I moved here for the greenery. I'm okay with building, but when you start pushing out animals and you create safety issues, just like last uh I think it was November of last year, headed to work and all of a sudden what do I see? I see a child who's struck
at a bus stop. And why? Well he was fatally uh injured because people are are going around trying to avoid these traffic lights. They're going through our subdivisions and they're speeding, they're not paying attention and struck 'em and killed them. The pedestrian traffic, I run these calls every day. Nobody else runs these calls. I see these calls. Pedestrians are hit more often than you would know. Um, but when we start pushing out wildlife, you know, we have the sandhill cranes is if you see two sandhill cranes together, they're like a married couple. They will mate for life. So then when you see one
just walking around all lonely, it's because it will no longer mate for life. Because they're being wiped out. The gopher tortoises. They create homes for 350 other species of animals. And what do we do? We put concrete on top of them. And it takes them about a year to die. So they pretty much starve to death. We got migrating birds. We have deer, raccoons, all being killed. There's uh even talk about a black wolf. Look up a black wolf. Apparently it was extinct for about 100 years, but now we're saying we're seeing them in our areas because they got nowhere else to go. Uh Knox
gas. All these extra vehicles are creating extra pollution that we're sitting in in traffic. You know, I was just in Belgium and people there cough non-stop because of all the NOx gases coming out of our vehicles. What are Knox gases? Nitric oxide and nitrogen dioxide. Are these the things that are causing cancer as we sit in 'em and US 19 as we can go longer get anywhere? Uh smog and astray come from those two things. Infrastructure. US nineteen. I can't do it anymore. Getting my kids every day from Tarpon Springs, which I'm already late getting them, because I'm here to
speak for everybody who cannot be here. Fifty-two is still two lanes, yet we're worried about all this other stuff. You know, w what about our water, our power? You know, nobody's thinking about our you know, people like me, right now, uh, you know, I got a septic tank that won't drain because all this increased building is pushing it more towards me. You're you guys are elevating your lands, you have the money to do that, I don't. Um what happens, you know, in a state of emergency when we need to get out of here. How the hell are everybody going to evacuate this area when these roads are deadlocked? And
what happens with people like me is everyone already mentioned, you know, we want to go shoot, we wanna have our cows, our horses, have our kids have what I had. you know, years of having land, our kids are on phones all day. Instead of being out in nature, that's what they want to do and everyone's pushing towards that. That's not what I want. I don't want to see, you know these houses packed together and then creates all these issues. Like just like last time I tried to get food uh with all these extra people here, the food just uh sells out even quicker. Uh I don't know when we're gonna stop bulldozing. We need to start preserving
our our resources. That's just me.

And some of these folks have come to the Shady Hills Civic Association meetings, so I felt it important to just advocate uh you know, for their position. Um and just in that I know that most everyone knows of the golden rule, do unto those that as you would have done to yourself. And it sounds as if maybe one of the neighbors is not being as great of
a neighbor. Um those with more land are not more important than those that don't have as much land. the neighbors should be equally and you know, I just most of these projects, the reason why people come and just are concerned and those that are concerned and can't attend because they're working Is because you know they don't know necessarily the intricacies. They maybe there are things that could be
worked out, and then we spend time here, you know, trying to advocate for a position that maybe otherwise would have been worked out. I understand not every situation requires a neighborhood meeting, but Like, come on, let's be a good neighbor. As the gentleman said, Ms. Will Hight uh advocates for many landowners, you know, and and there are like a few that likewise, as Ms. Will Hight. I mean, have a neighborhood meeting, meet with the folks around you, let
them know, see if there's something that you know could be advocated. And I ask that you as As as the leaders in this county, that you would ask the same, that that they begin to try and advocate. and collaborate in a positive way so that you know we can be still remain a good community in Florida.

Sun CoastUh it's an F dot term. It's project Development and Environmental Study. And what we do in uh the case is
a route study is choosing the alignment of a road, excuse me, and the drainage facility locations so that we can actually construct the network needed to move people around.

Barbara WilhiteSo ultimately there's a process you guys go through and ultimately there's public hearing on that vision road and so we we are been asked to accommodate your road and so that's what we're doing. That's why colony road is on our property. Would my client probably like to develop the whole thing and push the road on somebody else's property? Sure. I mean that might be the thing. But no we we were accommodating the road. We were asked to accommodate the road. Your P and E P D and E asked us to accommodate the road. So that's how the road came to be. We didn't choose the alignment We didn't even choose the cross section. We obviously are
going to work on a better cross section. I think one of the things you have to have perspective is that this property since 1989 has all been um approved by the county as residential three. It's a suburban density, three units per acre. Um say that again. Three units per acre is your land use designation for this for this area. It's not just this property. I mean it's all s south of Hudson Avenue. It's a s it's res three. So when you talk about did we Did we look at the community you were coming to?
We did. Res three allows a hundred and two units. Next door, you approved. Palm winds. With forty and fifty foot lots. We didn't come and propose 40 and 50 foot lots. We didn't come and propose 6,000 square foot lots, which are your R4 district. We didn't come and propose an R4 district without conditions. We came forward as an MPUD to exceed your R4 district. And we did that because The client was committed to a quality
project and all of your standards regarding architectural standards and the things that you like to see in MPUDs that if I would have come as an R4 with 6,000 square foot lots. It would just be in your zoning district. Pastor Dan and and I guess they know me by name now. Um You know, I grew up in this community as well and care about it, but when we look at a place where we're gonna bring a project where I look at with my clients, we actually look at where we're bringing that project. And that's why we're bringing forward 633 units instead of
102. That's why we're bringing forward sixty by one hundred and twenty foot lots, seventy two hundred square feet, instead of four thousand square feet or five thousand square feet or even your code that says six thousand square feet.
Where you have central water and sewer where you make those investments in center water and sewer is where your growth is ultimately gonna go. Again, the connection to Boxfire is a code requirement so that you have different connectivity, people can travel different ways, that's why it's there. I would add that you know Commissioner Mariano did mention when I spoke to him, like could there be a disclosure, a written disclosure for our residents that they can appreciate that there are surrounding residents that have an agricultural
lifestyle and I did prepare um a condition And I did run it by it's been such a long day. I did run it by uh Mr. Goldstein and staff. That we could add to a disclosure. So there is that mutual. Our residents know that there are neighbors that have an agricultural lifestyle. So I'm gonna pass this out. Um

Barbara WilhiteWith regard to wildlife, we do wildlife surveys and gopher tortoises are no longer allowed to be just um mitigated on site. You have to move them. quite a process to do that, quite an expense to clients to do that, but they cannot put concrete on them and suffocate them. They have to be moved. And again we have to do all the wildlife surveys and we have to do them multiple times. We had to do them with the MPUD, we have to do them again at Pelomary Plan. They're only good for eighteen months. And then even after that, when we go out to actually start development, your staff
goes out again, and if any gopher tortoises have come onto the site since we've moved them all, then they have to be taken care of as well. It's a condition that deals with any any wildlife that comes onto the site after we start construction. We can't still still aren't allowed to put concrete over them or suffocate gopher tortoises.
I think that's all I have. Um I think everything else we have talked about. If you have any particular questions for myself, my team, level up, my clients, DRB, or Steve Henry, who has done our traffic, uh I w I would add We heard a lot about the intersection of State Road 52 and Colony at um at the Planning Commission. Hudson and fifty-two? Fifty-two. Fifty-two and colony. Yeah, all the way down. I know we're at Hudson. Oh yeah. I looked at it here

So I wanted to let you know that. If you want any more details about that, I'm not the detail person, but I can tell you that DOT is already working on it, knows
of that issue, and they're planning on making that a signalized intersection.

That one. What's the name of that golf course? There there are res there are people in Fox Hollow who have, you know, the the the um solos or whatever or or homemade bonfires in their backyard. And I know I had a resident who was complaining about it. She had asthma. But fully within that homeowner's right to have a bonfire in their yard. So don't if this goes through Don't think that you can't still enjoy your own property. You you cannot raise your hand from the audience. Um but you can still continue to own your Enjoy
your property. So Um

Is that one right there? Yes. So if you look on the right side of that. That develops there much more dense, but that thing connects Down to Fairwinds, which is a lot further to the south. We get a situation where And I'm I'm not I'm not sure what's right to the side to them, et cetera, but You know, all these one acre lots, people are doing all sorts of agricultural, et cetera, and all of a sudden we're gonna squeeze it right in. And the worst part is we're not even allowing for the road Yeah. Well if you wanted
to show a benefit, so be it. But right now you're gonna take all that extra traffic. And those you ever go up there. If you go up Colony Road, you gotta take a right on Fox Fire, you gotta come up to another turn, take another right turn. And then you're gonna thought it's an avido. Ideal. Um And I will tell you I I wish that staff had worked with us closer. Because this development coming in on Palmwind. Had this work with this one better? They could have made that connection to Colony right through their property. Could've gone right along the edge. But That
didn't happen. And that's what we do, that's the type of thing we need to change what we're doing. If we're gonna come into a rural area like this and have development come in, it's gotta work better. Right now. Again, just with the dimensions of what that road was supposed to be. Uh and Mrs. Ericsson, I I looked at your house right there and I'm watching. How can we design a ho uh uh a roadway going right through somebody's house? Why would we do that, especially when we could have gone up a little bit further in the other development and then brought it over from there when we saw we were making a change, not this road where the roadway was going to go? So To
me it's like th these vision roads are tough we're seeing today. But handling this one here. Um to me it it's it's it's it's not ready. Um That connection to Collie Road needs to be done. to take the roadway on Foxfire and just throw more traffic down there? I would rather even see a cul-de-sac or even just a a T section there and just let the people if they're gonna come in there that they gotta go up on Hudson Avenue and that's their only way in and out. uh unless it connects over to the other neighborhood there, but to bring 'em down Fox Fire and up and around.
Let them go straight up and over. They don't need any more traffic right there. These are rural roads. that are are dangerous at night. I mean You know, people have signs up there, they got reflectors up there. It's not a it's not a great scenario. And to tell a neighbor That has a Acre parcel and he can't build another home on the other ACO, but now we're gonna let R 4 come in. What are we doing? I mean gr I'm I'm glad we're looking at the ADUs. That's great. That's a classic example of why we need to do that, but again, you're throwing this High density
in here. And granted, not as higher far harsh powerland, but with no connection that's gonna go until it's gonna fall on us taxpayers again. And I will tell you, just like we found out earlier, uh we we heard earlier today, we don't have the infrastructure in place to make these things come in. So I don't think this one's this one's ready yet.
StarkeyChairI think there is um more property that is coming on the market in this area? That is um I probably can't speak to it, but there's I've heard rumors there's a big piece coming here that's also coming in. They they have every right to develop at R three, right? They're coming in at R four.

Um And also I I look forward to the day when we fix Hudson R Hudson. It needs to have some pedestrian safety features on it. Um and Um I have said here that I think the bus stops Especially when we're out here where there's no lighting and it's dark. Let's
get those solar lights from Metro on here. and put 'em up there. They can't be that much and they're solar and I don't want to see kids sitting at a rural road in the dark getting on a school bus. Um I don't I don't think she we should stop doing connections because a road is substandard. I think we should keep the connections and find a way to fix the road. Because otherwise You're gonna create A gridlock traffic nightmare in the county. We
won't have enough road to support And that that is like planning one oh one is interconnectivity. So Um I kinda agree with you that's too bad colonies Swung to the left, but We had that discussion when I think when Fairwinds was coming in. Frankly I wish we hadn't approved that at forty We should never approve 40 foot lots on that thing. Um this is sixty foot. Those houses are very nice. Uh it's it's there it's I wish we had more developments like that coming
in the county, frankly. Um but there is some work that needs to be done here to improve uh safety. And I I was trying to find where it says Shady Hills Ranch. Was that what it's called? Shady Ranch?

As it is you know, we're we're getting late in in the on this particular item and and and I've I've been taking notes here and I I think we've nailed it down to three key three major issues. One is the cross section of the road, which I think is a technical issue that Mr. Goldstein had mentioned previously and I think we can work through that and come up with um an alternative um section that would meet um the
needs that we've talked about today um and fit that within the right-way. That's number one. Number two I think though from what I'm hearing on the vision road is the specific alignment that we're looking at and the challenge that we have quite frankly right now is that we are Really hyper focused on this corner piece of property. When you look at the whole of Colony Road all the way down to where it's supposed to connect. There is going to have to be a lot of additional property acquisitions, right-of-acquisitions, or any other things like that. So I think that this is a good opportunity
for us as staff to take a look at that and reevaluate that vision road piece. And then thirdly, um one of the things I heard particularly from the community was the concerns with cut-through traffic on this project and Um certainly the project proponent has uh met the code requirements, but I think it was Commissioner Mariano who suggested maybe we have a cul-de-sac at the end of that one piece and really force all of the traffic.
StarkeyChairCan I suggest that instead of a cotton sec we put an emergency exit and so that one day if when Fox fire gets fixed, people who are trying to get home here don't have to go all the way up and around if there's a perfectly fine road. Oh, y you're stressing you're stressing areas to the north maybe when you don't need to, but wait until Fox Fire is improved.
David AllenAnd and I think the the point I was gonna make was that really would require a board action because it's a it's a change from the land development code.
Barbara WilhiteI I would agree. That's why I It's not emergency access only because it is a code requirement, it's ultimately your decision. Do you want it to be a full access per the code? That's what I told Planning Commission, that's why they didn't take any action on it, because they're just they're following your code, but it's ultimately your decision.

So economically it's not a good move for us. I will tell you I was disappointed with staff before with calling the road not connecting up through there. The connections that the other development has coming from fairway, it makes a good connection where they
got two ways to get out to the south. This here is one way and people are gonna go travel down Fox fire, up and over, come back in. Um it just the road's not set for it. We need to go look at what we really can do. And there's a piece of property on the side of Colony Road. If you saw it as like one thin little sliver down, then another thing over. It's unused right now from the development side. On the east side. On the east side that we have to do.

Here is where we First get to some of the changes that have occurred since the the last meeting. The the applicant was kind enough to work with the the commissioners as well as the the residents in the area. The first change you'll notice is the the the cul-de-sac to the bottom there, the applicant is no longer proposing it a an access to Foxfire Drive and this is reflected on the MPD master plan. We also have added a a condition of approval twenty-three. to annotate as such
to allow no vehicular access to Foxfire Drive. We've also added in that condition twenty-three that all construction access is to happen from Hudson Avenue.
The applicant has also requested the in condition seventeen to For a requirement to construct a 315-foot eastbound turn lane, as well as adding additional buffering requirements. along that cul-de-sac there in condition number eight
Which is reflected here on the the binding concept plan that you see that's been updated. Which shows that Cul Deus Act to the South as well as those additional buffering requirements in that packet that I just provided. And then finally a change to the COAs in condition fifty-three. the applicant added into the disclosure agreement in which the the sellers would be purchasing a single home. the Florida Right to Farm Act has been added to that disclosure.
Another major change between last meeting and today was The ultimate right-of-way needed for Colony Road. Originally the applicant was asking for 124 feet, which was the the P D and E study, which was approved by the board. However, a after that last meeting and over the last month The applicant has worked uh to achieve a sixty foot cross section. Instead of that one hundred and twenty four feet.
Here is one of the right away exhibits here showing that that sixty feet of uh of right away in that typical section.
Here is the Mobility Fee Credit exhibit. talking about the right-of-way dedication of the portion of which the applicant isn't constructing, they're constructing that northern portion as well as the credible pond along Hudson Avenue.

Planning and Development staffPerfect and and just to to to go back to the pond, it's it's roughly a hundred and nine thousand dollars in mobility fee credits. that that was agreed to between county staff and the applicant for that point seven acre pond and the point eight seven acres of right away.
This exhibit four is the phase one of Colony Road Extension, which is going to be developed by this MPUD from the from Hudson Avenue south to the project entrance at the aforementioned 60 feet typical shown again below.
This is illustrative of the Of the talks that we had with the neighboring Palm Wind MP in order to change this roadway alignment. staff and the applicant work to to shift this road roadway alignment further east. Which included Roughly.
the current Palm Wind property and a tract that they had currently platted that wasn't being used for residential lot. This exhibit here highlights that point zero eight acres from shifting that roadway alignment over.
Here is a right of way and acquisition visual Showings in red there is that that Taylor Morrison.08 acres of shifting that road over. In hatched orange is that thirty three foot public access right away easement. as well as parcels needed to be acquired on the east side of the road outside of that public access easement owned by the Naturalist Religious Society, and then two individuals in purple.
There are some variation requests with this project, the first being from 9016 D 11. street design and dedication requirements. In lieu of the Western vehicular connection, the applicant has prioritized pedestrian mobility and safety in their design. And provided uh those additional pedestrian connections.
both on the north along Colony Road to the uh to the parcel there that would will now be at the corner of Hudson and Colony, as well as to the parcel to the west through the corner lots.
And the the second variation is is from that BCC P D and E study, of course, taking it originally from 160 feet. to one twenty four but now down to sixty feet to accommodate Um the the ultimate build out that the BCC s feels is appropriate and that PD and A staff feels is appropriate.
With that that comes to you with a recommendation of approval. From the Planning Commission and from Planning Development Economic Growth staff, I'm here for any questions.

connection that then gets to Hudson Avenue. The reason I was pushing staff not to have the connection to Foxfire was just because of so much traffic so close to the intersection. Um
When I look at the roadway that's going to come through their property. Um I will tell you I have a hard time saying to them why they're not building it. because they don't need it to connect, they have it. But if you look right to the right at over in Palm Winds, if you see all the development right there, They have set themselves up to connect up to the north and they did a very good job connecting to the north. Their other connection going to the south uh connects over to the side another roadway. Um But a lot of those people are eventually
going to want to connect over here. And I think it's better for traffic flow if we move that forward as opposed to not. So As you can see with the impact fee on the last page of the last thing that um Barbara had just handed us, it shows the mobility fees don't cover near enough to build the road. And I'll have staff maybe if they could comment. How many impact fee on palm wind? and how many on Brighton Bay down below that are coming into the area.

Sun CoastGood afternoon, Commissioner. Nick Uren, County Engineer. Uh wanted to mention that uh as Commissioner Mariano and I had discussed this morning, the way we do development of our capital program is by forecasting impact fee, rather mobility fees that will be collected within each of our three zones. over the five year period and then allocating them to projects that are warranted for construction based on how busy the roads are. Uh and so while I can't answer your specific question regarding How much will they generate
and how much will it cost to build Colony Road from Hudson to State Road 52 at this point in time? We're we're working on those answers as we speak. Um what I can say is that we have a plan to consume to build roads within zone one with the mobility fees that we're anticipating to collect. So the idea is again on a zone level we collect fees and then select projects for board approval as part of your annual capital budget. We do not
do small area planning where we say these mobility fees from this project should be used to build this road that is right next door to them. Unless that road is essential for access to the property, and then we work out relationships with them for mobility fee credits. So unfortunately I I don't have a specific answer to you other than to say It would cost more than they are generating in mobility fees and we have a plan to spend all of the predicted mobility fees that we intend to receive or hope to receive in this zone in the next five years.

Development cost per linear if it was two thousand total development cost and I think it's just building the section that's being shown right there. I'm just r at this point talking about to that connection right there. to what it would cost. And it's got a difference of in excess of the mobility fuse two point one million. So i I I I I thought you would get it from me but I did ask Terry to get it too, so Um If Terry can come up with those numbers to what those impact fee generated between this project the next project. The mobility fees are paid upon issuance of COs or prior to issuance of COs for development. that money gets aggregated together within the entire western zone. uh which is zone one in our mobility fee system. And then we use that money for capital projects to create capacity, add travel lanes for cars on projects within anywhere within that zone. So again, the zone is a large zone. Penellas
all the way to Hernando, uh Gulf of Mexico to and I'm gonna Gulf of where? Eastern.

If we were to allocate mobility fees to this um to this corridor instead.

So the calculation of mobility fees has a lot of variables built into it depending on the type of product that ultimately gets picked in terms of the square footage of a house, for example, that might get selected by a buyer or or the builder. Nevertheless, um I I these are just kind of back a napkin. Um but this is this Sackelson MPUD and the Palmlands MPUD are in a rural standard mobility
fee assessment district. And just taking a um One thousand five hundred to twenty five hundred square foot single family home. as our baseline Um For three hundred nineteen units in palm wind, it's about three point five million dollars in mobility fees. And um Again. that's that's variable, that can change. Sure. But uh and then back on napkin on Sackelson you're looking at uh a again for
a one five one thousand five hundred square foot to twenty five hundred square foot single family home. uh about seven hundred sixty thousand dollars. But again, that's variable and that can definitely change based on the product that they end up building on the various lots. Okay. And what about Brighton

MarianoVice ChairSo S Sackelson would be seven hundred and the others about five point two million. And the reason I bring that up. I'm not looking even to if we ha if we can't build the whole road. I will say that this development coupled with the other two uh it would do a lot for the area to have that flow going up. Because that flow is coming up especially from Brighton Bay down below, it's coming right up that way to go out and you don't want them taking that turn every time on uh Foxfire and then the turning back up on Peachtree, you're just looking for trouble. This
would streamline it and would we've made this where it's a vision road. If whatever the time the vision to to complete it would be right now, even if we're just making the connection it might build the whole road out, which would need to be down the r down the road. So If you do this as well, it might make these other things sell better, which will generate more money for the area anyway.
YeagerI do I have one comment. If you could pull up um fifty two and colony
So when I was meeting with the citizens um residents, they one of the things they were worried about was um people are making a left onto Shadow Ridge Boulevard and cutting through Um that little building with the with the parking area. So I reached out to F Dot to see, you know, if there's been a study or where they're at to see if we can get a light on colony M fifty two. So I'm just waiting to hear back on that.
But again if that road connects that would be that would be great.

Barbara WilhiteWell there's your update. Barbara Wilheite, 6327 Grand Boulevard, Newport Ritchie for the applicant. Your staff too has done that research um coming at about fifty two in colony coming out of planning commission. The information your staff received is that they have 60% design done for redoing those intersections. Um And that they will it's designed for a full median so it can be signalized if there's enough development. So they're I'm glad you're reaching out because it's happening right now, fifty two in colony.

MarianoVice ChairBy the way, as you get as as you get started, Barbara, I just want people to know that, you know, sometimes it's tough to make things happen, tough to get meetings with folks, et cetera. But I want to say, Barbara, the you and the applicant were fantastic when It came to trying to meet before this meeting was going to happen. Uh they came at 5 30 on was it a Thursday or Friday night, Thursday night, uh with the residents where they could all meet, talk, and it was great dialogue, which led to a lot of these changes in the discussion we're talking about. So thank you for that.
Barbara WilhiteYou're welcome. It was a very productive meeting and and we did a lot of things I haven't seen done in MPUDs for a while. So I kind of want to show off what we came up with. with um that will make a difference um when we develop this project. One of the things that was we heard over and over is no access to Foxfire. So as you can had you seen from William's presentation, a cul-de-sac's been added to the MPD plan and the Binding Concept Plan. And we have a new condition that talks about no vehicular access to from the project in
Foxfire Drive. We actually have language that goes on the plat. Um to make sure one of the things the bet residents said to us is in that meeting was like, Well we don't believe ya. And not they don't believe me, but they don't believe that things won't change over time. So it's actually gonna be platted in a manner that that access won't be able to be granted in the future. So it's a sure it's a sure thing. So that's what condition twenty-three that we added that you can kind of see that we presented there. I was told that I have to request verbally because this meeting happened last Thursday, so trying to update this paperwork
and get all these technical things done has been a you know a bunch of work, but it's worth it. Um I have to request the variation to not have that connection. So I added that to my third bullet there. So if that you're so inclined to agree that That a cul-de-sac is better, then you you just agree that then staff can update the paperwork to include the variation in my bullet there. You've seen this from uh William's presentation.
All constructive this was Commissioner Mariano's idea. All construction traffic shall access from Hudson Avenue and a requirement for temporary turn lanes. So saying there's gonna be no construction traffic to or from Fox Fire. And then also when we get up to Hudson where Colony joins Hudson where our access will be making sure that we front some turn lanes, temporary turn lanes, so our construction vehicles will be off be able to get off the road. Whether it's they're turning left, they'll have a dedicated left that they can get in, so the travel
lanes keep moving. And the same thing with the right. And then condition says we have to do that before we can bring any construction um equipment on site and start construction. Again, have not seen that in a very long time, so I think that's a a good addition. We're not required um by traffic warrants to do an eastbound right turn lane on colony. By traffic warrants we're only required to do a left turn in But at the request of the District Commissioner He'd asked us to to
voluntarily add a right turn lane, so we'll have a permanent right turn lane as well. And that's the condition that you've seen added up here.
A lot of discussion with the neighbors. What do our buffers look like? For example, on our southern Foxfire boundary. We've added a specific landscape buffer there and a specific buffer detail that exceeds the code. We went all the way around our property and exceeded the code with requirement doing buffering, a minimum of 15. To our east, where one of the neighbors that attended will be doing a 20-foot buffer there. Our plan is binding, so for our neighbor that That's to our south
and to our east. She's got a pond to her north, and that's will be a pond. So there will be no adjacency there.
This again is the detail for the for the Fox fire buffer that's says exactly what we have to do, what size they have to be. Pretty detailed um requirement there. Again, binding, it's on a binding plan.
A lot of this is a I haven't seen a disclosure like this. Again, Commissioner Mariano's idea to to have a disclosure to all of our residents that we do have neighbors that that have agricultural pursuits. And discussion of actually it was uh Commissioner Penny Commissioner Moody's idea to add the the uh Florida Right to Farm Act. that their properties are protected by that. So if they neighbors in our our uh project call the county The county will be able to tell them, look, you had a disclosure, you know that you have neighbors that have agricultural
pursuits. This is the conversation that the commissioner was having regarding the properties that are needed. Um so I included this information. This is what the county would need to do to take uh Foxfire, excuse me, to take colony all the way to Foxfire. So that's what's listed here. There's a couple different property owners, three different property owners the county would work with, as well as um there's some easements they would need to do a the board would need to do a resolution to use those easements as a common law dedication per your county attorney's
office. You've seen this is this is the um shows those properties. And I just want to mention one thing.
This is the alignment that the counties came up with. We came up with it together. We we our team provided facts and research. and the county team took the research and said, okay, we'd like to we'd like to go 60 feet in this alignment. But when I did the MPUD, not knowing exactly how you wanna finish this road getting down to Fox fire, we put sixty feet at our our southern boundary, our southeastern boundary. So whether you ultimately go this way or you go another way to
make that that connection, I want you to have the right-of-way regardless. And that extra right of way between what this what it would have been, which is basically nothing at our southeast corner, and now what we're gonna give is sixty feet, we did not seek any credits for. So that was just a conveyance to to try to let you guys have your options and we didn't do something to zone our property in a manner that you don't if we're closed you doing it one way or v versus another way. And then you've seen this, which is the cost, not including the um right-of-way that need to be
acquired, but these are the cost of of getting colony from our access down to um Foxfire. You can see the cost there.
And that is what we have. Just remind you, you know, this is a res three land use. We've obviously went through all this before. Res three land use um allows 102 units. We're proposing sixty-three. Current zoning is thirty-four. Um so it's well below the density that was envisioned for this area and which our neighbor over at Palm Wynn did do a higher density, uh more in line with their comp plan versus this one, which I think complements because now we have a product, a community that's gonna have the larger step up
homes in this area. Um And that is what I have. I'm available for questions. I have my team here.
MarianoVice ChairI've got uh two comments and something th we didn't talk about but reading the full agenda item um Conditions on fifty two and fifty-three. Um I'll read it as a disclosure statement regarding the future construction of Hudson Ave and Colony Rolls shall be included in all sales contracts of residential sales with the MPD. This disclosure shall include the roadway's number of lanes in construction If applicable. I'm just wondering why the if applicable is in there.

the definition approximate. If it's right next door, that's one thing. But part of the reason that we're trying to like be concerned this whole area all the way out to Peachtree as it's all rural, so it may not be right next to the property. But there's still the effects of the could happen. for the next lot over even if you bought the bordering land to go further. So Are you okay if we get ri get rid of that?

Our front yard's gonna be the new developed colony road, our backyard's gonna be these new homes and we're concerned about the quality of our well water as well as how many
people do drive on that very dangerous turn. There's constantly accidents that come in. One of them knocked over a power line recently, so It's a little chaotic there. and how many people are gonna be driving down that road regardless and the fact that we also have to do the U-turn and the U-turn to get into Colony Road is taking longer and longer every like month I would say. So we would really like that to be considered because I do have a three year old, we have chickens, we have dogs, we have me

Um, I know myself and my family and friends are very invested in finding balance in the inevitable growth within the appropriate areas. Um I've been in the position um that the woman in front of me has been in before with a a a proposed increase um across the street. Um my neighbors and I
shared our concerns in during all the rezoning requests and The builder ended up changing the request from a larger quantity of homes to a less quantity of homes in an undesirable layout. While we continued to voice our concerns over that layout, it ultimately ended up being sold to one home and maintained the status of our current zoning. I'm asking you to take our concerns within all
of these communities very seriously with respect. I have serious concerns regarding the disruption of our native flora and fauna in all of our area, the displacement of wildlife and their safety, the numbers of dead and dying that we're seeing along the roadways on a daily basis. basis um the declines in some of our uh wildlife What will those mitigation solutions be? What are the mitigating solutions for tortoises
and burrows? Um we have the the current construction that's already going on there that is moving um moving our wildlife. And and then this will add to that. The increase in traffic on the two-lane road of Hudson Ave, which is already getting more and more congested with construction that is already occurring in addition to what is coming up. I do understand that growth is inevitable. But please consider

and even though I don't agree with you know I don't understand why this has to be built. Um, you got plenty of building around there. It's just gonna affect so much. It's I just I don't agree with it, but I understand that things happen. Um The one thing I do wanna bring up is uh what is very important to me Is um
Wildlife. Um I've Florida used to have a um what they call a black wolf. And uh It was done probably a hundred years ago since anybody has even mentioned or seen it. And here recently Um we have caught what we think on video as a black wolf. And If anybody wants to see it, some of you have seen it. Um I'm working with F W C right now and from what I understand there is other sightings um in Pasco County
and uh they're not a hundred percent sure what it is, they know it's not a fox and they're not a hundred percent sure that it's a coyote. So, um they are doing the research on it. And that's something to me that I think should really, really be uh looked over and paid attention to because you know if this is something that was supposed to be extinct um a hundred years ago, I think we owe it to them to at least step back and look it over and see what it is. Um and as far as uh the road Um
we have no idea of when that road would go through if he was to build this.

I am gonna say I don't I know our road is not substand it is substandard. It is nowhere near standard. It was an experimental road. Fox fire and I believe also Peachtree. 'Cause they were all dirt limerock roads when I moved in. And I understand the man over here. in the third seat down said that there's not enough money. that's gonna be developed from this, to build roads, you know, and the money's already being I want to
use the word divert it to another area. was the money counted that's supposed to be coming in right off of Hudson Avenue? There's I believe over three hundred homes. And I don't know the name of it. I just know it's across the street from the Girl Scout camp. I think it's being built by Black Sumph. A developer. But is those numbers being added in? because they're going to cut through off of Hudson Avenue. And it's
only common sense that makes this. They're gonna come in. Turn down peach tree. Just like everybody else does to hit fifty two. they're smarter to do that than they are to go all the way down to Hicks Road to turn on Fifty two to come through several more lights, which is an extra fifteen minutes. Just to get it. where Colony Road is. So the traffic is that that's a guarantee. I I'm I If
I have to suck up and allow zoning to be done in my neighborhood I'm not trying to be mean. But I think somebody else needs to kinda suck it up and make this road happen to get it off of our Not standard. Road.
And I think that's fair. I don't get everything I want. Well I don't think everybody else should either. I bought there. I own it. I've had ag for twenty five years. I have bought steers from Mr. Oakley.
I've driven out to Date City. I've bought numerous steers and I believe I bought a heifer.

I didn't not enjoy my drive to Dade City, Commissioner Oakley. Good afternoon, elected officials. We are back to discuss this Sackelson proposed development. Like I said, I would like to thank you for meeting us today and beating us for this week. One commissioner
refused to meet with us. And they're not here. This is Bayonet Point as a single family dwelling of thirty-four point two four acres. Most importantly, the Shoman parcel which you guys have addressed would connect to um Foxfire. Yeah, we met with uh Barbara Wilhe, we met with the the builders. We appreciate that. Commissioner Oakley, you give us three hours. You even drove out and saw the Brighton Park disaster where we have a drain to nowhere. Um Fox Fire like you said, I
don't wanna keep beating a dead horse here, but Like I said, we know Fox Fire's an issue. We know Colony Road in 52 is an issue. We know people are cutting through Shadow Ridge. Uh we know the general store. I was hoping he was here today. You know, he would have some play in this because when you're turn on the colony on the fifty two from colony, you don't know if they're pulling into the gas station. There's no turn lanes. There's no deceleration lane off of fifty-two onto colony. And I don't wanna see another disaster. I don't wanna see another fatality because it it's you know, it's just we we're losing people every day in our county. Um
I am proposing Hold on to your hat, Finance Department. I'm proposing the mobility fees for a 10 mile radius. to be isolated from the point of the Sackleson development out. So that means Shady Hills development, everyone, we get to share this money, okay? The Blackwell one on Hudson Avenue uh across from the Girl Scout camp. We got a new development that's being cleared. No one's even talked about that across from Lakeside. Um We know the connections, um, I think, or
I know, that we want to protect Bridget. It's important and and the other young lady was here. but we need to connect the Colony Road down to behind Bridget's house. And we need to connect it to Sharon and we need to connect it to Palm Wind. We all agreed the last time Palm Wind was a disaster Um it it made the other development hold up for 90 days because they had to buy that parcel, which was supposed to be an emergency exit, but they dumped it on fair winds. Um And then uh the attorney, Miss Will Hight,
she said this can be a binding contract. Well who's gonna bind it, who's gonna sign it? Because Ever since that exit. Did not come through on Fair Wednesdays' emergency accident. I don't trust anybody. Okay, I'm just gonna be honest with you. I feel like I was duped by Commissioner Starkey. Because it changed. And um and my my ag land, which we've had since I keep telling you since fifty-three and I'm a I'm very, very honored to be able to carry on the family tradition there. But that really, really messed up fair winds. I had wished the other lady
was here today. I saw her with her daughter waiting for the school bus. She actually got her school bus stop moved closer so she didn't have to walk the colony in fifty two and stand in the dark. So again, sidewalks, get ADA compliant. Clean up that Brighton Park. Protect the residents on Fox Fire. Um get that Colony Road extension and thank you for your time.

So Most of my concerns have been talked about already. My particular one is the well water with all the construction that has been going on. I've seen my quality of water change already. That's from Hudson Avenue all the way around.
The wildlife is another thing on the proposed property to be developed. It is close to the power line easement. That's where all the animals go through. Within the last three months I seen one dead deer close to where um where the power lines hit Foxfire. When I came here to my property forty years ago There was abundance of animals. I had rabbits on my property, fox squirrels.
Owls, everything. They're all disappeared. Used to watch a bobcat run up and down. It's gone. Anyways. My main concern is Colony Road.
I don't know how to I I mean you you said that the roadway would come in off of Hudson Avenue, but I don't know how the utilities would get there. Nothing's been spoken of that. Water, sewer, they're gonna have to be fed by that. All the neighbors have got wells and septic tanks. The other question is is they bring that water and sewer down. To connect up. How are they going to get in there? And will we have to connect up because it's
there and because the the cost of bringing it up there. Um
Is it gonna affect Or taxes. on our property? Is it gonna uh affect the Designation of our land. I mean I live on an agricultural piece of land now. I've raised chickens, I've raised hogs. My neighbors are raising chickens. We even had uh a woman that had animals that were rescued come in and rehabbed and released.
We have a school bus that runs down through there. And like they were saying, the experimental road starts at Fairwinds and goes all the way out to Hudson Avenue. So that would all have to be changed out. How long would that take? How long would we div be disrupted? Mm. And Brighton Park. They've added so much sand and dirt to that property that they've raised it up above
Colony Road. and when Colony Road was paved. That was raised up above the properties. I'm a little worried about some of the flooding that might go on. I know when they paved Black Walnut street, they raised my road. sixteen to eighteen inches. And that caused water to come on my property and erosion. And I don't know if this has been in consideration. So these these are some of the concerns that I had. I mean

You all ready? We the people let county commissioners to represent us, us the people. We do this so they can represent our best interest when we cannot be present. My vote put each one of you here today. However, we feel we're not being represented in a manner that represents what we want. We are asking one Of you to hear our every one of you to hear our petitions. We clearly object to further leveling of trees to keep our area healthy, quiet, and safe. Commissioners, if I say this to you, values, integrity. We work honestly and fairly with the public, each each other, compassion. We are empathetic to the
circumstances and needs of our customers and teammates. Teamwork, we develop and strengthen relationships with our stakeholders. As we share talents and resources, achieve common goals. We would all agree that that's why we got into the public service to help all. We have quietly watched as car washes filled our communities. We have seen massive lots that are housed that once housed deer in Turkey now be cleared for numerous storage facilities. We have seen headshops replace empty banks. We all will do it while breathing in increased levels of pollu uh pollution. The citizens in this room and at home watching ask the question, Will I be represented fairly in this? How about
the young lady worrying about possible imminent domain and her losing her house? Wildlife is diminishing. My yard is full of everything that has lost its home. Does anyone know how many species that are either threatened or endangered in the state of Florida? Thirteen fish, four amphibians, twenty reptiles, thirty-two birds, twenty-eight mammals, thirty-six invertebrates. This is a total of a hundred and thirty-four species. How many of these are on the land that we blindly bulldoze? Last time Barbara confidently told me no gopher tortoises were harmed during the bulldozing concrete pouring. Where is our proof? Where's the archaeological survey? including
arrowheads that may be on these lands. The only reason I saw the public notes is is because I stopped to pick up litter. Such a big decision, such a small sign. We need a wildlife corridor. All of Pasco's neighborhoods become racetracks. They have become new normal traffic patterns. Gated communities are no longer private. These are all now shortcuts. The news traffic is dangerous and scary. Little people lost their lives while waiting their bus to go to and from school. Imagine not call your loved one died at the bus stop. Fire rescue's normal responses to emergencies are hindered due to overwhelming traffic influxes that overwhelm the outdated infrastructure.
Sheriff's office also did Struggles with this as well when they need to get to and from calls for our citizens of Pasco County. I feel safe living in Pasco because of our deputies. Thank you guys, we appreciate it. He's back there watching over us now. Traffic accidents are increasing at an alarming rate. Our auto insurance companies tell us it will continue to increase due to population density. This is how our premiums are formulated. I will say that standing before you today, I feel like I am asking for basic rights of life. I have anxiety if I were standing before a federal court judge playing for one's life, and yet I only
have 180 seconds to ask for it. I feel like I am a stakeholder. I really hope I am. I live here, I go to church here, I like holding doors, so you we may have met. May I keep my way of living. Can my children's babies witness nature the way we have it now? Starkey Park is beautiful. So is my backyard. Please can I keep it? The other people in this on this list here could not make it. I speak for them. How about some of that integrity, compassion, and teamwork we all talked about? It's been difficult knowing that some of us get unlimited time and consultation time.

Kathy Julianmy name is Kathy Julian. I live at [address removed]. And I was sworn in. Um I don't live directly in this area that we're discussing today, but I do it's between my house and my office, so I drive by there every day and when I saw that sign pop up All I could think was Foxfire when it makes those two ninety degree turns is gonna be a nightmare. I mean I've probably almost been hit there three or four times. My friend's car was total pulling out of that neighborhood. Um crossing fifty two. So we do need a stoplight at that area 'cause she could have been killed.
Um I was actually asked by her to come and read a statement. Because she couldn't be here today, but She lives by the other area that's been cleared for a new development. One night when I was dropping her off, I know Mr. Mariano was actually there witnessing what was happening. Their house has cracked. because of the development that's happened. Apparently it's messed up the water tables. I don't understand that. I'm an accountant, not a engineer. Um But it's not really fair. The other thing that's not really fair
is this new neighborhood is coming in, you're putting in sixty houses and you're only charging them six hundred thousand dollars and it's gonna cost two point eight to put the road in to service them. That's not fair. We as taxpayers should not be paying. If those people want houses there, great. If they have the right to do it, great, but they should be paying for the infrastructure that's required. We should be raising our impact fee.
all of this construction to happen and then it the $2.1 million falls back on the taxpayers. Our taxes are high. I pay $7,000 a year for my house, $5,000 for my office. I mean that's a lot of money. You never own property because you pay seven thousand dollars a year in property tax on property that you've already paid off. It's just not fair. And you know, you guys I know that Jack works for us because I have reached out to him on numerous occasions and he has driven across the county to go look at something because somebody
reached out to me and said, hey, I don't know what to do about this. So I reached out to Jack and he was nice enough on a weekend to go check out what was happening with the flooding on the other side of the county. We've got so many issues in this county with flooding. How do we put in all this new development? How do we know this new development isn't gonna flood the people that are currently living there? Do we care? If these people that are living there, if their properties become flooded because we put in new construction. It seems like in a lot of cases they don't care. And that is very disheartening as a citizen of this county. You know, because
all these people here, they have beautiful property. I drive by it every day. And they're nice. I mean I would love to live out there. I don't not bless to but their property should not be damaged or flooded because we've let new construction in. And I the other thing that I don't believe for a second is where that cul-de-sac is that's right by Foxfire. What's the guarantee that that's not that a road is not put through to Foxfire. What is the guarantee on that? Who is guaranteeing that there won't be a road put through to Foxfire? Foxfire
can't handle the traffic now. It definitely won't be able to handle it then. Thank you.

Bridget Ericksongo ahead. Spot zoning is where a small area is rezoned for an use inconsistent with the surrounding area. As it can benefit a developer at the expense of the community and the property owners. We are not developers, we're agriculture. This is what's going on here. Spot zoning involves changing the zoning of a small parcel of land to allow use that differs significantly from the surrounding areas, often for the benefit of a specific property owner or developer. It disrupts the community plan. Spot zoning is for is changing. the intended
character of a neighborhood. That's what's going on. Special favors. It can be seen as giving special treatment to a developer or property owner, potentially leading to unfairness or corruption. It has a negative impact on the neighbors. Changing in zoning can negatively impact our neighboring property, property values, traffic, and the overall quality of our lives. Legitimate public purses. Zoning changes, including spot zoning, must generally serve a legitimate public purpose, such as promoting health, safety, or welfare. This project does none of the three. Uh
if spot zoning is deemed arbitrary or not in the public interest, it may be struck down as a violation of the process. Example, you're changing trying to change it from agriculture to residential. That's spot zoning. Uh water and soil pres pollution. These are all articles, World Hul Health Organization. Construction activities are a significant source of air pollution, primarily due to dust, emissions from machinery, and the use of harmful chemicals and materials. These pollutants can negatively impact human health and the environment. Dust, chemicals, asbestos, green
lines gas emissions, particulate matter, other pollutions. Uh one thing at conduct construction sentiment, the greatest threat to water quality. That's my neighbor talking about the well the one she she's my neighbor. Washington Stormwater. Oil and grease, construction machinery and equipment can release oil and grease, contributing to water pollution and pos posing risk to aqu aquatic life. Air pollution. The one thing I want to get in out of this article is since we're so c crest for time, the main construction contaminants that spread around
by wind, particular matter with a diameter of less than ten microns gen generating flu polluted dust. Water pollution. The surface water runoff and the groundwater close to a construction site becomes polluted with various materials used in the construction work. As described for air pollution, the following construction contaminants can pollute water: VOGs, paints, glues, diesel, oils, other toxic chemicals, and cement. Both of these groundwaters below your home. And surface runoff close to your home will constitute a
source of pollution emanating from the construction sites. Domestic animals and pets may drink contaminated water and soil may become contaminated too. We all have well water. My horses drink that water. My dogs drink that water. I drink that water. You're contaminated. Additionally, once the groundwater below your home becomes contaminated, it may affect you in the following ways through indirect consumption. Soil pollution, all this da da da. It uh from the perspective of the public, the best prevention is to spread as little time as possible outside.
So telling us we have to stay inside while construction is going on. Secondly First of all, you were trying to take my house. Now you're gonna try to put a freeway in front of my house. Both things are unacceptable. You've tried to put through my house, which that was an error on the planning commission. They should have noticed that there was a house there. That was poor planning on your part. Thank you. Now you're trying to put a freeway in my house.

Barbara and her team came and we really appreciate them sitting down and listening to our concerns and we felt heard. But we want to make sure some of the things said about the traffic. and the infrastructure goes through and are put in place because I feel like the infrastructure needs to we
have nothing against the growth, but we want the in infrastructure to be able to support the growth. And we're not in Piked because fifty two in Colony is a nightmare. No traffic signal. You can't make a left turn. You have to make a U turn. When you return home you got to make a U turn. And like they were saying, it's no deceleration lane. We you got the be ready to turn and you're not sure if you're coming out of somebody's turning into the store or where they're going or if they're gonna keep s um straight. So
it's a lot of issues that need to be addressed o um with the traffic and then with the flooding. That is a big concern we have with what's gonna happen with the flooding um once they put in these these subdivisions because we're the water is not gonna have anywhere to go. I know they were saying something about a de a dedicated lake. I'm not sure. How that works or what that has to do with the water or controlling the flooding once they take away all this all our trees and like they were saying
the wildlife you wake up and see anything in your yard now it's like a you wake up and see turkeys and deers. We have all kind of things that don't have anywhere to live now that's coming into our yards for us to help take care of them. So I really appreciate th that you're taking the time to listen to us and I definitely Anything they're gonna do to the infrastructure to be in writing and some of these things are being in writing where they can't be changed. And
so I want to thank you for your time today and I hope you consider the things that we said. And we love living on Fox Ride. We love Hudson. Thank you.

Barbara WilhiteProbable height for the applicant. Um the water we'll have central uh water and sewer, which is county water and sewer. We will not have wells or septic. Um and that comes up from colony up towards this project from I think around the Fairwinds area up to this project. The heard numerous times about Ms. Santero said that a builder changed the layout and and Mr. Wynn said, Well is it really binding? And Ms. Harris said the same thing, you know, are we
really b you know, how do we know things won't change? Um Ms Ms. Julian cul-de-sac, is that really a guarantee? I can tell you as I told the residents that, you know, when my when my clients say something, I make sure they do it. And so I toiled over the language even with the cul-de-sac guarantee with Mr. Goldstein this morning, like We wanted to do more than just say you can't have we're gonna have a cul-de-sac and no access to Foxfire. We actually negotiated language to go on the plat. to make sure when it's platted that's protected. So we our our plan is a
binding concept plan. So when you see where the all the the ponds are, that's where the ponds will be. So I I know it I know it's hard to believe that, but for if as I've as a resident because it always hasn't been that way, but we really went the extra mile to make sure and I always do that to make sure that if we commit to something we do it. With regard to wildlife, we did do a wildlife survey. Barbara? Yeah.

Point it there and then take the uh another sliver to the other side around it. This way the people that have it will have ownership. And then that will even be better for them n never to change it.

So I was gonna say regarding wildlife We do a survey at the time of rezoning, a listed species survey. It's done again, the only good for 15 m 18 months. We do them again when we come in for our plans, our development plans. But there's also an ongoing obligation. If there's listed species on the site while we construct, we have to address those. So it's not like a we just look at it one time, we look at it multiple times, then we have an ongoing obligation regarding protection of listed species.

OakleyUm can you speak to the uh infrastructure that's coming? You I think you made comment that you talked to F D O T about fifty two and calling in.
Barbara WilhiteWe don't know.
OakleyIt's important to the people, so
Barbara WilhiteRight. I I'll try to do a good job. I know we have Steve Henry here too, but again this was researched that came up at Planning Commission. Um it was researched by your staff actually with at Content F F D OT. They have sixty percent design plans. from not only the intersection with Shadow Ridge but the intersection of colony and how they're gonna fix that. So they're well into their process of knowing that's an issue and fixing it. Um and with your all of you contacting them, I'm sure that helps as well. It is a full median at colony
and as as Mr. Henry explained to me with the development that's being approved, that needs to be told to F D O T so that they signalize it. So that's the that's the key there.

Because he's got aside from this, he seemingly has some discrepancies or a variation in the amount of uh feet of the right of way within his property and I was hoping you could explain how this more organizes what he has going on on his his place
there.
Barbara WilhiteSo there's multiple things that you all have done to address improvements to Colony Road over time. You have a route study that has a hundred and twenty four foot corridor which goes into his property. You have right-way preservation tables that provide for a hundred and forty two feet, I think. Um And that also goes into his property and and what happens with those right-of-way preservation tables, if you come in for a building permit to do a shed within the right-of-way preservation area, you're told you can't do
that. So what you all need to do is hopefully you will support this project, but have staff go in and amend those tables uh so that you are consistent with the the sixty foot right of way section that the county engineer is supporting and suggesting to you, but you'll want to actually get in there and do the other paperwork to make sure that the sixty feet is what you do moving forward so that people all along the quarter don't have issues with the fact that their property could be within a quarter preservation area.
WeightmanSecond Vice ChairSo um Mr. Goldstein, so to do that. What steps what's next steps with that piece of this uh equation here? That way it gives you the property to the south. You know, he's not handcuffed. of whatever he might want to do with it in the future and he can gain more of his property

And then to today how the lots have been subdivided and subdivided and subdivided. into the future land use of what this current project is. I think that's just an important visual that way people can see How this area has evolved and what property owners have done with their property because they're legally able to do
it over the course of time. And Uh I think it's just an important picture to see um how this area has changed. in that the property owners and each one of you that own property do have the ability to subdivide your property If you choose to um and that what's going on here and you can see the big section in the north East Corner it's it's it's not a new Phenomenon. I mean the the map on the left's from the nineteen seventies and
the one on the right's from twenty twenty five. So I just think that was an important visual for folks to see as we're making the decision because
Fairness in owning property. The crux of this is the palm winds, and this this is what frustrates me with this, is the palm winds project. pushed this road west to the Sackleson property and seemingly they had no idea. It was a uh an example of a can that's been kicked And it forced a road west that impacted the property that we'll be voting on today and then the properties to the south of it. Um and quite frankly that was It
was disappointing to to see how that gamesmanship was done. Um And when you talk about fairness it wasn't fair to do to the Sacelson piece. Uh What? Coulda wulda shoulda's. gone gone by and what we know about the the Palmlands property east of here. But moving forward, I hope staff takes this real life example of how these roads are just pushed and when things come and it's a it's a surprise to everybody We need
to have a better plan, a better communication plan to the residents in the area. Uh I think when we have the Swasselands where projects are coming that we just shouldn't unless there's good reason to move vision roads like we've had in examples like this. Um and we get we get better at this exercise. So um I don't know if Ms. Whyde or Staffy have any comments on the points I've I've brought up today. But uh I just thought it was
important to to share these things.

And let's see I've got the money that I need all except for the seven hundred grand. that you guys will confirm to put up if we're ready to put up that seven hundred grand at that moment.

uh new alignment may actually help them with taking care of that. But as I look at the road, whether the road gets done or not, I'm not so concerned. I will say something that does concern me a little bit as thinking this through. I think that's a good thing. If we look at the number that's here at two point one million is what we're going to need. I think we should also look to include to try to put at least a trailer or a sidewalk, whatever it's going to be, running up from fifty-two colony all the way up to. So if there are any children, whatever, there's you know the Dunkin' Donuts down there retail.

But it's all west of the Sun Coast Parkway. Right. So to your point, Cowier is in zone two. So the difference of so it is on the other side.

So just know that she's out there watching. Uh I I also want to say one of the things that we are we hear you as far as the need for connectivity in this area. I hear you as as to the importance of that, and we will seek to try to make that happen in
a most in the most efficient way possible. Acknowledging some trade-offs. One of the things that you wrote you brought up toward the end of the discussion was the provision of pathways. One of the constraints on Colony Road is the right-of-way footprint that we control. So the wider that footprint gets, the more right-of-way we have to go out and acquire, and that makes it a more challenging project to implement. So what I would like is just to for the board's awareness that I hear you that we need to look at advancing connectivity in the development of
our CIP for your approval as part of this fiscal twenty-six budget season. Please don't give me too many constraints to operate within so that we can try to achieve the outcomes that you're seeking. Without unintended ancillary impacts. Right.
MarianoVice ChairWell and Nick, and I I'm happy to work with you on it. Again, I just I can't talk to my board members unless I'm in front of them, so we have to have the discussion now.
